Engineer's Report The building has two non- conforming truck loading spaces that are both 10 feet wide, one is 32 feet long and the other is 24.5 feet long. This has been reviewed by the Director of Community Services, and it is hereby recommended that the Variance be granted subject to the following Conditions: a. All existing and future tenants shall be notified of this restriction and a condition stating this shall be placed in all future leases. BVM /hr Very truly yours, Bruce V. Malkenhorst City Clerk ENGINEER'S REPORT N & E FUNDING,INC. 2110 37TH STREET VARIANCE APPLICATION JANUARY 28, 1997 N & E Funding, Inc. has requested a variance from the Comprehensive Zoning Ordinance Section 26.4.2 -8, Development Standards, for the property located at 2110 37th Street in the City of Vernon. The building which it owns was constructed with two non - conforming truck loading spaces, one measuring 10.0 feet in width and 32.0 feet in length and one measuring 10.0 feet in width and 24.5 feet in length. It has stated that only vehicles of smaller lengths will be used at the non - conforming truck loading spaces. The building is approximately 13,400 square feet in size. Section 26.4.2 -7 (b) requires two truck loading spaces for buildings with a gross floor area between 8,001 and 25,000 square feet in size. Section 26.4.2 -8 (c) of the Comprehensive Zoning Ordinance specifies that each loading space shall be a minimum of 10 feet wide and 65 feet long and Section 26.4.6 -4 (c) provides that a non- conforming building must comply with these standards within five years of April 18, 1989 unless a variance is granted. N & E Funding, Inc. has indicated that requiring the two non - conforming truck loading spaces to be 65 feet long by 10 feet wide would be a hardship. It has indicated that it has no plans for expansion or alteration of the building configuration. The operation is in conformance with the Zoning Ordinance and General Plan. Therefore, it is recommended that the variance be granted with the following conditions: (a) The usage of the two non - conforming truck loading spaces shall be limited so that no truck parked at or using the loading docks shall extend into the existing street right -of -way as shown on the Master Plan of Streets, dated June 16, 1992. (b) All existing and future tenants shall be notified of these restrictions and a condition stating the same shall be placed in all future leases. January 28, 1997 TO: Bruce V. Malkenhorst, City Administrator FROM: Samuel "Kevin" Wilson, Director of Community Services & Water SUBJECT: Variance - N & E Funding, Inc. @ 2110 37th Street N & E Funding, Inc. has submitted a variance application. It is requesting a variance from the Comprehensive Zoning Ordinance, Section 26.4.2 -8, Development Standards, for the building located at 2110 37th Street. The building has two non - conforming truck loading spaces, one measuring 10.0 feet in width and 32.0 feet in length and one measuring 10.0 feet in width and 24.5 feet in length. It is proposing to use only vehicles of a smaller length at the non- conforming truck loading spaces. Herewith is the following evidence: 1. Application for variance. 2. Affidavits of posting and mailing. 3. Notice of public hearing. 4. Engineers report. It is recommended that the variance be granted subject to the following conditions: (a) The usage of the two non- conforming truck loading spaces shall be limited so that no truck parked at or using the loading docks shall extend into the street right -of -way. (b) All existing and future tenants shall be notified of this restriction and a condition stating this shall be placed in all future leases.
