A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A VARIANCE TO
BENJAMIN H. WERBER TRUST AND JOSEPH
FREED FROM SECTION 26.4.2-8, DEVELOPMENT
STANDARDS, OF THE COMPREHENSIVE ZONING
ORDINANCE, FOR THE PROPERTY LOCATED
AT 3111 BANDINI BOULEVARD IN THE CITY OF
VERNON
WHEREAS, Benjamin H. Werber Trust and Joseph Freed,
which own a parcel of property located at 3111 Bandini
Boulevard in the City of Vernon, have requested a variance from
conformance with Section 26.4.2-8, Development Standards, of
the Comprehensive Zoning Ordinance; and
WHEREAS, the building is used for warehousing and the
physical condition of the property is unique in that the
existing building measures approximately 19,400 square feet and
was constructed with two conforming truck loading spaces and
one non-conforming truck loading space measuring 10.0 in width
and 51.0 feet in length. The non-conforming space cannot be
brought into conformance with the Zoning Ordinance without
recessing the building wall and relocating the loading dock
doors; and
WHEREAS, Zoning Ordinance Section 26.4.2-7 (b)
requires two truck loading spaces for buildings with a gross
floor area between 8,001 and 25,000 square feet in size; and
WHEREAS, Zoning Ordinance Section 26.4.2-8 (c)
specifies that each truck loading space shall be a minimum of
10 feet wide and 65 feet long, and Section 26.4.6-4 (c)
provides that a non-conforming lot or parcel must comply with
these standards within 5 years of April 18, 1989 unless a
1 variance is granted; and
2 WHEREAS, there is insufficient space on the property
3 and the application of the development standards for the truck
4 loading space requirements will create an unreasonable hardship
5 by requiring the non-conforming space to be 10 feet wide by 65
6 feet long; and
7 WHEREAS, the owners have indicated that there are no
8 plans to expand or alter the building configuration and that
9 the existing truck loading spaces are sufficient for the
10 intended use; and
11 WHEREAS, 3111 Bandini Boulevard is located in theM-2
12 zone and the operation is consistent with the objectives of the
13 General Plan and Zoning Ordinance; and
14 WHEREAS, the City Council of the City of Vernon held
15 a hearing on said application for a variance on October 1,
16 1996.
17 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
18 THE CITY OF VERNON AS FOLLOWS:
19 SECTION 1: City Council of the City of Vernon hereby
20 finds and determines that the recitals contained hereinabove
21 are true and correct.
22 SECTION 2: A variance from Section 26.4.2-8 of the
~ Comprehensive Zoning Ordinance, requiring all truck loading
24 spaces to be 10 feet wide by 65 feet long, is hereby granted to
25 Benjamin H. Werber Trust and Joseph Freed at 3111 Bandini
26 Boulevard.
27 SECTION 3: The variance shall be granted subject to
28 the following conditions:

(a) The usage of the non-conforming truck loading

loading dock shall extend into the existing street right-of-way
as shown on the Master Plan of Streets, dated June 16, 1992.
(b) All existing and future tenants shall be
notified of these restrictions and a condition stating the same
shall be placed in all future leases.
SECTION 4: Noncompliance with these conditions shall
constitute sufficient grounds for the City Council of the City
of Vernon to void this variance and require the application of
Zoning Ordinance Section 26.4.2-8 and the authorized truck
loading space requirement.
SECTION 5: The City Clerk of the City of Vernon
shall certify to the passage of this resolution and thereupon
and thereafter the same shall be in full force and effect.

Benjamin H. Werber Trust and Joseph Freed have submitted an
application for a Variance from the Comprehensive Zoning Ordinance,

We request a variance per Article IV, Section 26.4.6-4 (d) to Section 26.4.2 (c) which
requires 65' of truck parking space length. This address, 3111 Bandini Blvd, contains
both a flush dock and an indented dock. Though the flush dock has only 51' of parking
length (for which this variance is hereby sul::mitted) the indented dock next to it has
a full 65' of parking length. The light warehousing use typical for this parcel is
usually serviced by srna.ll to medium sized trucks.
NOTICE TO APPLICANT: In the variance procedure it shall be shown that
the following five (5) conditions exist in reference to the property
being considered. The applicant should answer the following
statements. If you have difficulty finding reasonable answers to the
statements contained in this application it may be an indication that
your request has insuffic"ient factors to justify approval. (Attach
additional sheet(s) if necessary.
(1) That special conditions and circumstances exist which are peculiar
to the land, structure, or building involved and which are not
generally applicable to other lands, structures, or buildings in the
same vicinity and zone:
The existing structure was built in 1971 with the parking/loading configuration
remaining unchanged to this day. This specific address has both flush and indented
docks. The flush dock's 51' of parking length has been rrore than adequate as an
adjunct to the indented dock's 65' of parking length. An adjacent unit (3109) with
an identical mirror-image layout has already received the same variance.
(2) That literal interpretation of the provisions of this ordinance
would deprive the applicant of rights commonly enj oyed by other
propertied in the same vicinity and zone in which the property is
located, under the terms of this Chapter.
Being required to. make costly improvements unnecessarily would deprive the owners of
the cormonly enjoyed right to conduct business lawfully and without unreasonable
hardship.

(3) That the special conditions and circumstances do not result from
actions of the applicant:
The structure was built in 1971 to codes which were current at the time. No rrodifi-
cations have been made to this day.
(4) That granting the variance requested will not confer on the
applicant any special privilege that is denied by this Chapter to other
lands, structures, or buildings in the same vicinity and zone in which
the property is located:
The variance process is provided for in Section 26.4.6-4 specifically to allow
for reasonable exceptions to all lands, structures and buildings in the sane vicinity
and zone. No special privilege is inferred or sought.
(5) That the granting of such variance will be in harmony and not
adversely affect the Comprehensive General Plan:
SUpporting the business ccmnunity by the granting of this variance is in harrrony
with the Canprehensi ve General Plan since' granting this variance request will
prevent urmecessary hardship and will have no negative impact.
NOTE:
Non-conforming use of neighboring lands, structures, or buildings shall
not be considered grounds for the issuance of a variance.

3111 BANDINI BOULEVARD
VARIANCE APPLICATION
SEPTEMBER 23, 1996
Benjamin H. Werber Trust and Joseph Freed are requesting a
variance from the Comprehensive Zoning Ordinance Section 26.4.2-
8, Development Standards, for the property located at 3111
Bandini Boulevard in the City of Vernon. The building was
constructed with two conforming truck loading spaces and one non~
conforming truck loading space measuring 10.0 feet ,in width and
51.0 feet in length. The non-conforming space cannot be brought
into conformance with the Zoning Ordinance without recessing the
building wall and relocating the loading dock doors. They have
stated that only vehicles of smaller lengths will be used at the
non-conforming truck loading space.
The building is used for
warehousing and is approximately 19,400 square feet in size.
Section 26.4.2-7 (b) requires two truck loading spaces for
buildings with a gross floor area between 8,001 and 25,000 square
feet in size.
Section 26.4.2-8 (c) of the Comprehensive Zoning
Ordinance specifie~ that each loading space shall be a minimum of
10 feet wide and 65 feet long and Section 26.4.6-4 (c) provides
that a non-conforming lot or parcel must comply with these
standards within five years of April 18, 1989 unless a variance
is granted.
Benjamin H. Werber Trust and Joseph Freed have indicated
that requiring the non-conforming truck loading space to be 65

feet long by 10 feet wide would be a hardship. The Trustee has
indicated that there are no plans for expansion or alteration of
the building configuration.
The operation is in conformance with the Zoning Ordinance and
General Plan. Therefore, it is recommended that the variance be
granted with the following conditions:
(a) The usage of the non-conforming truck loading space
shall be limited so that no truck parked at or using th~ loading
dock shall extend into the existing street right-of-way as shown
on the Master Plan of Streets, dated June 16, 1992.
(b) All existing and future tenants shall be notified of
these restrictions and a condition stating the same shall be
placed in all future leases.
