A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A CONDITIONAL USE
PERMIT TO USF DISTRIBUTION SERVICES, INC.
FOR THE OPERATION OF A TRUCK TERMINAL AT
2230 38TH STREET
WHEREAS, USF Distribution Services, Inc. has
applied for a conditional use permit to operate a truck
terminal at 2230 38th Street in the City of Vernon; and
WHEREAS, the City Council of the City of Vernon
held a hearing on said application for a conditional use
permit on August 20, 1996; and
WHEREAS, the proposed site is a conforming use in
the General Industrial (M) Zone which has been continuously
used as a truck apdfreight terminal previously operated by
Willig Freight Lines and which requires a conditional use
permit under the Zoning Ordinance in order to continue the
use; and
WHEREAS,the proposed operation will use the
propert;.y asa truck terminal for approximately 15 trucks;
and
WHEREAS, the proposed site is approximately 11.9
acres in size, contains three buildings, and the size,
shape, topography and drainage of the parcel are adequate
for the proposed operation; and
WHEREAS, a barrier wall or landscaping will be
installed where parking or maneuvering areas adjoin a public
street pursuant to the Vernon City Code; and
WHEREAS, the proposed site is surrounded by
1 industrial uses compatible with the proposed use and no
2 adverse effect from traffic, parking, noise, odors, dust,
3 smoke, light or glare, or risk of fire, infection or
4 explosion is anticipated from the proposed operation; and
5 WHEREAS, the site has access to 38th Street and in
6 general traffic will travel east on 38th Street to the 710
7 Freeway or west on 38th Street to Alameda Street going north
8 to the 10 Freeway; and the streets to be utilized within the
9 City of Vernon are sufficient to handle the traffic
10 generated from the proposed operations; and
11 WHEREAS, the site is required to have adequate
12 offstreet parking and loading facilities in accordance with
13 the Vernon City Code; and
14 WHEREAS, the conditions imposed on the conditional
15 use permit will adequately protect the public health, safety
16 and general welfare and the operation is consistent with all
17 applicable rules and laws of the City of Vernon; and
18 WHEREAS, the proposed use as to location,
19 operation, and design is consistent with the General Plan
20 and the Zoning Ordinance of the City of Vernon; and
21 WHEREAS, the project was found to be categorically
22 exempt from the California Environm.ental Ouality Act as an
23 existing facility pursuant to Section 15301 of the
24 California Environm.ental Quality Act Guidelines and a Notice
25 of Exemption shalL be. filed with the County Clerk pursuant
26 to Section 15062 of the California Environmental Quality Act
27 Guidelines.

1 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
2 OF THE CITY OF VERNON AS FOLLOWS:
3 SECTION 1: The City Council of the City of Vernon
4 hereby finds and determines that the recitals contained
5 hereinabove are true and correct.
6 SECTION 2: Subject to the conditions set forth
7 below, the conditional use permit is granted to USF
8 Distribution Services, Inc. for the operation of a truck
9 terminal at 2230 38th Street.
10 SECTION 3: In order to adequately protect the
11 public health, safety and general welfare the following
12 conditions are imposed:
13 a. The facility shall be operated in accordance
14 with all current codes, rules, regulations and subject to
15 permit fees as adopted by the City of Vernon. All trucking
16 operations, including truck and trailer parking, shall be
17 limited to the lot located at 2230 38th Street in the City
18 of Vernon.
19 b. If any portion of a building remains vacant
20 for a period greater than one year, the building shall be
21 made to conform with all current codes, rules and
22 regulations.
23 c. All parking and loading facilities shall be
24 paved with a hard durable surface material and shall be
25 adequately drained, and kept free of dust, mud, trash and
26 weeds. Where parking or maneuvering areas adjoin the public
27 street a barrier wall or landscaping shall be installed to
28 meet City standards.

1 d. Servicing of vehicles including washing, steam
2 cleaning and repairing shall be performed in facilities in
3 compliance with appropriate codes.
4 e. A National Pollutant Discharge Elimination
5 System Permit shall be obtained from the California State
6 Board of Water Resources.
7 f. No equipment or freight shall be stored on the
8 site, other than in buildings, trailers or on the docks.
9 g. Adequate plans and materials must be available
10 for handling leaks or spills from vehicles during storage or
11 transportation.
12 h. All required federal, state, local and
13 regulatory agency permits shall be obtained prior to
14 operation. Prior to occupancy a business license and
15 occupancy permit shall be obtained.
16 i. A hazardous materials inventory and
17 businesslcontingency plan shall be submitted and a hazardous
18 materials permit shall be obtained from the City of Vernon
19 Health Department. Hazardous materialslwastes shall be
20 handled and managed in compliance with all appropriate
21 federal, state and local laws.
22 j. The facility's buildings shall be structurally
23 maintained to exclude rodents and the property shall be
24 maintained rodent free.
25 k. The facility shall be operated in a manner
26 which will not impede traffic on 38th Streets.
27 1. All existing cracked sidewalk, curb and gutter
28 adjacent to the site on 38th Street shall be repaired and

1 maintained to meet City Standards.

m. The facility shall be operated in a manner
3 that will prevent unsanitary conditions, odors or other
4 nuisances. The property shall be provided with adequate
5 refuse containers and refuse disposal service.

n. Toilet rooms shall be provided with adequate
7 ventilation, lighting and wall mounted single service soap,
8 towel and toilet paper dispensers.

o. Approved drinking water facilities shall be
10 provided for employees.

SECTION 4: The City Clerk of the City of Vernon
12 shall certify to the passage of this resolution and
13 thereupon and thereafter the same shall be in full force and
14 effect.

Gentlemen:
USF Distribution Services, Inc. has applied for a
conditional use permit to operate a truck terminal at 2230 38th
Street.
Herewith for your consideration are the following supporting
documents:
1. Request for conditional use permit and information
supporting the application.
2. Engineer's Report.
3. Notice of Public Hearing, copies of notification letters
to owners and tenants in the area and affidavits of posting and
mailing.
USF Distribution Services, Inc. was found to be
categorically exempt from the California Environmental Quality
Act process, since they will be using an existing truck t~rminal
and the facility is not being expanded.
In my opinion the proposed operation will pose no adverse
effects to the City of Vernon and will not have a significant
effect on the environment, and no mitigating measures are
required.

It is recommended that the City Council find that the

filed with the County Clerk and the conditional use permit be
granted with the following'conditions:

THE MAJORITY OF TRUCK TRAFFIC WILL BE BETWEEN 9 AM AND 6 PM.

ENGINEER'S REPORT
ON USF DISTRIBUTION SERVICES, INC.
CONDITIONAL USE PERMIT TO OPERATE A
TRUCK TERMINAL AT 2230 38TH STREET
(August 15, 1996)
USF Distribution Services, Inc. has applied for a
conditional use permit to operate a truck terminal at 2230 38th
Street in the City of Vernon. USF Dis~ribution Services, Inc. is
a trucking company providing pick-up and delivery service of a,
wide range of items.
1. GENERAL PLAN The proposed use conforms to the Zoning
Ordinance and the General Plan. The site is presently being used
as a truck and freight terminal.
2. SITE The proposed site is approximately'11.9 acres in
~
size and contains three buildings; a cross dock terminal, garage
and storage shed. The size, shape, topography and drainage of
the parcel are adequate for the proposed operation.
3. ADVERSE AFFECT The proposed site is surrounded by
industrial uses compatible with the proposed use and no adverse
noise, odor, dust, smoke, light or glare, or risk of fire,
infection or explosion is anticipated from the proposed
operation.
4. ACCESS The site has access to 38th Streeb. This street
is of adequate size to handle the traffic generated from the
proposed operation.
5. TRUCK MOVEMENTS USF Distribution Services, Inc. will
operate approximately 15 trucks at the facility. Trucks will
travel east on 38th Street to Bandini Boulevard then to the 710

Freeway or west on 38th Street to Alameda Street going north to
the 10 Freeway.
6. STATE OR FEDERAL CONDITIONS There are no coriditions
imposed by State or Federal law.
7. CONDITIONS It is recommended that the following
conditions be set on the permit to adequately protect the public
interests:
a. The facility shall be operated in accordance with
all current codes, rules, regulations and subject to permit fees
as adopted by the City of Vernon. All trucking operations,
including truck and trailer parking, shall be limited to the lot
located at 2230 38th Street in the City of Vernon.
b. If any portion of a building remains vacant for a period
greater than one year, the building shall be made to conform with
all current codes, rules and regulations.
c. All parking and loading facilities shall be paved with a
hard durable surface material and shall be adequately. drained,
and kept free of dust, mud, trash and weeds. Where parking or
maneuvering areas adjoin the public street a barrier wall or
landscaping shall be installed to meet City standards.
d. Servicing of vehicles including washing, steam cleaning
and repairing shall be performed in facilities in compliance w~th
appropriate codes.
e. A National Pollutant Discharge Elimination Sy.stem Permit
shall be obtained from the California State Board of Water
Resources.

f. No equipment or freight shall be stored on the site,
other than in buildings, trailers or on the docks.
g. Adequate plans and materials must be available for
handling leaks or spills from vehicles during storage or
transportation.
h. All required federal, state, local and regulatory agency
permits shall be obtained prior to operation. Prior to occupancy
a business license and occupancy permit shall be obtained.
i. A hazardous materials inventory and businesslcontingency
plan shall be submitted and a hazardous materials permit shall be

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A CONDITIONAL USE
PERMIT TO USF DISTRIBUTION SERVICES, INC.
FOR THE OPERATION OF A TRUCK TERMINAL AT
2230 38TH STREET

WHEREAS, USF Distribution Services, Inc. has
applied for a conditional use. permit to operate a truck
terminal at 2230 38th 'Street in the City of Vernon; and

WHEREAS, the City Council of the City of Vernon
held a hearing on said application for a conditional use
permit on August 20, 1996; and
WHEREAS, the proposed site is a conforming use in
the General Industrial (M) Zone which has been continuously
used as a truck and freight terminal previously operated by
Willig Freight Lines and which requires a conditional use
permit under the Zoning Ordinance in order to continue the
use; and
WHEREAS, the proposed operation will use the
property as a truck terminal for approximately 15 trucks;
and
WHEREAS, the proposed site is approximately 11.9
acres in size, contains three buildings, and the size,
shape, topography and drainage of the parcel are adequate
for the proposed operation; and
WHEREAS, a barrier wall or landscaping will be
installed where parking or maneuvering areas adjoin a public
street pursuant to the Vernon City ,Code; and
WHEREAS, the proposed site is surrounded by
industrial uses compatible with the proposed use and no
