Resolution No. 6782 1 RESOLUTION NO. 6782 2 5 6 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON APPROVING AND AUTHORIZING THE EXECUTION OF A MEAD~PHOENIX PROJECT COMMUNICATIONS AGREEMENT (WESTERN CONTRACT NO. 94-PAO-10585) BY AND AMONG ARIZONA PUBLIC SERVICE COMPANY, M-S-R PUBLIC POWER AGENCY, SALT RIVER PROJECT AGRICULTURAL IMPROVEMENT AND POWER DISTRICT, SOUTHERN CALIFORNIA PUBLIC POWER AUTHORITY, THE UNITED STATES OF AMERICA AND THE CITY OF VERNON 3 4 7 WHEREAS, the City of Vernon by Resolution No. 5895 on 8 September 23, 1991, approved the Project Agreements for the Mead- 9 Phoenix Project; and 10 WHEREAS, the following parties have ownership interests in 11 the Mead-Phoenix Project: 12 Arizona Public Service Company 13 M-S-R Public Power Agency 14 Salt River Project Agricultural Improvement and Power 15 District (hereinafter "SRP") 16 Southern California Public Power Authority 17 The United States of America acting through the Western 18 Area Power Administration (hereinafter "Western") 19 City of Vernon; and 20 WHEREAS, pending the adoption of the Mead-Phoenix Project 21 agreements, SRP began the construction of a microwave communication 22 system to provide a communication link between the Westwing 23 SUbstation/Perkins Switchyard in Arizona and the Mead and 24 Marketplace Substations in Nevada; and 25 WHEREAS, the parties desire to have the SRP microwave 26 communication system transferred to Western as one of the Mead- 27 Phoenix Project Managers, which agency will hold it on behalf of the 28 Mead-Phoenix Project owners; and 1 WHEREAS, the parties also desire to have Western complete 2 the last segment of its own communication system from the Mead 3 Substation to the Westwing Substation at the expense of the Mead~ 4 Phoenix Project owners for the purpose of providing a back-up 5 communications link for the Mead-Phoenix Project; and 6 WHEREAS, a Mead-Phoenix Project communications Agreement 7 (Western Contract No. 94~PAO-10585) has been negotiated by the 8 parties to accomplish the above purposes; and 9 WHEREAS, the Director of Light and Power has recommended 10 approval of said Agreement. 11 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE 12 CITY OF VERNON AS FOLLOWS: 13 SECTION 1: The City Council of the City of Vernon hereby 14 finds and determines that the recitals contained hereinabove are 15 true and correct. 16 SECTION 2: The City Council of the City of Vernon hereby 17 approves the Mead-Phoenix Project Communications Agreement among the 18 above~named parties, a copy of which has been presented to the City 19 Council concurrently with this resolution, and the city Council 20 hereby orders said Agreement to be received and filed by the City 21 Clerk. 22 SECTION 3: The City Council of the City of Vernon hereby 23 authorizes the Mayor and the City Clerk to execute said Agreement 24 for, and on behalf of, the City of Vernon. 25 III 26 III 27 III 28 III -2- .. 1 SECTION 4: The City Clerk of the City of Vernon shall 2 certify to the passage of this resolution, and thereupon and 3 thereafter the same shall be in full force and effect. 4 APPROVED AND ADOPTED this 16th day of April, 1996. 5 6 9 BRUCE V.
