Resolution No. 6893 1 2 3 4 RESOLUTION NO. 6893 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VEgNON GRANTING A CONDITIONAL USE J?ERMITTO CARDLOCK "FUELS SYSTEM, INC. FOR THE OPERATION OF AN UNATTENDED COMMERCIAL FLEET FUELING FACILITY AT 5475 SANTA FE AVENUE 5 WHEREAS, Cardlock Fuels System, Inc. has applied 6 for a conditiona,l.use permit to operate an unattended 7 commercial fleet fueling facility at 5475 Santa Fe Avenue in 8 the ,City of Vernon; and 9 WHEREAS, the City Council of the City of Vernon 10 held a hearing on said application for a conditional use 11 permit on December 17, 1996; and 12 WHEREAS, the proposed site is a conforming use in 13 the Commercial/Industrial (CM) Zone which has been 14 continuously used as a fueling facility previously operated 15 by Sylvester Feichtinger and which requires a conditional 16 use permit under the Zoning Ordinance in order to continue 17 18 the use; and WHEREAS, the proposed operation will generate more 19 than 20 vehicle trips per 1,000 gross square feet of floor 20 21 22 23 of the parcel are adequate for the proposed operation; and 24 25 26 27 area per day; and WHEREAS, the acres in size, and the proposed site is approximately 0.28 size, shape, topography and drainage WHEREAS, a barrier wall exists and will be maintained ,where parking or maneuvering areas adjoin a public street pursuant to the Vernon City Code; and WHEREAS, the proposed site is surrounded by 28 1 industrial uses compatible with the proposed use and no 2 adverse effect from traffic, parking, noise, odors, dust, 3 smoke, light or glare, or risk of fire, infection or 4 explosion is anticipated from the proposed operation; and 5 WHEREAS, the site has access to Santa Fe Avenue 6 and 55th Street and it is anticipated that traffic will 7 travel to the site from all directions and the streets to be 8 utilized within the City of Vernon are sufficient to handle 9 the traffic generated .. from the proposed opera.tion; and 10 WHEREAS, the site is required to have adequate 11 off street parking and loading facilities in accordance with 12 the Vernon City Code; and 13 WHEREAS, the conditions imposed on the conditional 14 use permit will adequately p.rotect the public health, safety 15 and general welfare and the operation is consistent with all 16 applicable rules and laws of the City of Vernon; and 17 'WHEREAS, the proposed use as to location, 18 operation, and design is consistent with the General Plan 19 and the Zoning Ordinance of the City of Vernon; and 20 WHEREAS, the project was found to be categorically 21 exempt from the California Environmental Quality Act as an 22 existing facility pursuant to Section 15301 of the 23 California Environmental Quality Act Guidelines and a Notice 24 of Exemption shall be filed with the County Clerk pursuant 25 to Section 15062 of the California Environmental Quality Act 26 Guidelines. 27 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL 28 OF THE CITY OF VERNON AS FOLLOWS: 2 1 SECTION 1: The City Council of the City of Vernon 2 hereby finds and determines that the recitals contained 3 hereinabove are true and correct. 4 SECTION 2: Subject to the conditions set forth 5 elow, the conditional use permit is granted to Cardlock 6 Fuels System, Inc. for the operation of an unattended 7 commercial fleet fueling facility at 5475 Santa Fe Avenue. 8 SECTION 3: In order to adequately protect the 9 ublic health, safety and general welfare the following 10 conditions are imposed: 11 a. The facility shall be operated in accordance 12 ith, and made to conform with all current codes, rules, 13 regulations and subject to permit fees as adopted by the 14 City of Vernon. 15 b. All parking and loading facilities shall be 16 with a hard durable surface material and shall be 17 drained, and kept free of dust, mud, trash and 18 Where parking or maneuvering areas adjoin the public 19 a barrier wall or landscaping shall be installed and 20 aintained to meet City standards. 21 c. A National Pollutant Discharge Elimination 22 System Permit shall be obtained if or when required by the 23 California State Board of Water Resources. 24 d. All required federal, state, local and 25 regulatory agency permits shall be obtained prior to 26 operation. Prior to occupancy a business license, occupancy 27 ermit and underground storage tank permit shall be 28 obtained. 3 1 e. The facility shall be operated in a manner 2 that will prevent unsanitary conditions, odors or other 3 uisances. The property shall be provided with adequate 4 refuse containers and refuse disposal service. 5 f. The facility shall be operated in a manner 6 hich will not impede traffic on Santa Fe Avenue and 55th 7 A routing map approved by the City of Vernon shall 8 e distributed to all customers. 9 g. All existing cracked sidewalk, curb and gutter 10 adjacent to the site on Santa Fe Avenue and 55th Street shall 11 e repaired and maintained to meet City Standards. 12 h. A leak monitoring system for the underground 13 tank system shall be maintained in compliance with federal, 14 state and local regulations. 15 i. A hazardous materials inventory and 16 usinessjcontingency plan shall be submitted and a hazardous 17 aterials permit shall be obtained from the City of Vernon 18 ealth Department and maintained. Hazardous 19 aterialsjwastes shall be handled and managed in compliance 20 ith all appropriate federal, state and local laws. The 21 contingency plan shall provide a methodology for immediate 22 response to a leak alarm from the leak monitoring system as 23 approved by the City of Vernon Health Department. 24 j. Containment for unauthorized aboveground 25 releases from the fueling system shall be provided and 26 approved by the City of Vernon Health Department. Fuel and 27 other contaminants shall be prevented from escaping the 28 facility and entering adjacent streets, neighboring 4 1 ~roperties, sewers or the storm drain system. k. Cardlock Fuels System, Inc. shall supply 2 3 trained personnel to make daily inspections of the facility 4 5 6 7 8 9 10 11 12 13 14 to check the cleanliness of the site, the proper operation of monitoring equipment and to insure proper disposal of contaminants. SECTION 4: The City Clerk of the City of Vernon shall certify to the passage of this resolution and thereupon and thereafter the same shall be in full force and effect. Herewith for your consideration are the following supporting documents: 1. Request for conditional use permit and information supporting the application. 2. Engineer'S Report. 3. Notice of Public Hearing, copies of notification letters to owners and tenants in the area and affidavits of posting and mailing. Cardlock Fuels System, Inc. was found to be categorically exempt from the California Environmental Quality Act process, since they will be using an existing facility and the facility is not being expanded. In my opinion the proposed operation will pose no adverse effects to the City of Vernon and will not have a significant effect on the environment, and no mitigating measures are required. * Honorable City Council -2- December 12, 1996 It is recommended that the City Council find that the proposed use is categorically exempt from the California Environmental Quality Act process. Further it is recommended that a Notice of Exemption be filed with the County Clerk and the conditional use permit be granted with the following conditions: a. The facility shall be operated in accordance with, and made to conform with all current codes, rules, regulations and subject to permit fees as adopted by the City of Vernon. b. All parking and loading facilities shall be paved with a hard durable surface material and shall be adequately drained, and kept free of dust, mud, trash and weeds. CONDITIONAL USE PERMIT TO OPERATE AN UNATTENDED COMMERCIAL FLEET FUELING FACILITY (December 11, 1996) Cardlock Fuels System, Inc. has applied for a conditional use permit to operate an unattended commercial fleet fueling facility at 5475 Santa Fe Avenue in the City of Vernon. This operation will generate more than 20 vehicle trips per 1,000 gross square feet of floor area per day. 1. GENERAL PLAN The proposed use conforms to the Zoning Ordinance and the General Plan. The site is presently being used as a gasoline and diesel service station. 2. ~ The proposed site is of adequate size and shape for the proposed use. 3. ADVERSE AFFECT The proposed site is surrounded by industrial and commercial uses compatible with the proposed use and no adverse noise, odor, dust, smoke, light or glare, or risk of fire, infection or explosion is anticipated from the proposed operation. All underground tanks are double-walled. The pumps will have secondary containment and automatic shut-offs and must meet minimum requirements of the Fire, Health, Electrical and South Coast Air Quality Management District's codes and regulations. The site will be electronically monitored 24 hours per day, 365 days per year. The site will be visited daily by a trained technician who will check the equipment for proper 1 operation and inspect the cleanliness of the site. The site will be equipped to shut down in case of spill or leak. Additionally, the site will have a special spill containment system to catch any accidental spills or leaks on the surface. 4. ACCESS The site has access to Santa Fe Avenue and 55th Street. These streets are of adequate size to handle the traffic generated from the proposed operation. 5. VEHICLE MOVEMENTS Operation of the fueling facility will be 24 hours a day, seven days per week. The facility will be laid out to allow southbound traffic to enter off of Santa Fe Avenue and exit onto 55th Street. The lay-out will include areas for stacking of trucks both entering and exiting the facility. It is the goal of Cardlock Fuels System, Inc. to service the existing traffic that passes the facility rather than increase the traffic flow into the area. 6. STATE OR FEDERAL CONDITIONS There are no conditions imposed by State or Federal law. 7. CONDITIONS It is recommended that the following conditions be set on the permit to adequately protect the public interests: a. The facility shall be operated in accordance with, and made to conform with all current codes, rules, regulations and subject to permit fees as adopted by the City of Vernon. b. All parking and loading facilities shall be paved with a hard durable surface material and shall be adequately drained, 2 and kept free of dust, mud, trash and weeds. Where parking or maneuvering areas adjoin the public street a barrier wall or landscaping shall be installed and maintained to meet City standards. c. A National Pollutant Discharge Elimination System Permit shall be obtained from the California State Board of Water Resources. d. All required federal, state, local and regulatory agency permits shall be obtained prior to operation. Prior to occupancy a business license, occupancy permit and underground storage tank permit shall be obtained. e. The facility shall be operated in a manner that will prevent unsanitary conditions, odors or other nuisances. The property shall be provided with adequate refuse containers and refuse disposal service. f. The facility shall be operated in a manner which will not impede traffic on Santa Fe Avenue and 55th Street. A routing map approved by the City of Vernon shall be distributed to all customers. g. All existing cracked sidewalk, curb and gutter adjacent to the site on Santa Fe Avenue and 55th Street shall be repaired and maintained to meet City Standards. h. A leak monitoring system for the underground tank system shall be maintained in compliance with federal, state and local regulations. i. A hazardous materials inventory and business/contingency 3 plan shall be submitted and a hazardous materials permit shall be obtained from the City of Vernon Health Department and maintained. Hazardous materials/wastes shall be handled and managed in compliance with all appropriate federal, state and local laws. The contingency plan shall provide a methodology for immediate response to a leak alarm from the leak monitoring system as approved by the City of Vernon Health Department. j. Containment for unauthorized aboveground releases from the fueling system shall be provided and approved by the City of Vernon Health Department. Fuel and other contaminants shall be prevented from escaping the facility and entering adjacent streets, neighboring properties, sewers or the storm drain system. k. Thomas Company (CET), forwarded a copy of your letter dated November 18, 1996 regarding the Conditional Use Permit for the above referenced project. Cardlock Fuels System, Inc. (CFS) believes that the construction of an unattended commercial fleet fueling facility at 5415 Santa Fe Avenue would be beneficial to the surrounding business community and in keeping with the future development plans of the City of Vernon. Cardlock Fuels System, Inc. proposes to build a "state-of -the- art" unattended commercial fleet fueling facility at 5415 Santa Fe Avenue. The facility will include approximately $450,000.00 in site improvements. The latest in leak prevention technology will be incorporated to insure an environmentally safe operation. Great care will be taken to protect the above and below ground environment. Off site electronic monitoring will be used to verifY the proper operation of the location as well as daily physical site inspections by trained company maintenance technicians to insure a problem free operation. The technicians will also insure that the facility is neat and clean. Currently, there are numerous industrial and commercial businesses in the immediate area that store their own fuel in underground storage tanks. Most of these installations are old and, unfortunately, many are leaking. As of 1998, all underground storage tanks will either have to be upgraded or replaced to meet mandatory EP A Standards. Many of these businesses will opt not to upgrade or replace their tanks. Consequently, they will be looking for alternate sources to fuel. Currently, they have only few retail locations which, in many cases, are not built to handle commercial size vehicles thus resulting in street congestion and dangerous fueling conditions. Cardlock Fuels System, Inc. designs and constructs facilities that meet all the fueling needs of commercial and industrial fleets. They are built to handle small to medium fleet vehicles requiring diesel or gasoline. The sites are well lit and accessible 24 hours a day. Cardlock Fuels System, Inc. will take an existing underutilized property and build an attractive, modem fueling facility that we believe is consistent with the future development of the area. In response to Item NO.1 of your letter, please refer to the attached site plan prepared by Charles E. Thomas Company. This facility will be laid out to allow for the smooth flow of traffic off of Santa F e Avenue for fueling and exit onto 55th Street. The site has been laid out to allow for the fueling of up to three trucks at one time with "stacking" for three additional trucks off of Santa Fe. Additionally, there will be room for three trucks to "stack" while awaiting a safe entrance back on to 55th Street. It is the belief of CFS that we will not increase traffic into the area, rather we will be servicing the exiting traffic that passes the facility on Santa Fe and 55th Street. Most of the truck fueling will be for the smaller "pick and delivery" type vehicles, usually 18 to 27 feet in length. There will be additional fueling capacity for up to four smaller vehicles for either gasoline or diesel. The CFS facility will be neat and attractive, and will fit well in a commercial/retail area. It will not deter from the development of a new modem looking business district. Rather, this new Cardlock Facility will provide a valuable service to the new business community. New businesses that enter the area will be able to secure fueling services tailored to meet their needs at the modem and attractive Cardlock Fuels facility. In response to Item No.2 of your letter to Mr. Faulk, CFS employees the latest in electronic equipment to provide for the safe operation of a commercial unattended fueling facility. The site will be electronically monitored 24 hours a day, 365 days per year for the safe, environmental operation of the facility. CFS currently operates a new, state-of-the-art commercial fueling facility at the intersection of Olympic and Boyle less than three miles away in Los Angeles. The facility was the first of its kind allowed in the City of Los Angeles. The same safety equipment and procedures will be used at the Vernon location as are used at the Los Angeles site, Additionally, the CFS locations are visited daily, 365 days per year by a company employee and trained technician who checks the equipment for proper operation and insures that the site is neat and clean. CFS maintains a 24 hour emergency "toll free 800 number" with immediate response by company trained technicians. The site is equipped with equipment to physically and electronically shut the site down in the case of a spill or leak. The site is also programmed to notify remote monitoring of any shut downs or suspected leaks. The site will be equipped with a special spill containment system to catch any accidental spills or leaks on the surface. Again, this spill containment system will be set up to shut down the facility in case of a fuel spill. In response to Item No, 3, the hazardous substances that will be stored on the site will be gasoline, up to 24,000 gallons and diesel, up to 24,000 gallons. The tanks will meet all federal, state and local rules, regulation and standards for safety, As indicated in the last two paragraphs, the site will be operated in a safe and environmentally friendly manor, Fuel, both gasoline and diesel, will be transported by a quality common carner. The largest amount transported will be 9,000 gallons gasoline and 8,000 gallons diesel at any given time. Accept as may be reasonably and temporarily necessary in connection with construction and maintenance or repair work as may be undertaken and performed in accordance with the maintenance of the Easement by Grantor, no walls, fences, barriers, poles, planters, curbs, chains, or obstructions of any kind or nature shall be constructed or maintained and no vehicles, containers, or other obstructions shall be parked or placed in the Easement and nothing shall in any way prevent or impair the use or exercise of the Easement granted herein or the free access of persons utilizing the Lease Parcel over or about the Easement Parcel, including, without limitation, pedestrian and vehicular traffic over the Easement Parcel. Amendment. This Declaration may be amended only by written consent of Cardlock or its permitted assigns. 5. Term. The modem upgrades proposed by CFS will improve the safe handling of on site fuel deliveries. As indicated earlier, the site will have a catch basin system sufficient to handle a large fuel spill on site of several hundred gallons. The driver will be provided with the appropriate safety procedures and emergency numbers as needed. CFS maintains trained staff to handle spills and also maintains outside services for emergency response to spills. A copy of the easement and lease agreements have been attached as requested in Item NO.4 of your letter.
