Resolution No. 6854 1 RESOLUTION NO. 6854 2 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON WITHDRAWING THE ALTERNATE OFFER OF SETTLEMENT WITH MODIFICATIONS IN THE LITIGATION ENTITLED CITY OF SOUTH GATE, ET AL. VS. CITY OF LOS ANGELES, ET AL., LASC NO. BC 129447, COURT OF APPEAL NO. 2ND CIV NO. B100019 4 5 6 7 WHEREAS, the cities of Compton, Lynwood, South Gate and 8 Vernon and the Association for the Mitigation of Transportation 9 Impacts composed of the above-referenced four cities and taxpayers Anita O. Aviles and Edward Saenz filed a complaint in the Los 10 11 Angeles Superior Court against the City of Los Angeles, Port of 12 Los Angeles, Board of Harbor Commissioners of the City of Los 13 Angeles, City of Long Beach, Port of Long Beach, Board of Harbor 14 Commissioners of the City of Long Beach raising, among other 15 issues, the validity of the Third Amendment to the Joint Powers 16 Agreement between Los Angeles and Long Beach, which established 17 the Alameda Corridor Transportation Authority; and 18 WHEREAS, the litigation is presently pending in the Court 19 of Appeal and is entitled CITY OF SOUTH GATE, ET AL. VS. CITY OF 20 LOS ANGELES, ET AL., LASC NO. BC 129447, COURT OF APPEAL NO. 2ND 21 CIV NO. B100019; and 22 WHEREAS, on August 15, 1996, the cities of Long Beach and 23 Los Angeles, and the Ports of Long Beach and Los Angeles made an 24 offer of settlement to the plaintiffs in this matter, Huntington 25 Park and SECTA which, if accepted, would have settled this litigation; and ' 26 27 WHEREAS, the defendants' attorney, Keesal, Young & Logan, 28 submitted an alternate offer of partial settlement on August 22, 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 1996, which did not include the city of Lynwood, upon the condition that said attorney will formally present said alternate offer of settlement to the defendants for their formal approval as soon as possible; and WHEREAS, the defendants' alternate offer of settlement reduced the Payments to SECTA and the Miscellaneous Settlement Payment to Vernon by 20%, in order to reflect that the City of Lynwood was not included in such alternate offer of settlement; and WHEREAS, the cities believe this reduction is unequitable because only 14.1% of the combined project miles is located in or adjacent to the City of Lynwood; and WHEREAS, the only SECTA funds directly affected by Lynwood's decision to not participate in the settlement are the: (1) funding for Construction Claim Committee; (2) funding for Joint Project Committee and mitigation resolution (PDC); and (3) funding for Job Training; and WHEREAS, the Miscellaneous Settlement Payment for the City of Vernon is not affected by the City of Lynwood's decision to not participate in the offer of settlement; and WHEREAS, the cities' counsel submitted a counterproposal to the defendants on August 29, 1996, to modify such alternate offer of settlement by modifying such settlement amount as shown on the attached Exhibit "B" which is incorporated herein as though fully set forth at length; and WHEREAS, the cities of Huntington Park, South Gate, Compton and Vernon by Resolution No. 6843 adopted on August 29, 1996, approved the above-described modified alternate offer of -2- '. 1 settlement conditioned upon all four cities approval, NEW SECTA 2 approval and conditioned upon the defendants' approving said 3 modified alternate offer of settlement; and 4 WHEREAS, the defendants' attorney has notified the City 5 Attorney that the defendants have rejected the modified alternate 6 offer of settlement; and 7 WHEREAS, the City Council of the City of Vernon by this 8 resolution intends to withdraw said modified alternate offer of 9 settlement. 10 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE 11 CITY OF VERNON AS FOLLOWS: 12 SECTION 1: The city Council of the City of Vernon does 13 hereby find and determine that the recitals contained hereinabove 14 are true and correct. 15 SECTION 2: The City Council of the City of Vernon hereby 16 withdraws the modified alternate offer of settlement (see Exhibit 17 "B"), in the litigation entitled city of South Gate, et al. vs. 18 city of Los Angeles, et al., LASC No. BC 129447, Court of Appeal 19 No. 2ND CIV NO. B100019. 20 SECTION 3: The City Clerk of the City of Vernon shall 21 certify to the passage of this resolution and thereupon and 22 thereafter the same shall be in full force and effect. 26 AT~ BRUCE V.
