A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON ACCEPTING THE BID OF KENKO, INC. FOR
VERNON GAS DISTRIBUTION SYSTEM, PHASE I, IN
ACCORDANCE WITH CONTRACT NO. 524 OF THE CITY OF
VERNON AND APPROVING THE EXECUTION OF SAID
CONTRACT

6 WHEREAS, Contract No. 524 of the City of Vernon was
7 approved by the City Council of the City of Vernon pursuant to
8 Resolution No. 6431, and sealed bids were opened on June 30, 1994;
9 and
10 WHEREAS, said bids were referred to Samuel Kevin Wilson,
11 Director of Community Services, who has reported to the City
12 Council under the date of January 29, 1997, recommending that
13 Contract No. 524 for Vernon Gas Distribution System, Phase I, be
14 executed with Kenko, Inc., on the basis of its bid in the sum of
15 $1,841,652.00 plus a mandated increase in the State prevailing
16 wage rate of $11,000.00 for a total of One Million Eight Hundred
17 Fifty-two Thousand six Hundred Fifty-two Dollars and No Cents
18 ($1,852,652.00), being the lowest responsible bid meeting the
19 contract requirements; and
20 WHEREAS, Valley Engineers, Inc. submitted an original bid
21 in the amount of $1,772,900.00, but declined to accept an increase
22 of $11,000.00 for the State mandated increase in prevailing wage
23 rates, and instead recalculated its bid in writing for a total of
24 $2,112,761.80, which is no longer the lowest responsible bid.
25 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
26 CITY OF VERNON AS FOLLOWS:

SECTION 1: The City Council of the City of Vernon hereby
28 finds and determines that the recitals contained hereinabove are
1 true and correct.

SECTION 2 The City Council of the City of Vernon does
3 hereby award Contract No. 524 to Kenko, Inc., in accordance with
4 the recommendation of Samuel Kevin wilson, Director of Community
5 Services, and authorizes the Mayor to execute said Contract on
6 behalf of the city.

SECTION 3: All other bids are rejected subject to
8 execution of the contract and the City Treasurer is hereby
9 directed to return to unsuccessful bidders any cashier or cer-
10 tified checks deposited with said bids upon the receipt of an
11 executed contract from Kenko, Inc., accompanied by all required
12 bonds and certificates.

SECTION 4: The City Clerk of the City of Vernon shall
14 certify to the passage of this resolution and thereupon and
15 thereafter the same shall be in full force and effect.
16 APPROVED AND ADOPTED this 4th day of February, 1997.
