A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A VARIANCE TO
C.M.D. PARTNERS FROM SECTION 26.4.2-8
(e), ACCESS, OF THE COMPREHENSIVE ZONING
ORDINANCE, FOR THE PROPERTY LOCATED AT
4711 50TH STREET IN THE CITY OF VERNON
WHEREAS, C.M.D. Partners owns a parcel of property
located at 4711 50th Street in the City of Vernon which requires
a variance from Section 26.4.2-8 (e), Access, of the
Comprehensive Zoning Ordinance; and
WHEREAS, the physical condition of the property is
unique in that the proposed parcel measuring approximately
28,800 square feet is rectangular in shape and construction of
a building will leave a parking area approximately 120 feet by
118 feet on the northeast corner of 50th Street and Corona
Avenue; and
WHEREAS, Zoning Ordinance Section 26.4.2-8 (e)
specifies that no curbcut for a driveway to any parking or
loading facility shall be permitted within 75 feet of the point
of tangency of any curb return for a driveway used by trucks;
and
WHEREAS, C.M.D. Partners will dedicate property to
expand the curb return to a 50.0 foot radius, with a 42.0 foot
property line radius, which would require the curbcuts to be
located at least 125 feet from the corner; and
WHEREAS, C.M.D. Partners is proposing to construct a
curbcut on 50th Street and a curbcut on Corona Avenue for
driveways that are less than 75 feet from the point of tangency
of the proposed curb return on the northeast corner of 50th

2 WHEREAS, 4711 50th Street is located in the M zone
3 and the operation is consistent with the objectives of the
4 General Plan and Zoning Ordinance; and
5 WHEREAS, the City Council of the City of Vernon held
6 a hearing on said application for a variance on March 4, 1997.
7 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
8 THE CITY OF VERNON AS FOLLOWS:
9 SECTION 1: The City Council of the City of Vernon
10 hereby finds and determines that the recitals contained
11 hereinabove are true and correct.
12 SECTION 2: A variance from Section 26.4.2-8 (e),
13 Access, of the Comprehensive Zoning Ordinance, requiring
14 seventy-five feet from the point of tangency of any curb return
15 to a curbcut for a driveway to any parking or loading facility
16 to be used by trucks is hereby granted to C.M.D. Partners at
17 4711 50th Street.
18 SECTION 3: The variance shall be granted subject to
19 the following conditions:
20 (a) C.M.D. Partners shall construct or provide the
21 funding to construct all required frontage improvements
22 including the enlargement of the curb radius.
23 (b) C.M..D. Partners shall dedicate to the City of
24 Vernon the property required for a property line radius of 42
25 feet.
26 (c) Curbcuts for the two proposed driveways shall be
27 located approximately as shown on Exhibit "A" attached hereto
28 and made a part hereof by reference.

SECTION 4: Noncompliance with these conditions shall
constitute sufficient grounds for the City Council of the City
of Vernon to void this variance and require. the application of
access requirements.
SECTION 5: The City Clerk of the City of Vernon
shall certify to the passage of this resolution and thereupon
and thereafter the same shall be in full force and effect.

C.M.D. Partners has requested a variance from the
Comprehensive Zoning Ordinance Section 26.4.2-8 (e), Access, for
the property located at 4711 50TH Street in the City of Vernon.
The parcel measures approximately 28,800 square feet and is
rectangular in shape being 120 feet deep by 238 feet wide.
C.M.D. Partners is proposing to build a 15,700 square foot
building and as part of the development proposes to construct a
12,300 square foot parking area (approximately 120 feet by 118
feet) with curbcuts for two driveways to be used by trucks less
than 75 feet from the point of tangency of the proposed curb
return on the northeast corner of 50th Street and Corona Avenue.
Section 26.4.2-8 (e) specifies that no curbcut for a
drive~_ay to any parking or loading facility shall be permitted
within 75 feet of the point of tangency of any curb return for a
driveway used by trucks. The parking area will be located at the
corner and a 50 foot curb return would require that the driveways
be 125 feet from the corner, which is outside of the parking
area.
C.M.D. Partners has indicated that the combination of the
corner location, depth of the parcel, enlarged curb return

radius, and the requirements of Section 26.4.2-8 (e) creates a
hardship on the usefulness of the parcel. As part of the
development, C.M.D. Partners intends to expand the existing curb
return to have a radius of 50.0 feet with a property line radius
of 42.0 feet, thus improving the traffic conditions at the
existing corner. A plot plan of the proposed development is
shown on Exhibit "A."
The corner is a four-way stop and with the enlarged curb
return radius, trucks will be out of the intersection before
beginning their turn to enter the proposed driveways. 50th
Street and Corona Avenue are not considered arterials or
collectors and traffic at this intersection is minimal. Other
parcels in the vicinity have driveways for trucks that are less
then 75 feet from the point of tangency of the curb return.
The operation is in conformance with the Zoning Ordinance
and General Plan. Therefore, it is recommended that the variance
be granted subject to the following conditions:
(a) C.M.D. Partners shall construct or provide the funding

VARIANCE APPLICATION
FEBRUARY 26, 1997
C.M.D. Partners has requested a variance from the
Comprehensive Zoning Ordinance Section 26.4.2-8 (e), Access, for
the property located at 4711 50TH Street in the City of Vernon.
The parcel measures approximately 28,800 square feet and is
rectangular in shape being 120 feet deep by 238 feet wide.
C.M.D. Partners is proposing to build a 15,700 square foot
building and as part of the development proposes to construct a
12,300 square foot parking area (approximately 120 feet by 118
feet) with curb cuts for two driveways to be used by trucks less
than 75 feet from the point of tangency of the proposed curb
return on the northeast corner of 50th Street and Corona Avenue.
Section 26.4.2-8 (e) specifies that no curb cut for a
driveway to any parking or loading facility shall be permitted
within 75 feet of the point of tangency of any curb return for a
driveway used by trucks. The parking area will be located at the
corner and a 50 foot curb return would require that the driveways
be 125 feet from the corner, which is outside of the parking
area.
C.M.D. Partners has indicated that the combination of the
corner location, depth of the parcel, enlarged curb return

radius, and the requirements of Section 26.4.2-8 (e) creates a
hardship on the usefulness of the parcel. Other parcels in the
vicinity have driveways for trucks that are less then 75 feet
from the point of tangency of the curb return. As part of the
development, C.M.D. Partners intends to expand the existing curb
return to have a radius of 50.0 feet with a property line radius
of 42.0 feet, thus improving the traffic conditions at the
existing corner. A plot plan of the proposed development is
shown on Exhibit "A." The operation is in conformance with the
Zoning Ordinance and General Plan. Therefore, it is recommended
that the variance be granted subject to the following conditions:
(a) C.M.D.. Partners shall construct or provide the funding
to construct all required frontage improvements including the
enlargement of the curb return radius.
(b) C.M.D. Partners shall dedicate to the City of Vernon
the property required for a property line radius of 42.0 feet.
(c) Curb cuts for the two proposed driveways shall be
located approximately as shown on Exhibit "A" attached to the
Engineer's Report.
