'. 1 RESOLUTION NO. 6861 2 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON SUPPORTING THE ADOPTION BY THE LEAGUE OF CALIFORNIA CITIES OF A RESOLUTION REGARDING ELECTRIC INDUSTRY RESTRUCTURING 4 5 6 WHEREAS, Joyce Howerton, Mayor of the City of Lompoc, has 7 requested that the City of Vernon support the League of California cities' proposed resolution regarding Electric Industry 8 9 Restructuring, a copy of said resolution is attached hereto as Exhibit "A" and incorporated herein by this reference as though 10 11 fully set forth at length; and 12 WHEREAS, the proposed resolution reinforces and 13 emphasizes the "Home Rule" authority of municipal governments with 14 respect to utility operations rather than regulation by the Public 15 Utility Commission, which such intrusion can only result in 16 increased cost to local government and their electric customers; and 17 18 WHEREAS, the proposed resolution also states that the League of California cities will participate in the electric 19 20 restructuring debate to assure that no erosion of local government 21 authority in the provision of essential services occurs and oppose 22 all legislation introduced in the California Legislature that 23 erodes the decision-making ability of local government in the 24 provision of essential services; and 25 WHEREAS, the League of California Cities is encouraging solidarity among all California cities to obstruct efforts to 26 27 erode "Home Rule"; and 28 WHEREAS, the City Council of the city of Vernon desires " 1 to support the attached proposed resolution which is to be 2 considered during the upcoming Annual League of California cities 3 Conference. 4 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE 5 CITY OF VERNON AS FOLLOWS: 6 SECTION 1: The City Council of the City of Vernon does 7 hereby find and determine that the recitals contained hereinabove 8 are true and correct. 9 SECTION 2: The City Council of the City of Vernon hereby 10 recommends that the League of California Ci~ies adopt the proposed 11 resolution attached hereto as Exhibit "A" relating to the Electric 12 Industry Restructuring, which will be considered at the Annual 13 League of California cities Conference in October. 14 SECTION 3: The City Council of the City of Vernon hereby 15 authorizes the appropriate delegates to vote in favor of the 16 proposed resolution at said Annual Conference and hereby directs 17 the City Clerk to send a certified copy of this resolution to the 18 League of California cities. 19 SECTION 4: The City Clerk of the City of Vernon shall 20 certify to the passage of this resolution and thereupon and 21 thereafter the same shall be in full force and effect. 22 APPROVED AND ADOPTED this 1st day of October, 1996. 23 24 A6~M~ BRUCE V. RESOLUTION FORWARDED TO THE LEAGUE OF CALIFORJ~rA CITIES "ELECTRIC INDUSTRY RESTRUCTURING" WHEREAS. local government is charged with the responsibility of providing essential and emergency services to its citizens. and WHEREAS. California's Constitution recognizes the provision of electric serVice and specifically grams the authority to local governmenl to pro\'idc that service, and WHEREAS. the decision-making authority (or the provision of electric service is vested in the level 9f government closest to the people and most immediately r~sponsive tq the people. and WHEREAS, more th~n 30 percent of California residents and businesses receive electric service from local govemrnem.operatedelectric utilities, and \VHERE/'.S, consumers of electric service provided by local government, public power customers, are the owners of the electric util.i.ty who directly elect the directors of the utilicy and participate in rate-making , decisions of the utility. and WHEREAS, electric' service to non-p~blic power customers of electric service is provided by fOi:,profic investor-owned utility companies whose service and price-making priorities are overseen by the non.elected, Public Utilities Commission ~f the State of California. and WHEREAS. consumer-owned public power electric rates average 20 percent below rates authorized by the California Public Utilities Commission and charged by investor-owned utilities. and \VHEREAs, the cUrrent debate regarding a restructuring of the electric utility in California includes suggestions that the State of California Public Utilities, Commission intrude into the rights and responsibilities of local government. and WHEREAS. such intrusion can only result in increased cost to local government and their electric customers, and \VHEREAS, the League of California 'Cities has aggressively supported "home rule" and encourages the provision'of services by the level of government mOSt immediately responsive to the needs of California's citizens, ' NOW THEREFORE BE IT RESOLVED, that the League of California Cities 'does affirm its support of electric service by consumer-owned public power municipal utilities and encourages the COntinuation of the "home rulen authority vested in California's cities, and BE IT FURTHER RESOLVED, that the League of California Cities will participate in the electric restructuring debate to assure that no erosion of local government authority in the provision of essential services o~curs, that the League encourages solidarity among all California cities to obstruct efforts to erode "home rule," and funher that the League of California Cities will oppose all legislation' introduced in the California Legislature that erodes the decision-making ability of local government in the provision of essential serviceS.
