JONES OF COUNSEL PRINCIPALS September 3, 1996 BY FACSIMILE David B. Brearley 2440 South Hacienda Boulevard, No. 223 Hacienda Heights,- California 91745-4770 • Re: Notice of Purported Termination of Joint Powers Agreement Creating the Southeast Cities Transportation Authority (SECFI'A); Letter dated August 30, 1996 to Albert Robles, SECFTA General _ Manager , Dear Mr. Brearley: • This Office serves as Special Counsel to the City of Lynwood insofar as its participation in the Southeast Cities Transportation- Authority ("SECTA") and related matters are concerned. On or about August 30, 1996, by facsimile, you served a Notice of 'a purported. Termination of Joint Powers Agreement Creating the Southeast Cities Transportation Authority. The Notice of purported Termination states ,that it is based on a vote of two-thirds of the members,. the Cities of Compton, Huntington-Park, Southgate and Vernon. The letter- fails to state that the decision to terminate SECTA occurred at a meeting of SECTA and further.-does not state whether such a meeting, if it occurred at all, was duly noticed in accordance with California law. - The City of Lynwood received no notice of such a meeting, if one in fact did occur. The above-described activities constitute wholesale and manifest violations of the Ralph M. Brown Act, California Government Code § 54950, sue. September 3, 1996- Page 2 Accordingly, demand is hereby made for SECTA to cure each and every violation of the Brown Act, above-enumerated, inter alia, by nullification of the purported Termination thereof. Failure immediately to effect such a cure,' will leave the City of Lynwood no alternative but to enforce the provisions of the Brown Act in court and to avail itself of each and every remedy available to it under the Joint Powers Agreement. If you have any questions concerning the content of this letter, contact me immediately. Very truly yours, KANE, BALLMER & BERKMAN Murray O. Kane " R. Bruce Tepper, Jr. By: R. Bruce Tepper, J .
