Resolution No. 6867 ,i. .~ 1 RESOLUTION NO. 6867 2 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON APPROVING (1) AN APPLICATION FOR FUNDING FROM THE ENTERPRISE FUND COMPONENT OF THE ECONOMIC DEVELOPMENT ALLOCATION OF THE STATE COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) PROGRAM AND THE EXECUTION THEREOF, (2) A CITIZEN PARTICIPATION PLAN, AND (3) UP TO $52,000 IN MATCHING FUNDS FOR,UTILITY RELOCATION AND TRAFFIC SIGNALIZATION COSTS 4 5 6 7 8 9 WHEREAS, by Resolution No. 6723 on December 5, 1995, the City of Vernon approved a Consulting Agreement with Cotton/Beland/ 10 11 Associates, Inc. ("CBA") to provide assistance for the preparation 12 of applications for the Community Development Block Grant ("CDBG") 13 program from the State of California Department of Housing and Community Development ("HCD") and to implement the program if 14 15 funds are granted; and 16 WHEREAS, the City of Vernon has prepared an application 17 for funding from the Community Economic Enterprise Fund to provide 18 loans and grants to local businesses in order to defray costs of 19 required infrastructure improvements; and 20 WHEREAS, The Director of Community Services has 21 recommended that the City Council approve the application for CDBG funds in the amount of $500,000 and authorize up to $52,000 in 22 23 utility, relocation and traffic signalization costs as a City of 24 Vernon contribution; and 25 WHEREAS, the three activities of the grant will provide 26 funds for (1) a Public Infrastructure Program in the amount of $416,250, (2) General Administration in the amount of $37,500, and (3) Activity Delivery in the amount of $46,250; and 27 28 ~ ~ 1 WHEREAS, it is recommended that, if the application is 2 approved, the city Administrator be authorized to act on the 3 City's behalf in all matters pertaining to the application; and 4 WHEREAS, the Director of Community services has 5 recommended approval of a citizen participation plan in compliance 6 with Federal statute. 7 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF 8 THE CITY OF VERNON AS FOLLOWS: 9 SECTION 1: The City Council of the City of Vernon 10 hereby finds and determines that the recitals contained 11 hereinabove are true and correct. 12 SECTION 2: The City Council hereby approves the City of 13 Vernon Application for Funding, California Community Economic 14 Enterprise Fund, 1996, for a grant of $500,000 from the HCD CDBG 15 Program, a copy of which has been presented to the city Council 16 concurrently herewith, and the city Council hereby orders said 17 Application be filed with the City Clerk. 18 SECTION 4: The City Council hereby authorizes and 19 directs the City Administrator to act on the City's behalf in all 20 matters pertaining to said Application. 21 SECTION 5: The city Council hereby authorizes the City 22 Administrator/City Clerk to execute said Application for and on 23 behalf of the City of Vernon and to file said Application with the 24 HCD. 25 SECTION 6: The City Council hereby approves the City of 26 Vernon 1996 Community Development Block Grant Program citizen 27 Participation Plan, a copy of which has been presented to the city 28 Council concurrently with this resolution, and the City Council -2- . ~ ...- .. 1 hereby orders said Plan to be filed with the city Clerk. 2 SECTION 7: The city council has reviewed said citizen 3 Participation Plan for compliance with Federal statutes and has 4 determined that this plan was followed for the development of said 5 Application. 6 SECTION 8: The City council of the City of Vernon 7 hereby authorizes up to Fifty-Two Thousand Dollars ($52,000.00) in 8 City utility funds as a local contribution to utility relocation 9 and traffic signalization costs. 10 SECTION 9: The City Clerk of the City of Vernon shall 11 certify to the passage of this resolution, and thereupon and 12 thereafter the same shall be in full force and effect. 13 APPROVED AND ADOPTED this 15th day of October, 1996. 14 ~~~. /~~ 15 16 ATTEST: ~ BRUCE V. If the Grant is obtained, the City would utilize the funds to create a Public Infrastructure Grant Program. The types of offsite improve- ments that are eligible for funding are street widenings, utility relocations and infrastructure upgrades that are normally required at the time of subdividing a property or constructing major improvements on a lot. The Grantee will be required to fund 20% of the project costs excluding City utility relocation costs. The City will provide funding for 20% of the City utility relocation costs. This has been reviewed by the Director of Community Services, and it is hereby recommended that the City Council: 1. Approve the Application pending final approval of the Application by the City Attorney; 2. ECONOMIC DEVELOPMENT COMPONENT FROM: Kevin Wilson, Commu.ity Service. Director The City of Vernon is eligible to apply for BUD Community Development Block Grant (CDBG) funds through the State Department of Housing and Community Development (HCD). More specifically, Vernon is eligible for up to $500,000 in State CDBG Economic Development Funds through the Economic Enterprise Fund for business attraction and/or retention activities that create or retain private sector jobs. . The City has hired CottonlBeland/ Associates to assist in. developing a renewal of its economic development grant application for $500,000 in support of its Public Infrastructure Grant program. (The City was awarded $500,900 in 1995 to initiate the Program). The need for such a program is' based on the significant costs associated with necessary infrastructure improvements for businesses expanding or relocating into the City, and the disincentives such costs serve to businesses. The program is designed to provide assistance in the form of a forgivable loan of between $20,000 to $200,000 to businesses making off-site public improvements. The Infrastructure Grant can be used to finance: · Utility relocation .. such as power poles. telephone lines, water meters, fire hydrants · Addition or relocation of traffic signals · Frontage improvements .. such as curb cu~ for truck access, handicapped ramps, addition of curbs and gutters · Street widening and turn lanes As a participant in the State CDBG prograttl, Vernon is required to conduct a public hearing to describe the CDBO Infrastructw'e Grant program, and to authorize submittal of the grant application to the State. The purpose of tonight's meeting is to provide the following information: · an explanation of the State CDBG program; · discussion of the three national: objectives for the CDBG program; · information about eligible activities; · information on the needs of the community; · '. proposed program design and activities/time schedule: and. · discussion of opportunities for public involvement. . , EXPLANATION OF STATE CDBG PROGRAMlELIGmLE ACTMTIES Under the State Economic Enterprise Fund, the City applies to HCD for a $500,000 CDBG grant which it in turn may use to originate local business loans, make infrastructure grants, or assist in the development of microenterprises, if these aetivities meed CDBG eligibility requirements and meet a CDBG national objective. In general, the guidelines used by HCn to detetmine CDBG eligibility include: · that project costs are reasonable; . that all sources of project financing are committed; · that CDBG funds are not substituted for non-Federal financial support, and that equity participation and private debt fmancing are maximized; · that the project is fmancially feasible; and . that the return on the o'Wller's equity investment will not be unreasonably high. In addition to these financial review factors, the application must document sufficient public benefit in the form of job creation or job retention. To ensure that the amount of CnBG subsidy is not excessive given the amount of public benefit, the maximum CDBG subsidy per job created or retained is 535,000. NATIONAL CDBG OBJECTIVES State law requires that the use of CnBG funds satisfy anyone of the following three national HUD objectives: ' 1. Benefitting Targeted Income Group (at least 51% of jobs created or retained by an activity must benefit low income persons earning at or below 800A, of the median family income for the County); 2. Aiding in the prevention or elimination of slums and blight; 'or 3. Meeting other community development needs having a particular urgency. PROGRAM DESIGN As previously described, the City of Vernon is proposina continuation of its public infrastructure grant proaram providing forgivable loans of $20,000 to $200,000 to qualifying businesses for frontage improvements related to expansion or relocation into the City. Businesses requesting the grant assistance must be able to create one new job per $20,000 of grant received. The City WatJ::Jt and Power Department will contribute 20% of frontage improvement costs related to City water and power utility relocation and traffic signalization, With the CnBO grant comprisina the remaining 80% of costs. Other non-City frontage improvement costs will require a 20% contri~tion by the private business. Properties which fall within the Redevelopment Project Area, and are considered i' contributing parcels to Project Area blight, can qualify under the CDBG National Objective of "Removal of Slums and Blight". Properties outside the Project Area or non-contributing parcels may still be eligible under the national objective of "Benefitting. the Targeted Income Group." PROGRAM SCHEDULE The City will. be notified no later than January 8, 1997 on the status of its grant application. If the City is awarded grant funds. it will continue its marketing efforts by publishing a second Notice of Funding Availability (NOF A) in the Vemon Journal and will also make NOF As available at the public counter. The City will accept preliminary applications submitted within 45 days from the publication of the NOF A. ApplicantS with potential projects meeting the program criteria will be invited to an application conference with staff. At this conference, businesses will be instructed on how to coIXlplete the application package. . City staff will make recommendations for funding of qualified applicants to the City Administrator based on the following criteria: · Business viability; · Urgency of Need; · Potential public benefit; . Project costs; and · Availability of other funds. The City Administrator will in turn make a recommendation to the City Council for fmal approval. OPPORTUNITIES FOR PUBLIC INVOLVEMENT If the City is successful in securing additional funds under the CnBG program, the City Council will conduct a public hearing and adopt a resolution authorizing execution of the grant agreement with the State. In addition, each recommended grant award will go before the City Council for fInal approval. CITY OF VERNON 1996 COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM CITIZEN P ARTICIP ATION PLAN I. PURPOSE The City ofVemon, as a non-entitlementjurisdiction (population less than 50)000) and non- participating jurisdiction under the County of Los Angeles. is eligible to apply for the U.S, Department of Housing and Urb~ Development (BUD) Community Development Block Grant (CDBG) funds through the State Department of Housing and Community Development (HCD). The City of Vernon is eligible for State CDBO Economic Development.and General Allocation Funds. Eligible activities include business attraction and/or retention activities that create or retain private sector jobs. Pursuant to HCD regulations on participation, in the State CnBG Program, Vernon has prepared this Citizen Participation Plan (CPP). The CPP provides a strategy which the City will follow to ensure the participation of all citizens in the planning. implementation, and assessment of the City's CDBO program. While this plan will aim to ensure the participation of all citizens. special assurance will be made to ensure the participation of the following, but not limited to: persons oflow and moderate income who are residents of slum and blight areas and of areas in which CDBO funds are proposed to be used, and residents in low and moderate income neighborhoods as defined by the City. ll. DEFINITIONS State law requires that the use of CnBO funds must satisfy anyone of the following three HUD national objectives: 1. Benefitting Targeted Income Group; 2. Aiding in the prevention or elimination of slums and blight~ or 3. Meeting other community development needs having a particular urgency. 1. Targeted Income Group (TIC) - An activity will be considered to address the objective of benefit to the Targeted Income Group if it meets one of the following criteria; · At least 51 pe1'cent of the jobs created or retained by an activity must benefit the TIG.The TIO, which includes the "Lowest Targeted Income Group (LTIG)," is based on the County's median household income limit adjusted for household size, which is provided annually by BUD. TIGs are those whose household income does not exceed 80% of the County median household income, and L TIGs are those whose household income is SO percent and below of the adjusted County median household income. City of Vernon Citizen Parricipation Plan ] CDBG Program . Area benefit activity. An activity which benefits an area in which at least 51 percent of the residents-are in the TIO. . Limited clientele activity. An activity that benefits a limited clientele, of which at least 51 percent of whom are in the TIO. , 2. Slums and Blight - An activity will be considered to aid in the prevention and elimination of slums orblight if:, ' . The activity will occur in an area,' delineated by the City, that meets a definition of a slum. blighted, deteriorated or deteriorating area under State or local law: . Throughout the area there is a substantial number of deteriorated or deteriorating buildings or the public ixnprovements are in a general state of deterioration; . Documentation is maintained by the City on the boundaries of the area and the condition which qualified the area at the time of its designation; and . The assisted activity addresses one or more of the conditions which contributed to the slum and blighting condition of the area. 3. Urgent Need .. An activity meets this national objective if the City certifies that the assisted activity is needed to alleviate existing conditions which pose a serious and Unmediate threat to the health and welfare of the community. The conditions must be of recent origin (developed 01' ~ame critical within 18 months preceding the certification by the City), and the grantee must be unable to finance the activity on its own and other sources of funding are not available. W. PUBLIC HEARINGS The City will conduct public hearings to obtain citizen views and to respond to proposals and questions at all stages of the CDBO pl'O~ including at least the development of needs, the review of proposed activities, and review of program perfonnance. 'State CnBG Program regulations require that two public hearings be held during the preparation of an application for funding: 1) during discussion of the most serious and basic needs of the community; and 2) after determining which activities are proposed for the application. The second public hearing.must be held before the City Council to approve a . resolution supporting the application, committing leverage, adopting a citizen participation plan and program guidelines, and authorizing the City's Chief Administxative Officer to act on the City's behalf in all matters related to the program. In addition, a public hearing will also be required at the time of the annual and/or final Grantee Performance Report, in order to review program performance. ACCESS TO RECORDS The City will provide citizens, public agencies, business owners, and other interested parties with timely and reasonable access to local meetings, infoxmation, and records relating to use of CnBO funds. Requests for infoImation and records must be made to the City of V emon in writing. Staff will respond to such requests within 1 S working days or as soon as possible thereafter. , V. TEClINlCAL ASSISTANCE The City will provide technical assistance to representative groups of low- and moderate- income persons. business owners, and other eligible parties that request such assistance in developing proposals for funding assistance under activities covered by the CDBG Program. VI. COMMENTS AND COMPLAINTS Citizens and other interested parties are encouraged to state or submit their cOmlnents on the City's proposed used of CDBO funds and program performance. It possesses legal authority to apply for the grant and to execute the proposed program. 2. Its governing body has duly adopted or passed as an official act or resolution, motion, or similar action authorizing the filing of the application, including all understandings and assurances contained therein, and directing and authorizing the applicant's chief executive officer or other designee to act in connection with the application and to provide such additional information as may be required. 3. It has or will comply with all citizen participation requirements, including preparation of a written citizen participation plan which includes, at a minimum, the following components: a. Provides for and encourages citizen participation, with particular emphasis on participation by persons of low and moderate income who are residents of slum and blight areas and of areas in which CDBO funds are proposed to be used, and provides for participation of residents in low and moderate income neighborhoods as defined by the local jurisdiction; b. Provides citizens with reasonable and timely access to local meetings, information, and records relating to the grantee's proposed use or funds, as required by CDBO regulations, and relating to the actual use of funds under this title; c. Provides for technical assistance to groups representative of persons of low and moderate income that request such ass,istance in developing proposals with the level and type of assistance to be determined by the grantee; d. Provides for public hearings to obtain citizen views and to respond to proposals and questions at all stages of the community development program. These include at least the development of needs, the review of proposed activities, and review of program performance, which hearings shall be held after adequate notice, at times and locations convenient to potential or actual beneficiaries, and with accommodation for the handicapped. This shall include one public meeting during the program design, annual performance report preparation, and formal amendments. A public hearing shall be conducted prior to application submittal; e. Identifies how the needs of non-English speaking residents will be met in the case of public hearings where a significant number of non-English speaking residents can reasonably be expected to participate. 4. Its CDBG Program has been developed so as to primarily benefit targeted income persons and households, and each activity in the program meets one of the three national objectives: benefit to low and moderate income persons, elimination of slums and blight, or meets an urgent community need certified by the grantee as such. 5. It consents to assume the responsibilities for environmental review and decision-making in order to ensure compliance with NEP A by following the procedures for "recipients" of block grant funds as set forth in 24 CFR, Part 58, entitled "Environmental Review Procedures for Title I Community Development Block Grant Programs." Also included in this requirement is compliance with Executive Order 11988 relating to the evaluation of flood hazards, and Section 1 02(a) of the Flood Disaster Protection Act of 1973 (Public Law 93-234) regarding purchase of flood insurance, and the National Historic Preservation Act of 1966 (16 USC 470) and implementing regulations (36 CFR 800.8). 6. It consents to assume the role of either "Lead Agency" as defined by Section 21067 of the California Public Resources Code, or if another agency is or will be designated "Lead Agency," it consents to assume the role of "Responsible Agency" as defined by Section 21069 of the California Public Resources Code, in order to ensure compliance with CEQA. 7. It has resolved any audit findings or performance problems for prior CDBG grants awarded by the State. 8. It certifies that there is no plan, ordinance, or other measure in effect which directly limits, by number, the building permits that may be issued for residential construction or the build able lots which may be developed for residential purposes; or if such a plan, ordinance, or measure is in effect, it will either be rescinded before receiving funds, or it need not be rescinded because: a. It imposes a moratorium on residential construction, to protect the health and safety, for a specified period of time which will end when the public health and safety is no longer jeopardized; or b. It creates agricultural preserves under Chapter 7 (commencing with Section 51200) of Part 2 of Division 1 of Title 5 of the Government Code; or c.
