RESOLUTION NO. 6950
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A CONDITIONAL USE
PERMIT TO TRANSPORT PARTNERS, INC. FOR THE
OPERATION OF A TRUCK TERMINAL AT 2230 38TH STREET
5 WHEREAS, Transport Partners, Inc. has applied for
6 a conditional use permit to operate a truck terminal at 2230
7 38th Street in the City of Vernon; and
8 WHEREAS, the City Council of the City of Vernon
9 held a hearing on said applicatic:m for a conditional use
10 permit on May 6, 1997; and
11 WHEREAS, the proposed site is a non-conforming use
12 in the General Industrial (M) Zone which has been
13 continuously used as a truck and freight terminal previously
14 operated by Will.ig Freight Lines and currently operated by
15 USF Distribution Services, Inc. and which requires a
16 conditional use permit under the Zoning Ordinance in order
17 to qualify for a new occupancy permit pursuant to Vernon
18 City Code Section 26.2.5-11; and
19 WHEREAS, the proposed operation will use the
20 property as a truck terminal for approximately 30 trailers
21 and 15 tractors; and
22 WHEREAS, USF Distribution Services, Inc. will
23 continue to occupy the southern portion of the property
24 while Transport Partners, Inc. occupies the northerly
25 portion of the property; and
26 WHEREAS, the proposed site is approximately 11.9
27 acres in size, contains two buildings, and the size, shape,
28 topography and drainage of the parcel are adequate for the

1 proposed operations; and
2 WHEREAS, a barrier wall or landscaping will be
3 installed where parking or maneuvering areas adjoin a public
4 street pursuant to the Vernon City Code; and
5 WHEREAS, the proposed site is surrounded by
6 industrial uses compatible with the proposed use and no
7 adverse effect from traffic, parking, noise, odors, dust,
8 smoke, light or glare, or risk of fire, infection or
9 explosion is anticipated from the proposed operation; and
10 WHEREAS, the site has access to 38th and Ross
11 Streets and in general traffic will travel east on 38th
12 Street to the 710 Freeway or west on 38th Street to Alameda
13 Street going north to the 10 Freeway; and the streets to be
14 utilized within the City of Vernon are sufficient to handle
15 the traffic generated from the proposed operations; and
16 WHEREAS, the site is required to have adequate
17 off street parking and loading facilities in accordance with
18 the Vernon City Code; and
19 WHEREAS, the conditions imposed on the conditional
20 use permit will adequately protect the public health, safety
21 and general welfare and the operation is consistent with all
22 applicable rules and laws of the City of Vernon; and
23 WHEREAS, the proposed use as to location,
24 operation, and design is consistent with the General Plan
25 and the Zoning Ordinance of the City of Vernon; and
26 WHEREAS, the project was found to be categorically
27 exempt from the California Environmental Quality Act as an
28 existing facility pursuant to Section 15301 of the

1 California Environmental Quality Act Guidelines and a Notice
2 of Exemption shall be filed with the County Clerk pursuant
3 to Section 15062 of the California Environmental Quality Act
4 Guidelines.
5 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
6 OF THE CITY OF VERNON AS FOLLOWS:
7 SECTION 1: The City Council of the City of Vernon
8 hereby finds and determines that the recitals contained
9 hereinabove are true and correct.
10 SECTION 2: Subject to the conditions set forth
11 below, the conditional use permit is granted to Transport
12 Partners, Inc. for the operation of a truck terminal at 2230
13 38th Street.
14 SECTION 3: In order to adequately protect the
15 publ.ic health, safety and general welfare the following
16 conditions are imposed:
17 a. The facility shall be operated in accordance
18 with all current codes, rules, regulations and subject to
19 permit fees as adopted by the City of Vernon. All trucking
20 operations, including truck and trailer parking, shall be
21 limited to the lot located at 223D 38th Street in the City
22 of Vernon.

b. All required federal, state, local and
regulatory agency permits shall be obtained prior to
operation. Prior to occupancy a business license and
occupancy permit shall be obtained.
c. All parking and loading facilities shall be
paved and maintained with a hard durable surface material

1 and shall be adequately drained, and kept free of dust, mud,
2 trash and weeds. Where parking or maneuvering areas adjoin
3 the public street a barrier wall or landscaping shall be
4 installed and maintained to meet City standards.
5 d. All existing cracked sidewalk, curb and gutter
6 adjacent to the site on 38th Street shall be repaired and
7 maintained to meet City Standards.
8 e. No equipment or freight shall be stored on the
9 site, other than in buildings, trailers or on the docks.
10 f. Servicing of vehicles including washing, steam
11 cleaning and repairing shall be performed in facilities in
12 compliance with appropriate codes.
13 g. The facility shall be operated in a manner
which will not impede traffic on 38th and Ross Streets.

15 h. A National Pollutant Discharge Elimination
16 System Permit shall be obtained from the California State
17 Board of Water Resources.
18 i. A hazardous materials inventory and
19 business/contingency plan shall be submitted and a hazardous
20 materials permit shall be obtained from the City of Vernon
21 Health Department. Hazardous materials shall be handled and
22 managed in compliance with all appropriate federal, state
and local laws.

24 j. Adequate plans and materials must be available
25 for handling leaks or spills from vehicles during storage or
26 transportation.
27 k. The facility shall be operated in a manner
28 that will prevent unsanitary conditions, odors or other

1 nuisances. The property shall be provided with adequate
2 refuse containers and refuse disposal service.
3 1. The facility's buildings shall be structurally
4 maintained to exclude rodents and the property shall be
5 maintained rodent free.
6 m. Adequate employee toilet and handwash
7 facilities shall be provided to include at least one toilet
8 and one lavatory for every 10 male employees, and one toilet
9 and one lavatory for every 10 female employees or fraction
10 thereof.
11 n. Toilet rooms shall be provided with adequate
12 ventilation, lighting, and wall mounted single service soap,
13 towel and toilet paper dispensers.
14 o. Approved drinking water facilities shall be
15 provided for employees.
16 p. If food products are to be stored on the site,
17 the applicant shall apply for a City of Vernon Food
18 Warehouse Health Permit.
19 SECTION 4: The City Clerk of the City of Vernon
20 shall certify to the passage of this resolution and
21 thereupon and thereafter the same shall be in full force and
22 effect.

Transport Partners, Inc. has submitted an application for a
conditional use permit. They intend to occupy the site at 2230
38th Street. They are proposing to use the property as a truck
terminal.
Since the site is an existing truck terminal, the project is
exempt from the California Environmental Quality Act process.

Gentlemen:
Transport Partners, Inc. has applied for a conditional use
permit to operate a truck and freight terminal at 2230 38th
Street in the City of Vernon.
Herewith for your consideration are the following supporting
documents:
1. Request for conditional use permit and information
supporting the application.
2. Engineers's Report.
3. Notice of Public Hearing, copies of notification letters
to owners and tenants in the area and affidavits of posting and
mailing.
Transport Partners, Inc. was found to be categorically
exempt from the California Environmental Quality Act process,
since they will be using an existing facility and the facility is
not being expanded.
In my opinion the proposed operation will pose no adverse
effects to the City of Vernon and will not have a significant
effect on the environment, and no mitigating measures are
required.

It is recommended that the City Council find that the
proposed use is categorically exempt from the California

Further it is recommended that a Notice of Exemption be
filed with the County Clerk and the conditional use permit be
granted with the following conditions:

In accordance with the conditional use permit instructs we are answering, items 8 and 9.
We will have 14 route trucks moving in and out of the facility between the hours of9 to 7pm and
there will be the same number of cars parked I'm sure. Also there will be an office staff often
people who will work between 9 and 7pm also.
As to the Hazardous materials report we will have no hazmat material on the premises.

I appreciate you takini the time to meet with me on April 16, 1997, regarding Hannibal
Industries, Inc.'s desire to lease addition space at 2230 E. 38th Street. I have compiled the
information you had requested during our meeting. Please note that there is typographical error
on the diagram of the property I provided you. In the upper right, blocked-off parking space for
Transpon Partners, the square footage should read approximately "22.900 sq. ft.".
Here is the information you requested:
(1) There are 29 marked parking spaces for office parking within the
Northern portion of the property;
(2) USF will be able to station approximately 4{) trailers in the South-East
comer of the property:
(3) In the South-West comer, near the Ross Street gate, USF will be able to
station appro~ate1y 70 trailers: and
(4) Transport Partners will be able to station approximately 20 trailers in the
Nom-East ponion. However. Transport indicates that they have less than
28 trailers, most of which will be stationed adjacent to the dock doors
stationary during non-operating hours.
During our meeting, you bad expressed concern that there might not be enough space for
both companies. USF and Transport Partners, to occupy and operate within the property. As you

ENGINEER'S REPORT
ON TRANSPORT PARTNERS, INC.
CONDITIONAL USE PERMIT TO OPERATE A
TRUCK TERMINAL AT 2230 38TH STREET
(May 1, 1997)
Transport Partners, Inc. has applied for a conditional use
permit to operate a truck terminal at 2230 38th Street in the
City of Vernon. Transport Partners, Inc. is a trucking company
providing pick-up and delivery service of a wide range of items.
1. GENERAL PLAN The proposed use conforms to the Zoning
Ordinance and the General Plan. The site is presently being used
as a truck and freight terminal.
2. ~ The proposed site is approximately 11.9 acres in
size and contains two buildings: a cross dock terminal and
garage. The size, shape, topography and drainage of the parcel
are adequate for the proposed operation.
3. ADVERSE AFFECT The proposed site is surrounded by
industrial uses compatible with the proposed use and no adverse
noise, odor, dust, smoke, light or glare, or risk of fire,
infection or explosion is anticipated from the proposed
operation.
4. ACCESS The site has access to 38th and Ross Streets.
These streets are of adequate size to handle the traffic
generated from the proposed operation.
5. TRUCK MOVEMENTS Transport Partners, Inc. will operate
approximately 15 trucks at the facility which will make

approximately one trip each day. Approximately 5 outside haulers
will access the site daily. There will be 10 employees at the
site. USF Distribution Services, Inc. will continue to occupy
the southern portion of the facility and will also generate
approximately 45 truck trips each day, along with 20 employees
vehicle trips. Trucks will travel north on Ross Street to 38th
Street and east on 38th Street to Bandini Boulevard then to the
710 Freeway or west on 38th Street to Alameda Street going north
to the 10 Freeway.
6. STATE OR FEDERAL CONDITIONS There are no conditions
imposed by State or Federal law.
7. CONDITIONS It is recommended that the following
conditions be set on the permit to adequately protect the public
interests:
a. The facility shall be operated in accordance with all
current codes, rules, regulations and subject to permit fees as
adopted by the City of Vernon. All trucking operations,
including truck and trailer parking, shall be limited to the lot
located at 2230 38th Street in the City of Vernon.
b. All parking and loading facilities shall be paved and
maintained with a hard durable surface material and shall be
adequately drained, and kept free of dust, mud, trash and weeds.
Where parking or maneuvering areas adjoin the public street a
barrier wall or landscaping shall be installed and maintained to
meet City standards.
c. Servicing of vehicles including washing, steam cleaning

and repairing shall be performed in facilities in compliance with
appropriate codes.
d. A National Pollutant Discharge Elimination System Permit
shall be obtained from the California State Board of Water
Resources.
e. No equipment or freight shall be stored on the site,
other than in buildings, trailers or on the docks.
f. Adequate plans and materials must be available for
handling leaks or spills from vehicles during storage or
transportation.
g. All required federal, state, local and regulatory agency
permits shall be obtained prior to operation. Prior to occupancy
a business license and occupancy permit shall be obtained.
h. A hazardous materials inventory and business/contingency
plan shall be submitted and a hazardous materials permit shall be
obtained from the City of Vernon Health Department. Hazardous
materials/wastes shall be handled and managed in compliance with
all appropriate federal, state and local laws.
i. The facility's buildings shall be structurally
maintained to exclude rodents and the property shall be
maintained rodent free.
j. The facility shall be operated in a manner which will
not impede traffic on 38th and Ross Streets.
k. All existing cracked sidewalk, curb and gutter adjacent
to the site on 38th Street shall be repaired and maintained to
meet City Standards.

1. The facility shall be operated in a manner that will
prevent unsanitary conditions, odors or other nuisances. The
property shall be provided with adequate refuse containers and
refuse disposal service.
m. Adequate employee toilet and handwash facilities shall be
provided to include at least one toilet and one lavatory for
every 10 male employees, and one toilet and one lavatory for
every 10 female employees or fraction thereof.
n. Toilet rooms shall be provided with adequate
ventilation, lighting, and wall mounted single service soap,
towel and toilet paper dispensers.
o. Approved drinking water facilities shall be provided for
employees.
p. If food products are to be stored on the site, the
applicant shall apply for a City of Vernon Food Warehouse Health
Permit.

Transport Partners, Inc. has submitted an application for a
conditional use permit. They are proposing to occupy the property at
2230 38th Street. Transport Partners, Inc. is a transporter of general
commodities. The site is currently being used as a truck terminal so the
project is exempt from the California Environmental Quality Act process.
They plan to have approximately 30 trailers at the site. They will have
15 tractors at the site that will make approximately one trip each day.
They will also have outside haulers that will generate 5 trips to/from
the site each day for a total of 20 trips (entering and exiting) each
day. They.intend to have 10 employees. Their business hours will be
between 7 am and 7 pm, Monday through Friday with occasional deliveries
on Saturdays.
