RE$OLUTION NO. 6894
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A CONDITIONAL USE
PERMIT TO SOUTHERN COUNTIES TRANSPORT FOR THE
OPERATION OF A TRUCK AND FREIGHT TERMINAL AT
2065 ROSS STREET
WHEREAS, Southern Counties Transport has applied
for a conditional use permit to operate a truck and freight
terminal at 2065 Ross Street in the City of Vernon; and

WHEREAS, the City Council of the City of Vernon
held a hearing on said application for a conditional use
10
permit on January 21, 1997; and

WHEREAS, the proposed site is a grandfathered non-
conforming use in the General Industrial (M) Zone which has
been continuously used as a truck and freight terminal and
which requires a conditional use permit under Zoning
Ordinanc.e Section 26.5.2-11 in order to continue the use;
and

WHEREAS, the site was previously operated by Heitz
Trucking, Inc. which was issued a conditional use permit by
19

Resolution No. 6764 on March 26, 1996; and

WHEREAS, the proposed operation will include the
hauling and temporary storage of general products; and
WHEREAS, the proposed site is approximately 1.61
acres in size, and the size, shape, topography and drainage
of the parcel are adequate for the proposed operation; and
WHEREAS, a barrier wall or landscaping has been
installed where parking or maneuvering areas adjoin a public
street pursuant to the Vernon City Code; and
1 WHEREAS, the proposed site is surrounded by
2 industrial uses compatible with the proposed use and no
3 adverse effect from traffic, parking, noise, odors, dust,
4 smoke, light or glare, or risk of fire, infection or
5 explosion is anticipated from the proposed operation; and
6 WHEREAS, the site has access to Ross Street and in
7 general traffic will travel from the site on Ross Street to
8 Alameda Street, thence north to freeway access and the
9 streets to be utilized within the City of Vernon are
10 sufficient to handle the traffic generated from the proposed
11 operations; and
12 WHEREAS, the site is required to have adequate
13 off-street parking and loading facilities i.n accordance with
14 the Vernon City Code; and
15 WHEREAS, the conditions imposed on the conditional
16 use permit will adequately protect the public health, safety
17 and general welfare and the operation is consistent with all
18 applicable rules and laws of the City of Vernon; and
19 WHEREAS, the proposed use as to location,
20 operation, and design is consistent with the General Plan
21 and the Zoning Ordinance of the City of Vernon; and
22 WHEREAS, thepJ:"oject was found to be categorically
23 exempt from the California Environmental Quality Act as an
24 existing facility pursuant to Section 15301 of the
25 California Environmental Quality Act Guidelines and a Notice
26 of Exemption shall ,be filed with the County Clerk pursuant
27 to Section 15062 of the California Environmental Quality Act
28 Guidelines.

1 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
2 OF THE CITY OF VERNON AS FOLLOWS:
3 SECTION ~: The City Council of the City of Vernon
4 hereby finds and determines that the recitals contained
5 hereinabove are true and correct.
6 SECTIO~ 2: Subject to the conditions set forth
7 below, the conditional use permit is granted to Southern
8 Counties Transport for the operation of a truck and freight
9 terminal at 2065 Ross Street.
10 SECTION 3: In order to adequately protect the
11 public health, safety and general welfare the following
12 conditions are imposed:
13 a. The facility shall be operated in accordance
14 with, and made to conform with all current codes, rules,
15 regulations and subject to permit fees as adopted by the
16 City of Vernon.
17 b. All required federal, state, local and
18 regulatory agency permits shall be obtained prior to
19 operation. Prior to occupancy a business license and
20 occupancy permit shall be obtained.
21 c. All parking and loading facilities shall be
22 paved with a hard durable surface material and shall be
23 adequately drained, and kept free of dust, mud, trash and
24 weeds. Where parking or maneuvering areas adjoin the public
25 street a barrier wall or landscaping shall be maintained to
26 meet City standards.
27 d. The facility shall be operated in a manner
28 that will prevent unsanitary conditions, odors or other

1 nuisances. The property shall be provided with adequate
2 refuse containers and refuse disposal service.
3 e. The facility's buildings shall be structurally
4 maintained to exclude rodents and the property shall be
5 maintained rodent free.
6 f. Servicing of vehicles including washing, steam
7 cleaning and repairing shall be performed in facilities in
8 compliance with appropriate codes.
9 g. No equipment or freight shall be stored on the
10 site, other than in buildings, trailers or on the docks.
11 h. A National Pollutant Discharge Elimination
12 System Permit shall be obtained from the California State
13 Board of Water Resources.
14 i. Adequate plans and materials must be available
15 for handling leaks or spills from vehicles during storage or
16 transportation.
17 j. A hazardous materials inventory and
18 business/contingency plan shall be submitted and a hazardous
19 materials permit shall be obtained from the City of Vernon
20 Health Department. Hazardous materials/wastes shall be
21 handled and managed in compliance with all appropriate
22 federal, state and local laws.
23 k. If the underground fuel tank is to be used,
24 the applicant must apply for an Underground Tank Program
25 Permit from the City of Vernon Health Department.
26 I. The facility shall be operated in a manner
27 which will not impede traffic on Ross Street.
28 m. All existing cracked sidewalk, curb and gutter

SECTION 4:
The City Clerk of the City of Vernon
shall certify to the passage of this resolution and
thereupon and thereafter the same shall be in full force and

Southern Counties Transport has submitted an application for a
conditional use permit. They intend to occupy the site at 2065 Ross
Street. They are proposing to use the property as a truck and freight
terminal.
Since the site is an existing truck and freight terminal, the
project is exempt from the California Environmental Quality Act
process.
It is recommended that you receive the application and supporting
documents. It is recommended that a public hearing for this
conditional use permit be held on January 21, 1997.

Gentlemen:
Southern Counties Transport has applied for a conditional
use permit to operate a truck and freight terminal at 2065 Ross
Street in the City of Vernon.
Herewith for your consideration are the following supporting
documents:
1. Request for conditional use permit and information
supporting the application.
2. Engineer'S Report.
3. Notice of Public Hearing, copies of notification letters
to owners and tenants in the area and affidavits of posting and
mailing.
Southern Counties Transport was found to be categorically
exempt from the California Environmental Quality Act process,
since they will be using an existing facility and the facility is
not being expanded.
In my opinion the proposed operation will pose no adverse
effects to the City of Vernon and will not have a significant
effect on the environment, and no mitigating measures are
required.

ENGINEER'S REPORT
ON SOUTHERN COUNTIES TRANSPORT
CONDITIONAL USE PERMIT TO OPERATE A
TRUCK AND FREIGHT TERMINAL AT 2065 ROSS STREET
(January 8, 1997)
Southern Counties Transport has applied for a conditional
use permit to operate a truck and freight terminal at 2065 Ross
Street in the City of Vernon. They are an interstate trucking
company providing pick-up and delivery service to customers
throughout Southern California, The site was previously occupied
by Heitz Trucking, Inc, Southern Counties Transport was
previously operating under a conditional use permit for the
facility at 2043 Ross Street.
1, GENERAL PLAN The proposed use is a grandfathered non-
conforming use in the General Industrial, M Zone, which has been
continually used as a truck and freight terminal,
2. ~ The proposed site is of adequate size and shape
for the proposed use.
3, ADVERSE AFFECT The proposed site is surrounded by
industrial uses compatible with the proposed use and no adverse
noise, odor, dust, smoke, light or glare, or risk of fire,
infection or explosion is anticipated from the proposed
operation.
4. ACCESS The site has access to Ross Street which is 60
feet wide. This street is of adequate size to handle the traffic
generated from the proposed operation,

5 . TRUCK MOVEMENTS
Southern Counties Transport will

and kept free of dust, mud, trash and weeds. Where parking or
maneuvering areas adjoin the public street a barrier wall or
landscaping shall be maintained to meet City standards,
d, The facility shall be operated in a manner that will
prevent unsanitary conditions, odors or other nuisances, The
property shall be provided with adequate refuse containers and
refuse disposal 'service,
e. The facility's buildings shall be structurally
maintained to exclude rodents and the property shall be
maintained rodent free,
f. Servicing of vehicles including washing, steam cleaning
and repairing shall be performed in facilities in compliance with
appropriate codes,
g, No equipment or freight shall be stored on the site,
other than in buildings, trailers or on the docks.
h, A National Pollutant Discharge Elimination System Permit
shall be obtained from the California State Board of Water
Resources,
i. Adequate plans and materials must be available for
handling leaks or spills from vehicles during storage or
transportation.
j. A hazardous materials inventory and business/contingency
plan shall be submitted and a hazardous materials permit shall be
obtained from the City of Vernon Health Department. Hazardous
materials/wastes shall be handled and managed in compliance with
all appropriate federal, state and local laws.

k. If the underground fuel tank is to be used, the
applicant must apply for an Underground Tank Program Permit from
the City of Vernon Health Department.
1, The facility shall be operated in a manner which will
not impede traffic on Ross Street.
m. All existing cracked sidewalk, curb and gutter adjacent
to the site in Ross Street shall be repaired and maintained to
meet City Standards.
