RESOLUTION NO. 6902
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A CONDITIONAL USE
PERMIT TO HEITZ TRUCKING, INC. FOR THE
OPERATION OF A TRUCK AND FREIGHT TERMINAL
AT 3575 ROSS STREET
WHEREAS, Heitz Trucking, Inc. has applied for a

conditional use permit to operate a truck and freight
7
terminal at 3575 Ross Street in the City of Vernon; and
8

WHEREAS, the City Council of the City of Vernon
held a hearing on said application for a conditional use
10
11
permit on January 7, 1997; and
WHEREAS, the proposed site is a conforming use in
12
the General Industrial (M) Zone which has been continuously
13
used as a truck and freight terminal previously operated by
14
Vecta Transportation Systems, Inc. and which requires a
15

conditional use permit under Zoning Ordinance Section
26,5.2-11 in order to continue the use; and
WHEREAS, the proposed operation will include the
hauling and temporary storage of general products; and
WHEREAS, the proposed site is approximately 2.26
acres in size,
and the size, shape, topography and drainage
of the parcel are adequate for the proposed operation; and

WHEREAS, a barrier wall or landscaping has been
installed where parking or maneuvering areas adjoin a public
street pursuant to the Vernon City Code; and
WHEREAS, the proposed site is surrounded by
industrial uses compatible with the proposed use and no

adverse effect from traffic, parking, noise, odors, dust,
1 smoke, light or glare, or risk of fire, infection or
2 explosion is anticipated from the proposed operation; and
3 WHEREAS, the site has access to Ross Street and in
4 general traffic will travel from the site on Ross Street to
5 Alameda Street, thence north to freeway access and the
6 streets to be utilized within the City of Vernon are
7 sufficient to handle the traffic generated from the proposed
8 operations; and
9 WHEREAS, the site is required to have adequate
10 off-street park~ng and loading facilities in accordance with
11 the Vernon City Code; and
12 WHEREAS, the conditions imposed on the conditional
13 use permit will adequately protect the public health, safety
14 and general welfare and the operation is consistent with all
15 applicable rules and laws of the City of Vernon; and
16 WHEREAS, the proposed use as to location,
17 operation, and design is consistent with the General Plan
18 and the Zoning Ordinance of the City of Vernon; and
19 WHEREAS, the project was found to be categorically
20 exempt from the California Environmental Quality Act as an
21 existing facility pursuant to Section 15301 of the
22 California Environmental Quality Act Guidelines and a Notice
23 of Exemption shall be filed with the County Clerk pursuant
24 to Section 15062 of the California Environmental Quality Act
25 Guidelines.
26 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
27 OF THE CITY OF VERNON AS FOLLOWS:

1 SECTION 1: The City Council of the City of Vernon
2 hereby finds and determines that the recitals contained
3 hereinabove are true and correct.
4 SECTION 2: Subject to the conditions set forth
5 below, the conditional use permit is granted to Heitz
6 Trucking, Inc, for the operation of a truck and freight
7 terminal at 3575 Ross Street.
8 SECTION ~: In order to adequately protect the
9 public health, safety and general welfare the following
10 conditions are imposed:
11 a. The facility shall be operated in accordance
12 with, and made to conform with all current codes, rules,
13 regulations and subject to permit fees as adopted by the
14 City of Vernon,
15 b. All parking and loading facilities shall be
16 paved with a hard durable surface material and shall be
17 adequately drained, and kept free of dust, mud, trash and
18 weeds. Where parking or maneuvering areas adjoin the public
19 street a barrier wall or landscaping shall be maintained to
20 meet City standards.
21 c. servicing of vehicles including washing, steam
22 cleaning and repairing shall be performed in facilities in
23 compliance with appropriate codes.
24 d. A National Pollutant Discharge Elimination
25 System Permit shall be obtained from the California State
26 Board of Water Resources.
27 e. No equipment or freight shall be stored on the
28 site, other than in buildings, trailers or on the docks,

1 f. Adequate.plans and materials must be available
2 for handling leaks or spills from vehicles during storage or
3 transportation.
4 g. All required federal, state, local and
5 regulatory agency permits shall be obtained prior to
6 operation. Prior to occupancy a business license and
7 occupancy permit shall be obtained.
8 h. A hazardous materials inventory and
9 businesslcontingency plan shall be submitted and a hazardous
10 materials permit shall be obtained from the City of Vernon
11 Health Department. Hazardous materialslwastes shall be
12 handled and managed in compliance with all appropriate
.
13 federal, state and local laws.
14 i. The facility shall be operated in a manner
15 that will prevent unsanitary conditions, odors or other
16 nuisances. The property shall be provided with adequate
17 refuse containers and refuse disposal service.
18 j. The facility's buildings shall be structurally
19 maintained to exclude rodents and the property shall be
20 maintained rodent free.
21 k. The facility shall be operated in a manner
22 which will not impede traffic on Ross Street.
23 1. All existing cracked sidewalk, curb and gutter
24 adjacent to the site in Ross Street shall be repaired and
25 maintained to meet City Standards.

SECTION 4: The City Clerk of the City of Vernon
2 shall certify to the passage of this resolution and
3 thereupon and thereafter the same shall be in full force and
4 effect.

Tuesday, January 7, 1997 at 5:00 p.m.

The purpose of the hearing is to obtain testimony from
affected and/or interested persons regarding this application.
The public is also invited to submit written comments regarding
the request prior to the Hearing.
Request: Grant a conditional use permit to allow the
applicant to operate a truck and freight
terminal.

Gentlemen:
Heitz Trucking, Inc. has applied for a conditional use
permit to operate a truck and freight terminal at 3575 Ross
Street in the City of Vernon.
Herewith for your consideration are the following supporting
documents:
1. Request for conditional use permit and information
supporting the application.
2. Engineer'S Report.
3. Notice of Public Hearing, copies of notification letters
to owners and tenants in the area and affidavits of posting and
mailing.
Heitz Trucking, Inc. was found to be categorically exempt
from the California Environmental Quality Act process, since they
will be using an existing facility and the facility is not being
expanded.
In my opinion the proposed operation will pose no adverse
effects to the City of Vernon and will not have a significant
effect on the environment, and no mitigating measures are
required.

It is recommended that the City Council find that the
proposed use is categorically exempt from the California
Environmental Quality Act process.
Further it is recommended that a Notice of Exemption be
filed with the County Clerk and the conditional use permit be
granted with the following conditions:
a. The facility shall be operated in accordance with, and

ON HEITZ TRUCKING, INC.
CONDITIONAL USE PERMIT TO OPERATE A
TRUCK AND FREIGHT TERMINAL AT 3575 ROSS STREET
(January 2, 1997)
Heitz Trucking, Inc. has applied for a conditional use
permit to operate a truck and freight terminal at 3575 Ross
Street in the City of Vernon. It is a trucking company providing
pick-up and delivery service of a wide range of items. They
intend to jointly occupy the site with Bert E. Jessup
Transportation, Inc.
1. GENERAL PLAN The proposed use conforms to the Zoning
Ordinance and the General Plan. The site is presently being used
as a truck and freight terminal.
2. ~ The proposed site is of adequate size and shape
for the proposed use.
3. ADVERSE AFFECT The proposed site is surrounded by
industrial uses compatible with the proposed use and no adverse
noise, odor, dust, smoke, light or glare, or Tisk of fire,
infection or explosion is anticipated from the proposed
operation.
4. ACCESS The site has access to Ross Street. This street
is of adequate size to handle the traffic generated from the
proposed operation.
5. TRUCK MOVEMENTS Heitz Trucking, Inc. and Bert E. Jessup
Transportation, Inc. will operate 40 trucks out of the facility.

Heitz Trucking, Inc. will operate 28 of the 40 trucks. Trucking
operations will be five days a week, from 4:30 am Monday through
10:00 pm Friday. Sales and customer service will be conducted in
the office area. Light maintenance will be conducted in the shop
area. Office and shop areas will operate between 8:00 am and
6:00 pm on Saturday as well as Monday through Friday hours. In
general, trucks will travel on Ross Street to Alameda Street then
north to freeway access.
6. STATE OR FEDERAL GONDITIONS There are no conditions
imposed by State or Federal law.
7. CONDITIONS It is recommended that the following
conditions be set on the permit to adequately protect the public
interests:
a. The facility shall be operated in accordance with, and
made to conform with all current codes, rules, regulations and
subject to permit fees as adopted by the City of Vernon.
b. All parking and loading facilities shall be paved with a
hard durable surface material and shall be adequately drained,
and kept free of dust, mud, trash and weeds. Where parking or
maneuvering areas adjoin the public street a barrier wall or
landscaping shall be maintained to meet City standards.
c. Servicing of vehicles including washing, steam cleaning
and repairing shall be performed in facilities in compliance with
appropriate codes.
d. A National Pollutant Discharge Elimination System Permit
shall be obtained from the California State Board of Water

Resources.
e. No equipment or freight shall be stored on the site,
other than in buildings, trailers or on the docks.
f. Adequate plans and materials must be available for
handling leaks or spills from vehicles during storage or
transportation.
g. All required federal, state, local and regulatory agency
permits shall be obtained prior to operation. Prior to occupancy
a business license and occupancy permit shall be obtained.
h. A hazardous materials inventory and business/contingency
plan shall be submitted and a hazardous materials permit shall be
obtained from the City of Vernon Health Department. Hazardous
materials/wastes shall be handled and managed in compliance with
all appropriate federal, state and local laws.
i. The facility shall be operated in a manner.that will
prevent unsanitary conditions, odors or other nuisances. The
property shall be provided with adequate refuse containers and
refuse disposal service.
j. The facility's buildings shall be structurally
maintained to exclude rodents and the property shall be
maintained rodent free.
k. The facility shall be operated in a manner which will
not impede traffic on Ross Street.
1. All existing cracked sidewalk, curb and gutter adjacent
to the site in Ross Street shall be repaired and maintained to
meet City Standards.
