A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A CONDITIONAL USE
PERMIT TO TOURCOACH FOR THE OPERATION OF
A TRUCK TERMINAL AT 2715 BONNIE BEACH PLACE
WHEREAS, TourCoach has applied for a conditional
use permit to operate a truck terminal at 2715 Bonnie Beach
in the City of Vernon; and
WHEREAS, the City Council of the City of Vernon
held a hearing on said application for a conditional use
permit on February 4, 1997; and
WHEREAS, the proposed site is a conforming use in
the Heavy Industry (M -2) Zone which requires a conditional
use permit under the Zoning Ordinance in order to continue
the use; and
WHEREAS, the proposed site is approximately 1.7`
acres in size, contains two buildings, and the size, shape,
topography and drainage of the parcel are adequate for the
proposed operation; and
WHEREAS, a barrier wall or landscaping will be
maintained where parking or maneuvering areas adjoin a
public street pursuant to the Vernon City Code; and
WHEREAS, the proposed site is surrounded by
industrial uses compatible with the proposed use and no
adverse effect from traffic, parking, noise, odors, dust,
smoke, light or glare, or risk of fire, infection or
explosion is anticipated from the proposed operation; and
WHEREAS, the site, has access to Bonnie Beach Place
and Bandini Boulevard and in general traffic will travel

from the site on Bandini Boulevard east to freeway access
and the streets to be utilized within the City of Vernon are
sufficient to handle the traffic generated from the proposed
operations; and
WHEREAS, the site is required to have adequate
off - street parking and loading facilities in accordance with
the Vernon City Code; and
WHEREAS, the proposed use as to location,
operation, and design is consistent with the General Plan
and the Zoning Ordinance of the City of Vernon; and
WHEREAS, the Community Services Department has
performed an Initial Study to determine the potential .
adverse impact to the environment that the proposed project
may cause, and has determined that the proposed project will
not have significant effect on the environment. The
Director of Community Services & Water has recommended that
a Negative Declaration be adopted in compliance with the
California Environmental Quality Act; and
WHEREAS, the conditions imposed on the conditional
use permit will adequately protect the public' health, safety
and general welfare and the operation is consistent with all
applicable rules and laws of the City of Vernon.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL,
OF THE CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon
hereby finds and determines that the recitals contained
hereinabove are true and correct
SECTION 2 The City Council hereby approves and

adopts the Negative Declaration for the project and hereby
finds that the project will not individually or cumulatively
have an adverse effect on the environment including the
wildlife resources.
SECTION 3: Pursuant to Section 711.4(c) of the
Fish and Game Code, the City has found no evidence that the
proposed project will have the potential for adverse effects
on wildlife resources and the project is therefore exempt
from the fees otherwise payable under Section 711.4.
SECTION 4: Subject to the conditions set forth
below, the conditional use permit is granted to TourCoach
for the operation of a bus repair and charter facility at
2715 Bonnie Beach Place.
SECTION 5: In order to adequately protect the
public health, safety and general welfare the following
conditions are imposed:
a. The facility shall be operated in accordance
with, and made to conform with all current codes, rules,
regulations and subject to permit fees as adopted by the
City of Vernon.
b. All required federal, state, local and
regulatory agency permits shall be obtained prior to
operation. Prior to occupancy a business license and
occupancy permit shall be obtained.
c. All parking and loading facilities shall be
paved with a hard durable surface material and shall be
maintained to meet City standards.
d. The facility shall be operated in a manner

that will prevent unsanitary conditions, odors or other
nuisances. The property shall be provided with adequate
refuse containers and refuse disposal service.
e. The facility's buildings shall be structurally
maintained to exclude rodents and the property shall be
maintained rodent free.
f. Servicing of vehicles including washing, steam
cleaning and repairing shall be performed within a building
or other facilities in compliance with appropriate codes.
g. No equipment or freight shall be stored on the
site, other than in buildings or trailers.
h. A National Pollutant Discharge Elimination
System Permit shall be obtained from the California State
Board of Water Resources.
i. Adequate plans and materials must be available
for handling leaks or spills from vehicles during storage or
transportation.
j. A hazardous materials inventory and
business /contingency plan shall be obtained from the City of
Vernon Health Department. Hazardous materials /wastes shall
be handled and managed in compliance with all appropriate
federal, state and local laws.
k. The facility shall be operated in a manner
which will not impede traffic on Bonnie Beach Place or
Bandini Boulevard.
1. All existing cracked sidewalk, curb and gutter
adjacent to the site in Bonnie Beach Place and Bandini
Boulevard shall be repaired and maintained to meet City

Standards.
m. Discharging of any vehicle waste shall not be
permitted in the yard.
Servicing of bus sanitary wash rooms shall not
be permitted without prior approval by the, City of Vernon
Health Department and the County Sanitation Districts of Los
Angeles County.
o. The use of the existing vehicle wash area
shall be restricted for adequate waste water control,
storage and removal.
p. The two existing covered underground waste oil
storage tanks shall be properly closed now, or they may be
permitted for temporary use until December, 1998 when they
are required to be closed or brought into compliance.
q. On site fueling of vehicles at the facility by
tanker trucks is prohibited.
r. An annual certification for the backflow
prevention device at the facility shall be provided.

SECTION 6: The City Clerk of the City of Vernon
shall certify to the passage of this resolution and
thereupon and thereafter the same shall be in full force and
effect.

the Comprehensive Zoning Ordinance, Section 26.4.2 -8, Development
Standards, for the building located at 2110 37th Street. Trans-

VARIANCE APPLICATION
JANUARY 28, 1997
N & E Funding, Inc. has requested a variance from the
Comprehensive Zoning Ordinance Section 26.4.2 -8, Development
Standards, for the property located at 2110 37th Street in the
City of Vernon. The building which it owns was constructed with
two non - conforming truck loading spaces, one measuring 10.0 feet
in width and 32.0 feet in length and one measuring 10.0 feet in
width and 24.5 feet in length. It has stated that only vehicles
of smaller lengths will be used at the non - conforming truck
loading spaces. The building is approximately 13,400 square
feet in size.
Section 26.4.2 -7 (b) requires two truck loading spaces for
buildings with a gross floor area between 8,001 and 25,000 square
feet in size. Section 26.4.2 -8 (c) of the Comprehensive Zoning
Ordinance specifies that each loading space shall be a minimum of
10 feet wide and 65 feet long and Section 26.4.6 -4 (c) provides
that a non- conforming building must comply with these standards
within five years of April 18, 1989 unless a variance is granted.
N & E Funding, Inc. has indicated that requiring the two
non - conforming truck loading spaces to be 65 feet long by 10 feet
wide would be a hardship. It has indicated that it has no plans
for expansion or alteration of the building configuration.
The operation is in conformance with the Zoning Ordinance and
General Plan. Therefore, it is recommended that the variance be
granted with the following conditions:
(a) The usage of the two non - conforming truck loading spaces
shall be limited so that no truck parked at or using the loading
docks shall extend into the existing street right -of -way as shown
on the Master Plan of Streets, dated June 16, 1992.
(b) All existing and future tenants shall be notified of
these restrictions and a condition stating the same shall be
placed in all future leases.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A VARIANCE TO
N & E FUNDING, INC. FROM SECTION
26.4.2 -8, DEVELOPMENT STANDARDS, OF THE
COMPREHENSIVE ZONING ORDINANCE, FOR THE
PROPERTY LOCATED AT 2110 37TH STREET IN
THE CITY OF VERNON
WHEREAS, N & E Funding, Inc. owns the property
located at 2110 37th Street in the City of Vernon and has
requested a variance from conformance with Section 26.4.2 -8,
Development Standards, of the Comprehensive Zoning Ordinance;
and
WHEREAS, the building is unique in that the existing
building measures approximately 13,400 square feet and was
constructed with two non - conforming truck loading spaces, one
measuring 10.0 in width and 32.0 feet in length, and one
measuring 10.0 feet in width and 24.5 feet in length; and
WHEREAS, Zoning Ordinance Section 26.4.2 -7 (b)
requires two truck loading spaces for buildings with a gross
floor area between 8,001 and 25,000 square feet in size; and
WHEREAS, Zoning Ordinance Section 26.4.2 -8 (c)
specifies that each truck loading space shall be a minimum of
10 feet wide and 65 feet long, and Section 26.4.6 -4 (c)
provides that a non - conforming building must comply with these
standards within 5 years of April 18, 1989 unless a variance is
granted; and
WHEREAS, there is insufficient space on the property
and the application of the development standards for the truck
loading spaces requirements will create an unreasonable
hardship by requiring the non - conforming spaces to be 10 feet

will be a maximum of 8 employees consisting of 2 employees for a dispatch crew and 6
employees for bus maintenance and service.
This is to advise that the City of Vernon has approved the above described project on July 20, 1993 and has made the
following determinations regarding the above described project:

2. An Environmental Impact Report was prepared for this project pursuant to the provisions of CEQA.
