A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON APPROVING AND AUTHORIZING THE EXECUTION OF
A WATER RIGHT LICENSE BY AND BETWEEN THE CITY OF
VERNON AND KAL-KAN FOODS, INC. WHICH GRANTS THE
CITY OF VERNON A LICENSE TO EXTRACT 140 ACRE-FEET
OF KAL-KAN'S ALLOWED PUMPING ALLOCATION FOR THE
PERIOD JULY 1, 1996 THROUGH JUNE 30, 1997

WHEREAS, the City of Vernon and Kal-Kan Foods, Inc.

(Kal-Kan) have entered into annual agreements since 1990 providing
9
for the City to lease 140 acre-feet of Kal-Kan's allowed pumping
10
allocation; and
11
WHEREAS, the Director of Community Services & Water and
12
Kal-Kan have negotiated a new Water Right License with an agreed
13
price for the period of July 1, 1996 through June 30, 1997 of
14
Seventeen Thousand Five Hundred Dollars and No Cents ($17,500.00),
15
and said money will be applied as a credit towards Kal-Kan's regular
16
water bills; and
17
WHEREAS, the City of Vernon sent a "Statement" of account
18
dated June 11, 1996, which provides that the sum of Seventeen
19
Thousand Five Hundred Dollars and No Cents ($17,500.00)
(for

1996-97)
will be applied to the Kal-Kan Water Account No.
21
12-19740-01-0; and

WHEREAS, Mr. Howard Jacob, the Commercial Manager for
23
Kal-Kan, signed said statement on June 13, 1996, agreeing thereto.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:

SECTION 1: The City Council of the city of Vernon hereby
finds and determines that the recitals contained hereinabove are

true and correct.

SECTION 2: The City Council of the city of Vernon hereby
2 approves the Water Right License and said Statement, copies of which
3 have been presented to the City Council concurrently with this
4 resolution, and the City Council hereby orders said License to be
5 received and filed by the City Clerk.

SECTION 3: The City Council of the City of Vernon hereby
7 authorizes the Mayor and the City Clerk to execute said License for,
8 and on behalf of, the City of Vernon.

SECTION 4:
The City Clerk of the City of Vernon shall
10 certify to the passage of this resolution, and thereupon and
11 thereafter the same shall be in full force and effect.
12 APPROVED AND ADOPTED this 9th day of July, 1996.
