Resolution No. 6844 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 ~ ~ 24 ~ 26 27 28 RESOLUTION NO. 6844 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON GRANTING A VARIANCE TO KENWOOD REALTY CORPORATION AND A & B STERN FAMILY TRUST FROM SECTION 26.4.2-8, DEVELOPMENT STANDARDS, OF THE COMPREHENSIVE ZONING ORDINANCE, FOR THE PROPERTY LOCATED AT 1900 & 1950 25TH STREET IN THE CITY OF VERNON WHEREAS, Kenwood Realty Corporation and A & B Stern Family Trust own a parcel of property located at 1900 and 1950 25th Street in the City of Vernon and have requested a variance from conformance with Section 26.4.2-8, Development Standards, of the Comprehensive Zoning Ordinance; and WHEREAS, the building is used for warehousing and the physical condition of the property is unique in that the existing building measures approximately 50,000 square feet and was constructed with six non-conforming truck loading spaces measuring 9.0 in width and 59.0 feet in length. The spaces cannot be brought into conformance with the Zoning Ordinance without recessing the building wall and relocating the loading dock doors; and WHEREAS, Zoning Ordinance Section 26.4.2-7 (b) requires three truck lQading spaces for buildings with a gross floor area between 25,001 and 50,000 square feet in size; and WHEREAS, Zoning Ordinance Section 26.4.2-8 (c) specifies that each truck loading space shall be a minimum of 10 feet wide and 65 feet long, and Section 26.4.6-4 (c) provides that a non-conforming building must comply with these standards within 5 years of April 18,1989 unless a variance is granted; and 1 WHEREAS, there is insufficient space on the property 2 and the application of the development standards for the truck 3 loading space requirements will create an unreasonable hardship 4 by requiring the non-conforming spaces to be 10 feet wide by 65 5 feet long; and 6 WHEREAS, Kenwood Realty Corporation and A & B Stern 7 Family Trust have indicated that they have plans to recess the 8 two center truck loading spaces to 81.0 feet in length and 9.0 9 feet in width; and 10 WHEREAS, 1900 and 1950 25th Street are located in the 11 M zone and their operation is consistent with the objectives of 12 the General Plan and Zoning Ordinance; and 13 WHEREAS, the City Council of the City of Vernon held 14 a hearing on said application for a variance on September 3, 15 1996. 16 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF 17 THE CITY OF VERNON AS FOLLOWS: 18 SECTION 1: The City Council of the City of Vernon 19 hereby finds and determines that the recitals contained 20 hereinabove are true and correct. 21 SECTION 2: A variance from Section 26.4.2-8 of the 22 Comprehensive Zoning Ordinance, requiring all truck loading 23 spaces to be 10 feet wide by 65 feet long, is hereby granted to 24 Kenwood Realty Corporation and A & B Stern Family Trust at 1900 25 & 1950 25th Street. 26 SECTION 3: The variance shall be granted subject to 27 the following conditions: 28 (a) Kenwood Realty Corporation and A & B Stern Family 2 1 Trust shall bring the two center truck loading spaces measuring 2 59.0 feet in length and 9.0 feet in width to 81.0 feet in 3 length and 9.0 feet in width to accommodate longer trucks. 4 Plans for said construction shall be submitted within one month 5 of adoption of this resolution. Permits shall be obtained for 6 said work within two months of the adoption of this Resolution. 7 Construction shall be started on said work within three months 8 of the adoption of this Resolution, and construction shall be 9 completed within six months of the adoption of this Resolution. 10 (b) The usage of the four non-conforming truck 11 loading spaces 59.0 in length shall be limited to trucks of 12 smaller lengths so that no trucks parked at the loading docks 13 shall extend into the street right-of-way as shown on the 14 Master Plan of Streets, dated June 16, 1992. 15 (c) Within one month of the adoption of this 16 Resolution, Kenwood Realty Corporation and A & B Stern Family 17 Trust shall deliver a $10,000 Certificate of Deposit to the 18 City of Vernon, to be refunded to Kenwood Realty Corporation 19 and A & B Stern Family Trust, including the interest earned, 20 upon compliance with condition (a) or if compliance with above 21 condition (a) has not been attained then the Certificate of 22 Deposit shall be retained by the City of Vernon to construct 23 curb, gutter, sidewalk and a suitable barrier to eliminate the 24 usage of all non-conforming loading docks. 25 (d) All existing and future tenants shall be notified 26 of these restrictions and a condition stating the same shall be 27 placed in all future leases. 28 III 3 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SECTION 5: The City Clerk of the City of Vernon shall certify to the passage of this resolution and thereupon and thereafter the same shall be in full force and effect. Financiai Way Glendora, CA 91741 $teven T. & Margaret Judson 2009 25th Street Vernon, CA 90058-1101 ~~. . ~ ENGINEER'S REPORT KENWOOD REALTY CORPORATION AND A & B STERN FAMILY TRUST 1900 AND 1950 25TH STREET VARIANCE APPLICATION AUGUST 14, 1996 Kenwood Realty Corporation and A & B Stern Family Trust have requested a variance from the Comprehensive Zoning Ordinance Section 26.4.2-8, Development Standards, for the property located at 1900 and 1950 25th Street in the City of Vernon. The building was constructed with six non-conforming truck loading spaces measuring 9.0 feet in width and 59.0 feet in length. They have stated they will recess the two center truck loading spaces to 81.0 feet in length and 9.0 feet in width. The other spaces cannot be brought into conformance with the Zoning Ordinance without recessing the building wall and relocating the loading dock doors. They have stated that only vehicles of smaller lengths will be used at the non-conforming truck loading spaces. The building is used for warehousing and is approximately 50,000 square feet in size~ Section 26.4.2-7 (b) requires three truck loading spaces for buildings with a gross floor area between 25,001 and 50,000 square feet in size. Section 26.4.2-8 (c) of the Comprehensive Zoning Ordinance specifies that each loading space shall be a minimum of 10 feet wide and 65 feet long and Section 26.4.6-4 (c) provides that a non-conforming building must comply with these standards within five years of April 18, 1989 unless a variance is granted. Kenwood Realty Corporation and A & B Stern Family Trust have stated that by requiring the six non-conforming truck loading spaces to be 65 feet long by 10 feet wide would be a hardship. The operation is in conformance with the Comprehensive Zoning Ordinance and General Plan. Therefore, it is recommended that the variance be granted subject to the following conditions: (a) Kenwood Realty Corporation and A & B Stern Family Trust shall bring the two center truck loading spaces measuring 59.0 feet in length and 9.0 feet in width to 81.0 feet in length and 9.0 feet in width to accommodate longer trucks. Plans for said construction shall be submitted within one month of adoption of this resolution. Permits shall be obtained for said work within two months of the adoption of this Resolution. Construction shall be started on said work within three months of the adoption of this Resolution, and construction shall be completed within six months of the adoption of this Resolution. (b) The usage of the four non-conforming truck loading spaces 59.0 feet in length shall be limited to trucks of smaller lengths so that no trucks parked at the loading docks shall extend into the street right-of-way as shown on the Master Plan of Streets, dated June 16, 1992. (c) Within one month of the adoption of this Resolution, Kenwood Realty Corporation and A & B Stern Family Trust shall deliver a $10,000 Certificate of Deposit to the City of Vernon, to be refunded to Kenwood Realty Corporation and A & B Stern ~- ~ Family Trust, including the interest earned, upon compliance with condition (a) or if compliance with above condition (a) has not been attained then the Certificate of Deposit shall be retained by the City of Vernon to construct curb, gutter~ sidewalk and a suitable barrier to eliminate the usage of all non-conforming loading docks. (d) All existing and future tenants shall be notified of these restrictions and a condition stating the same shall be placed in all future leases.
