Resolution No. 6954 " 1 RESOLUTION NO. 6954 2 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON APPROVING AND AUTHORIZING EXECUTION OF A JOINT RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF LOS ANGELES, THE CITY COUNCILS OF THE CITY OF MAYWOOD AND THE CITY OF VERNON, THE REDEVELOPMENT AGENCY OF THE CITY OF VERNON AND THE GREATER LOS ANGELES COUNTY VECTOR CONTROL DISTRICT APPROVING AND ACCEPTING THE NEGOTIATED EXCHANGE OF PROPERTY TAX REVENUE RESULTING FROM REORGANIZATION NO. 1-96 (PARCELS 1 AND 2) BETWEEN THE CITIES OF MAYWOOD AND VERNON 4 5 6 7 8 9 WHEREAS, the ci ties of Vernon and Maywood on or about 10 February 9, 1996, filed an application with the Los Angeles County Local Agency Formation Commission for approval of an exchange of 11 12 parcels known as Reorganization No. 1-96 (Parcels 1 and 2); and WHEREAS, pursuant to section 99 of the California Revenue 13 14 and Taxation Code, prior to'the effective date of any jurisdictional 15 change, the governing bodies of all agencies whose service areas or service responsibilities would be al tered by such change must 16 17 determine the amount of property tax revenue to be exchanged between the affected agencies and approve and accept the negotiated exchange 18 19 of property tax revenues by joint resolution; and 20 WHEREAS, a joint resolution has been prepared between the 21 Board of Supervisors of Los Angeles County (on behalf of Los Angeles 22 County, the Los Angeles County Consolidated Fire Protection 23 District, and the Los Angeles County Public Library), the City of Maywood, the City of Vernon, the Redevelopment Agency of the City of 24 Vernon and the Greater Los Angeles County Vector Control District 25 (the "Agencies") which determines the amount of property tax revenue 26 27 to be exchanged between the respective Agencies as a result of Reorganization No. 1-96 (Parcels 1 and 2). 28 .' ~-~ t 1 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE 2 CITY OF VERNON AS FOLLOWS: 3 SECTION 1: The City Council of the City of Vernon hereby 4 finds and determines that the recitals contained hereinabove are 5 true and correct. 6 SECTION 2: The City Council of the City of Vernon hereby 7 approves the "A Joint Resolution of the Board of Supervisors of the 8 County of Los Angeles, the City Councils of the City of Maywood and 9 the City of Vernon, the Redevelopment Agency of the City of Vernon 10 and the Greater Los Angeles County Vector Control District Approving 11 and Accepting the Negotiated Exchange of Property Tax Revenue 12 Resulting from Reorganization No. 1-96 (Parcels 1 and 2) Between the 13 cities of Maywood and Vernon," a copy of which has been submitted 14 concurrently herewith. 15 SECTION 3: The City Council of the City of Vernon hereby 16 authorizes the Mayor and the city Clerk to complete and execute said 17 Joint Resolution for, and on behalf of, the City of Vernon. 18 SECTION 4: The City Clerk of the City of Vernon shall send 19 the original signed Joint Resolution and seven (7) certified copies 20 thereof, along with a certified copy of this resolution, to June D. 21 Savala, Executive Assistant, Los Angeles County Local Agency 22 Formation Commission, 383 Kenneth Hahn Hall of Administration, 23 500 West Temple Street, Los Angeles, CA 90012. 24 III 25 III 26 III 27 III 28 III -2- . ~ 1 ".--.... LOS ANGELES COUNTY PUBLIC LIBRARY AND THE GREATER LOS ANGELES COUNTY VECTOR CONTROL DISTRICT) WHEREAS, the Cities of Mayvvood and Vernon on or about February 9, 1996, filed an application with the Los Angeles County Local Agency Formation Commission for approval of an exchange of parcels known as Reorganization No. 1-96 (Parcels 1 and 2) between the Cities of Mayvvood and Vernon; and WHEREAS. pursuant to Section 99 of the California Revenue and Taxation Code, prior to the effective date of any jurisdictional change, the governing bodies of all agencies whose service areas or service responsibilities would be altered by such change must determine the amount of property tax revenue to be exchanged between the affected agencies and approve and accept the negotiated exchange of property tax revenues by resolution, but if the affected agency is a special district, the Board of Supervisors must negotiate on behalf of the district; and WHEREAS, the Board of Supervisors of Los Angeles County, on behalf of the County of Los Angeles and the Consolidated Fire Protection District and the Los Angeles County Public Library, the Greater Los Angeles County Vector Control District, the City of Maywood, and the City of Vernon, hereinafter referred to as the "Agencies," have determined that the amount of property tax revenues to be exchanged between their respective agencies as a result of the "Reorganization No. 1-96 (Parcels 1 and 2)" between the Cities of Maywood and Vernon is as set forth below. NOW THEREFORE. BE IT RESOLVED AS FOllOWS: 1. The negotiated exchange of property tax revenues between the Agencies resulting from "Reorganization No. 1-96 (Parcels 1 and 2)" is approved and accepted. 2. For fiscal years commencing on and after July 1. 1997, or after the effective date of this jurisdictional change. whichever is later, there shall be a transfer of funds to the Agencies consistent with the provisions of Section 97.35 and 98 of the California Revenue and Taxation Code, as determined by the County Auditor-Controller. 3. PARCEL 1 - For fiscal years commencing on and after July 1, 1997, or after the effective date of this jurisdictional change, whichever is later, all property tax revenue received by: 1) the Consolidated Fire Protection District of Los Angeles County. 2) the Los Angeles County Public Library, 3) the Greater Los Angeles County Vector Control District, and 4) the City of Maywood attributable to the "Reorganization No. 1-96 (Parcel 1 )" shall be transferred to the County of Los Angeles. 4. PARCEL 1 - For fiscal years commencing on and after July 1, 1997, or after the effective date of this jurisdictional change. whichever is later, two hundred and four dollars ($204) in property tax revenue shall be transferred from the County of Los Angeles to the City of Vernon. In addition, for each fiscal year commencing on and after July 1, 1997, or after the effective date of this jurisdictional change, whichever is later. 7.8003681 percent of the incremental tax growth attributable to Parcel 1 area of the "Reorganization No. 1-96" shall be transferred from the County of Los Angeles to the City of Vernon and the County of Los Angeles' share of incremental tax growth shall be reduced accordingly. 5. PARCEL 2 - This parcel is currently exempt from ad valorem taxation, however, for fiscal years commencing on and after July 1, 1997. or after the effective date of this jurisdictional change, whichever is later, four hundred and thirty seven dollars ($437) in property tax revenue shall be transferred from the County of Los Angeles to the Consolidated Fire Protection District of Los Angeles County. In addition, for each fiscal year commencing on and after July 1, 1997, or after the effective date of this jurisdictional change, whichever is later, 14.6036153 percent of the incremental tax growth attributable to Parcel 2 area of the "Reorganization No. 1-96" shall be transferred from the County of Los Angeles to the Consolidated Fire Protection District of Los Angeles County and the County of Los Angeles' share of incremental tax growth shall be reduced accordingly. 6. PARCEL 2 - This parcel is currently exempt from ad valorem taxation, however, for fiscal years commencing on and after July 1, 1997, or after the effective date of this jurisdictional change, whichever is later, sixty dollars ($60) in property tax revenue shall be transferred from the County of Los Angeles to the Los Angeles County Public Library. In addition. for each fiscal year commencing on and after July 1, 1997, or after the effective date of this jurisdictional change, whichever is later, 1.9867448 percent of the incremental tax growth attributable to Parcel 2 area of the "Reorganization No. 1-96" shall be transferred from the County of Los Angeles to the Los Angeles County Public Library and the County of Los Angeles' share of incremental tax growth shall be reduced accordingly. 2 I. . 7. PARCEL 2 - This parcel is currently exempt from ad valorem taxation, however, for fiscal years commencing on and after July 1, 1997, or after the effective date of this jurisdictional change, whichever is later, 0.0307488 percent of the incremental tax growth attributable to Parcel 2 area of the "Reorganization No. 1-96" shall be transferred from the County of Los Angeles to the Greater Los Angeles County Vector Control District and the County of Los Angeles' share of incremental tax growth shall be reduced accordingly. 8. PARCEL 2 - This parcel is currently exempt from ad valorem taxation, however, for fiscal years commencing on and after July 1, 1997, or after the effective date of this jurisdictional change, whichever is later, all property tax revenue received by the City of Vemon attributable to the "Reorganization No. 1-96 (Parcel 2)" shall be transferred to the County of Los Angeles and the City of Vemon Taxing District #1's property tax shall be reduced accordingly. 9. PARCEL 2 - For fiscal years commencing on and after July 1, 1997, or after the effective date of this jurisdictional change, whichever is later, 6.8525693 percent of the incremental tax growth attributable to Parcel 2 area of the "Reorganization No. 1-96" shall be transferred from the County of Los Angeles to the City of Maywood and the County of Los Angeles' share of incremental tax growth shall be reduced accordingly. 10. The City of Vernon shall: 1) annex Parcel 1 to the Vernon Industrial Redevelopment Project Area 1, and 2) detach Parcel 2 from the Vernon Industrial Redevelopment Project Area 1 pursuant to the California Community Redevelopment Law, Health & Safety Code Sections 33000 et seq. 11. In the event that all or a portion of either Parcel 1 or Parcel 2 of the reorganization area is subsequently included within a redevelopment project pursuant to California Community Redevelopment Law (California Health & Safety Code Sections 33000 et seq.) the Cities of Maywood or Vernon shall not adopt the ordinance approving the redevelopment plan with respect to the reorganization area until such time as the respective redevelopment agencies of the cities have diligently and in good faith complied with all applicable provisions of the California Community Redevelopment Law, including but not limited to consultation with the County with respect to the plan and to the allocation of taxes, pursuant to Health & Safety Code Section 33670 or any other relevant provision of law. Any ordinance approving a redevelopment project that includes this annexed area and which does not comply with this paragraph shall be void and of no effect with regard to the subsequent allocation and distribution of taxes to the Redevelopment agency.
