A RESOLUTION OF THE CITY COUNCIL ~F THE CITY
3 OF VERNON APPROVING AND AUTHORIZING THE
IMPLEMENTATION OF VEHICLE RELEASE FEE PROGRAM
4 FOR VEHICLES IMPOUNDED BY THE CITY OF VERNON
5 WHEREAS, Section 22850.5 of the California Vehicle Code
6 provides that agencies can recoup administrative costs relating to
7 properly impounded vehicles; and
8 WHEREAS, the City of Vernon incurs administrative costs
9 in impounding and processing vehicles, including those of
10 motorists who have been arrested for traffic violations such as
11 driving with a suspended or revoked licenses or driving under the
12 influence of an alcoholic beverage, drug, or other illegal
13 substance; and
14 WHEREAS, the administrative costs include the time spent
15 in preparing towing forms, jail booking forms, release of
16 vehicles, billing by records staff, and finance department
17 invoicing; and
18
WHEREAS, the time spent by the city of Vernon to
19 complete administrative tasks related to the impounding of
20 vehicles exceeds the amounts received by the City from the fines
21 imposed by the court for traffic violations; and
22 WHEREAS, the Chief of Police recommends the
23 implementation of a vehicle release fee program.
24 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
25 THE CITY OF VERNON AS FOLLOWS:

SECTION 1: The City Council of the City of Vernon
27 hereby finds and determines that the recitals contained
28 hereinabove are true and correct.

SECTION 2: The City Council of the City of Vernon
2 hereby approves and adopts the Vehicle Release Fee Program, a copy
3 of which is attached hereto as Exhibit "A" and made a part hereof
4 by reference.

SECTION 3: The City Clerk of the City of Vernon shall
6 certify to the passage of this resolution, and thereupon and
7 thereafter the same shall be in full force and effect.
8 APPROVED AND ADOPTED this 22nd day of April, 1997.

EXHIBIT A
CITY OF VERNON
VEHICLE RELEASE FEE PROGRAM
A. The following fees shall be collected prior to the release of
any vehicle properly impounded by or at the request of the
Vernon Police Department:
1. For release of any vehicle impounded as a result of
an arrest for driving under the influence of an
alcoholic beverage, drug, or any illegal
substance: . . . . . . . . . . . . . . . . . $230.00
2. For release of any other vehicle properly impounded
under the provisions of the California Vehicle
Code: ....................... $100.00
B. No personal checks will be accepted in payment of any such fee.
C. The vehicle shall be released only to the registered owner.
D. The fee shall be waived for any vehicle reported stolen prior to
its impoundment or on other verifiable proof of theft.
E. The fee may be waived by the Chief of Police for any vehicle
impounded for any other cause if the vehicle or its driver were
not cited for a traffic or other violation.
