A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON GRANTING THE DISABILITY RETIREMENT OF RAY
F. SHELTON, A LOCAL SAFETY MEMBER EMPLOYED BY
THE CITY OF VERNON (Government Code sections
21024 and 21025)

WHEREAS, the City of Vernon (hereinafter referred to as
7
"Agency") is a contracting agency of the Public Employees'
Retirement System; and
8

WHEREAS, the Public Employees' Retirement Law requires
10
that a contracting agency determine whether an employee of such
agency in employment in which he is classified as a local safety
11
12
member is physically or mentally incapacitated to perform his
13
duties for purposes of the Public Employees' Retirement Law; and
14
WHEREAS, Ray F. Shelton, employed by the Agency in the
15
position of Fire Captain, on or about November 13, 1995, filed an
16
application for disability retirement with the Public Employees'
Retirement system, and the Public Employees' Retirement System
17
18
requested the Agency, on or about April 24, 1996, to make a
determination regarding whether Ray F. Shelton was incapacitated
for the performance of his duties and therefore eligible to retire
for disability; and

WHEREAS, by letter dated April 29, 1996, Bruce V.
Malkenhorst, the City Administrator, notified Ray F. Shelton that
23

the matter of his orthopedic disability retirement based on the
25
findings contained in the medical reports would be considered by
the City Council; and
26

WHEREAS, the City Council of the City of Vernon has

determines that the permanent and stationary date for retirement

purposes is February 18, 1996, that the last day Ray F. Shelton
was on the City's payroll was February 17, 1996, that Mr. Shelton
retired effective February 18, 1996, and that no dispute as to the

expiration of such leave rights is pending.

SECTION 4: The City Clerk shall notify RayF. Shelton of
7
the City council's determination granting his application for
8
disability retirement.
9
SECTION 5: The City Clerk of the City of Vernon shall
10
certify to the passage of this resolution and thereupon and
thereafter the same shall be in full force and effect.
11

APPROVED AND ADOPTED this 7th day of May, 1996.

Mayor of the city of Vernon.
