A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A VARIANCE TO
AMERICAN HANDLE, INC. FROM SECTION
26.4.2-8, DEVELOPMENT STANDARDS, OF THE
COMPREHENSIVE ZONING ORDINANCE, FOR THE
PROPERTY LOCATED AT 4340 49TH STREET IN
THE CITY OF VERNON
WHEREAS, American Handle, Inc. occupies a parcel of
property located at 4340 49th Street in the City of Vernon and
has requested a variance from conformance with Section 26.4.2-
8, Development Standards, of the Comprehensive Zoning
Ordinance; and
WHEREAS, Everett Properties, the owner of said
property, has authorized American Handle, Inc. to act as its
agent in applying for this variance; and
WHEREAS, the building is used for warehousing and the
and the physical condition of the property is unique in that
the existing building measures approximately 15,400 square feet
and was constructed with two conforming truck loading spaces
and two non-conforming truck loading spaces measuring 9.0 in
width and 31.0 feet in length. The non-conforming spaces
cannot be brought into conformance with the Zoning Ordinance
without recessing the building wall and relocating the loading
dock doors; and
WHEREAS, Zoning Ordinance Section 26.4.2-7 (b)
requires two truck loading spaces for buildings with a gross
floor area between 8,001 and 25,000 square feet in size; and
WHEREAS, Zoning Ordinance Section 26.4.2-8 (c)
specifies that each truck loading space shall be a minimum of
1 10 feet wide and 65 feet long, and Section 26.4.6-4 (c)
2 provides that a non-conforming building must comply with these
3 standards within 5 years of April 18, 1989 unless a variance is
4 granted; and
5 WHEREAS, there is insufficient space on the property
6 and the application of the development standards for the truck
7 loading spaces requirements will create an unreasonable
8 hardship by requiring the non-conforming spaces to be 10 feet
9 wide by 65 feet long; and
10 WHEREAS, American Handle, Inc. has indicated that it
11 has no plans to expand or alter the building configuration and
12 that the existing truck loading spaces are sufficient for its
13 intended use; and
14 WHEREAS, 4340 49th Street is located in the M zone and
15 the operation is consistent with the objectives of the General
16 Plan and Zoning Ordinance; and
17 WHEREAS, the City Council of the City of Vernon held
18 a hearing on said application for a variance on November 5,
19 1996.
20 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
21 THE CITY OF VERNON AS FOLLOWS:
22 SECTION 1: The City Council of the City of Vernon
23 hereby finds and determines that the recitals contained
24 hereinabove are true and correct.
25 SECTION 2: A variance from Section 26.4.2-8 of the
26 Comprehensive Zoning Ordinance, requiring all truck loading
27 spaces to be 10 feet wide by 65 feet long, is hereby granted to
28 American Handle, Inc. at 4340 49th Street.

SECTION 3: The variance shall be granted subject to
the following condition: the usage of the non-conforming truck
loading spaces shall be limited so that no truck parked at or
using the loading docks shall extend into the existing street
right-of-way as shown on the Master Plan of Streets, dated June
16, 1992.
SECTION 4: Noncompliance with these conditions shall
constitute sufficient grounds for the City Council of the City
of Vernon to void this variance and require the application of
Zoning Ordinance Section 26.4.2-8 and the authorized truck
loading space requirement.
SECTION 5: The City Clerk of the City of Vernon
shall certify to the passage of this resolution and thereupon
and thereafter the same shall be in full force and effect.

VARIANCE APPLICATION
OCTOBER 29, 1996
American Handle, Inc. has requested a variance from the
Comprehensive Zoning Ordinance Section 26.4.2-8, Development
Standards, for the property located at 4340 49th Street in the
City of Vernon. The building that it occupies wa,s constructed
with two conforming truck loading spaces and two non-conforming
truck loading spaces, measuring 9.0 feet in width and 31.0 feet
in length. The non-conforming spaces cannot be brought into
conformance with the Zoning Ordinance without recessing the
building wall and relocating the loading dock doors. It has
stated that only vehicles of smaller lengths will be used at the
non-conforming truck loading spaces. The building is used for
warehousing and is approximately 15,400 square feet in size.
Section 26.4.2-7 (b) requires two truck loading spaces for
buildings with a gross floor area between 8,001 and 25,000 square
feet in size. Section 26.4.2-8 (c) of the Comprehensive Zoning
Ordinance specifies that each loading space shall be a minimum of
10 feet wide and 65 feet long and Section 26.4.6~4 (c) provides
that a non-conforming building must comply with these standards
within five years of April 18, 1989 unless a variance is granted.
American Handle, Inc. has indicated that requiring the non-
conforming truck loading spaces to be 65 feet long by 10 feet
wide would be a hardship. It has indicated that it has no plans
for expansion or alteration of the building co~figuration.
The operation is in conformance with the Zoning Ordinance and
General Plan. Therefore, it is recommended that the variance be
granted with the following condition: the usage of the non-
conforming truck loading spaces shall be limited so that no truck
parked at or using the loading docks shall extend into the
existing street right-of-way as shown on the Master Plan of
Streets, dated June 16, 1992.

Instruction for preparing radius maps for zoning case applications in
the City of Vernon, California.

1. Prepare the map to a scale of 1"=100'. Show all properties within
a 300 foot radius from the exterior boundaries of the subject
