RESOLUTION NO. 6883

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF VERNON APPROVING AND AUTHORIZING THE
EXECUTION OF PUBLIC IMPROVEMENTS AGREEMENT
NO. 15 BY AND BETWEEN THE CITY OF VERNON AND
CALIFORNIA WAREHOUSE COMPANY

WHEREAS, the City of Vernon proposes to install a 12-
6
inch sewer main in Loma vista Avenue as part of contract No. 0001-
7
RA; and
8
WHEREAS, CALIFORNIA WAREHOUSE COMPANY ("Company") was
issued a plumbing permit on November 19, 1996 to install a sewer
line from their facility to the property line on Loma vista
9

Avenue; and
12
WHEREAS, Company has requested that the city install at
13
Company's cost a 6-inch sewer lateral in Loma vista Avenue to the
14
premises located at 4455 Fruitland Avenue, Vernon, California
15
(northwest corner of Loma vista and Fruitland Avenues); and
16
WHEREAS, the cost of such sewer pipe installation is
estimated at Two Thousand Ninety Dollars and No Cents ($2,090.00),
and Company has deposited said amount with City as payment in full
17

for said work; and

WHEREAS, Company shall obtain all necessary permits and
21
pay the required fees prior to connection of the sewer; and
22
WHEREAS, Company and the City of Vernon desire to~enter
into an agreement setting forth the terms and conditions for said
6-inch sewer latera 1 installation in Loma vista Avenue.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF VERNON AS FOLLOWS:

SECTION 1: The City Council of the City of Vernon
hereby finds and determines that the recitals contained

hereinabove are true and correct.

SECTION 2: The City Council of the City of Vernon

hereby approves Public Improvement Agreement No. 15, a copy of
which has been presented to the City Council concurrently with
this resolution, and the City Council hereby orders said Agreement

to be received and filed by the City Clerk.
SECTION 3: The City Council of the City of Vernon
hereby authorizes the Mayor and the City Clerk to execute said
Agreement for, and on behalf of, the City of Vernon.

SECTION 4: The City Clerk of the city of Vernon shall

certify to the passage of this resolution, and thereupon and
12
thereafter the same shall be in full force and effect.

APPROVED AND ADOPTED this 3rd day of December, 1996.

PUBLIC IMPROVEMENTS AGREEMENT NO. 15
THIS AGREEMENT is entered into as of this ~ day of
,0'9~?~ 1996 by and between the City of Vernon, a municipal
corporation ("City"), and California Warehouse Company
("Company") .
RECITALS
WHEREAS, City proposes to install a 12 inch sewer main in
Lorna Vista Avenue, in Vernon California; and
WHEREAS, Company has requested that City install at
Company's cost a 6 inch sewer lateral in Lorna Vista Avenue to the
12 premises located at 4455 Fruitland Avenue (N.W. corner of Lorna
13 Vista and Fruitland Avenues) .
14 AGREEMENT
15 NOW, THEREFORE, in consideration of the premises and the
16 promises hereinafter set forth, the parties agree as follows:
17 FIRST: City shall construct approximately 30 feet of 6 inch
18 sewer lateral at approximately Station 18+12 from the proposed
19 main in Lorna Vista to the premises. California Warehouse Company
20 shall deliver to City concurrently with the execution of this
21 Agreement, a check in the amount of $2,090.00 as payment in full
22 for said work described above.
23 SECOND: Prior to connection Company shall obtain all
24 necessary permits and pay the required fees.
25 THIRD: Any notices, demands, or other communications
26 required or desired to be given or made under the terms of this
27 Agreement shall be in writing and personally served, or served by
28
