RESOLUTION NO. 6842
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON APPROVING AND AUTHORIZING THE EXECUTION
OF A SETTLEMENT AGREEMENT IN THE LITIGATION
ENTITLED CITY OF SOUTH GATE. ET AL. VS. CITY OF
LOS ANGELES. ET AL., LASC NO. BC 129447, COURT
OF APPEAL NO. 2ND CIV NO. B100019
WHEREAS, the Cities of Compton, Lynwood, South Gate and
and the Association for the Mitigation of Transportation

Impacts composed of the above-referenced four cities and taxpayers
10
Anita o. Aviles and Edward Saenz filed a complaint in the Los
11
Angeles Superior Court against the city of Los Angeles, Port of
12
Los Angeles, Board of Harbor Commissioners of the City of Los
13
Angeles, City of Long Beach, Port of Long Beach, Board of Harbor
14
Commissioners of the City of Long Beach raising, among other
15
issues, the validity of the Third Amendment to the Joint Powers
Agreement between Los Angeles and Long Beach, which established
16
17
the Alameda Corridor Transportation Authority; and
18
WHEREAS, the litigation is presently pending in the Court
19
of Appeal; and
20
WHEREAS, the cities of Long Beach and Los Angeles, and
the Ports of Long Beach and Los Angeles have made an offer of
settlement to the plaintiffs in this matter which, if accepted,
will completely settle this litigation; and

WHEREAS, the city of Huntington Park and SECTA have been
25
made parties to this proposed Settlement Agreement in order to
26
fully implement the settlement as proposed.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:

SECTION 1: The City Council of the City of Vernon does
2 hereby find and determine that the recitals contained hereinabove
3 are true and correct.

SECTION 2: The City Council of the City of Vernon hereby
5 approves the Settlement Agreement tendered by the defendants
6 herein, in the litigation entitled City of South Gate. et al. vs.
7 City of Los Anqeles. et al.. LASC No. BC 129447, a copy of which
8 has been presented to the City Council concurrently with this
9 resolution, and the City Council hereby approves such settlement.

SECTION 3: Upon receiving notification that all parties
11 to the Settlement Agreement have approved the Agreement, the Mayor
12 is authorized to execute the Agreement in twelve (12)
13 counterparts.

SECTION 4: The City Clerk of the City of Vernon shall
15 certify to the passage of this resolution and thereupon and
16 thereafter the same shall be in full force and effect.

APPROVED AND ADOPTED this 15th day of August, 1996.
