RESOLUTION NO. 6901
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A CONDITIONAL USE
PERMIT TO BERT E. JESSUP TRANSPORTATION,
INC. FOR THE OPERATION OF A TRUCK AND
FREIGHT TERMINAL AT 3575 ROSS STREET

applied for a conditional use permit to operate a truck and

WHEREAS, Bert E. Jessup Transportation, Inc. has
freight terminal at 3575 Ross Street in the City of Vernon;
8

and
WHEREAS, the City Council of the City of Vernon
held a hearing on said application for a conditional use
permit on January 7, 1997; and
12

WHEREAS, the proposed site is a conforming use in
the General Industrial (M) Zone which has been continuously
14
used as a truck and freight terminal previously operated by
15
Vecta Transportation Systems, Inc, and which requires a
16
conditional use permit under Zoning Ordinance Section
17
18
26,5.2-11 in order to continue the use; and
19
hauling and temporary storage of general products; and
20
WHEREAS, the proposed operation will include the
21
acres in size, and the size, shape, topography and drainage

of the parcel are adequate for the proposed operation; and

WHEREAS, the proposed site is approximately 2.26
WHEREAS, a barrier wall or landscaping has been
installed where parking or maneuvering areas adjoin a public
street pursuant to the Vernon City Code; and

WHEREAS, the proposed site is surrounded by
industrial uses compatible with the proposed use and no

1 adverse effect from traffic, parking, noise, odors, dust,
2 smoke, light or glare, or risk of fire, infection or
3 explosion is anticipated from the proposed operation; and
4 WHEREAS, the site has access to Ross Street and in
5 general traffic will travel from the site on Ross Street to
6 Alameda Street, thence north to freeway access and the
7 streets to be utilized within the City of Vernon are
8 sufficient to handle the traffic generated from the proposed
9 operations; and
10 WHEREAS, the site is required to have adequate
11 off-street parking and loading facilities in accordance with
12 the Vernon City Code; and
13 WHEREAS, the conditions imposed on the conditional
14 use permit will adequately protect the public health, safety
15 and general welfare and the operation is consistent with all
16 applicable rules and laws of the City of Vernon; and
17 WHEREAS, the proposed use as to location,
18 operation, and design is consistent with the General Plan
19 and the Zoning Ordinance of the City of Vernon; and
20 WHEREAS, the project was found to be categorically
21 exempt from the California Environmental Quality Act as an
22 existing facility pursuant to Section 15301 of the
23 California Environmental Quality Act Guidelines and a Notice
24 of Exemption shall be filed with the County Clerk pursuant
25 to Section 15062 of the California Environmental Quality Act
26 Guidelines,
27 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
28 OF THE CITY OF VERNON AS FOLLOWS:

1 SECTION 1: The City Council of the City of Vernon
2 hereby finds and determines that the recitals contained
3 hereinabove are true and correct,
4 SECTION 2: Subject to the conditions set forth
5 below, the conditional use permit is granted to Bert .E.
6 Jessup Transportation, Inc, for the operation of a truck and
7 freight terminal at 3575 Ross Street.
8 SECtION 3: In order to adequately protect the
9 public health, safety and general welfare the following
10 conditions are imposed:
11 a. The facility shall be operated in accordance
12 with, and made to conform with all current codes, rules,
13 regulations and subject to permit fees as adopted by the
14 City of Vernon.

15 b. All parking and loading facilities shall be
16 paved with a hard durable surface material and shall be
17 adequately drained, and kept free of dust, mud, trash and
18 weeds. Where parking or maneuvering areas adj oin the public
19 street a barrier wall or landscaping shall be maintained to
20 meet City standards,
21 c. Servicing of vehicles including washing, steam
22 cleaning and repairing shall be performed in facilities in
23 compliance with appropriate codes,
24 d. A National Pollutant Discharge Elimination
25 System Permit shall be obtained from the California State
26 Board of Water Resources.
27 e, No equipment or freight shall be stored on the
28 site, other than in buildings, trailers or on the docks,

1 f. Adequate plans and materials must be available
2 for handling leaks or spills from vehicles during storage or
3 transportation,
4 g. All required federal, state, local and
5 regulatory agency permits shall be obtained prior to
6 operation. Prior to occupancy a business license and
7 occupancy permit shall be obtained.
8 h, A hazardous materials inventory and
9 businesslcontingency plan shall be submitted and a hazardous
10 materials permit shall be obtained from the City of Vernon
11 Health Department. Hazardous materialslwastes shall be
12 handled and managed in compliance with all appropriate
13 federal, state and local laws.
14 i. The facility shall be operated in a manner
15 that will prevent unsanitary conditions, odors or other
16 nuisances. The property shall be provided with adequate
17 refuse containers and refuse disposal service,
18 j, The facility's buildings shall be structurally
19 maintained to exclude rodents and the property shall be
20 maintained rodent free,
21 k, The facility shall be operated in a manner
22 which will not impede traffic on Ross Street.
23 1. All existing cracked sidewalk, curb and gutter

Herewith for your consideration are the following supporting

Bert E, Jessup Transportation, Inc. was found to be
categorically exempt from the California Environmental Quality
Act process, since they will be using an existing facility and
the facility is not being expanded,
In my opinion the proposed operation will pose no adverse
effects to the City of Vernon and will not have a significant
effect on the environment, and no mitigating measures are
required.

TRUCK AND FREIGHT TERMINAL AT 3575 ROSS STREET
(January 2, 1997)
Bert E. Jessup Transportation, Inc. has applied for a
conditional use permit to operate a truck and freight terminal at
3575 Ross Street in the City of Vernon, It is a company
providing pick-up and delivery service of flowers. They intend
to jointly occupy the site with Heitz Trucking, Inc.
1. GENERAL PLAN The proposed use conforms to the Zoning
Ordinance and the General Plan. The site is presently being used
as a truck and freight terminal.
2. ~ The proposed site is of adequate size and shape
for the proposed use,
3, ADVERSE AFFECT The propdsed site is surrounded by
industrial uses compatible with the proposed use and no adverse
noise, odor, dust, smoke, light or glare, or risk of fire,
infection or explosion is anticipated from the proposed
operation.
4. ACCESS The site has access to Ross Street. This street
is of adequate size to handle the traffic generated from the
proposed operation.
5. TRUCK MOVEMENTS Bert E, Jessup Transportation, Inc. and
Heitz Trucking, Inc. will operate 40 trucks out of the facility,
Bert E. Jessup Transportation, Inc. will operate 12 of the 40

trucks. Trucking operations will be five days a week, from 4:30
am Monday through 10:00 pm Friday. Sales and customer service
will be conducted in the office area. Light maintenance will be
conducted in the shop area, Office and shop areas will operate
between 8:00 am and 6:00 pm on Saturday as well as Monday through
Friday hours. In general, trucks will travel on Ross Street to
Alameda Street then north to freeway access.
6. STATE OR FEDERAL CONDITIONS There are no conditions
imposed by State or Federal law.
