Resolution No. 6955 " 1 RESOLUTION NO. 6955 2 5 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON ESTABLISHING HEALTH PERMIT, HAZARDOUS MATERIALS ESTABLISHMENT PERMIT, AND APPLICATION FEES FOR PERMITS GRANTED BY THE CITY OF VERNON PURSUANT TO SECTIONS 11.25, 13.7, 13.31, 13.53, 25.12, AND 25.13-6 OF THE VERNON CITY CODE AND REPEALING RESOLUTION NOS. 6354, 6618, AND 6619 3 4 6 7 WHEREAS, Sections 11.25, 13.7, 13.31, 25.12, and 25.13-6 8 of the Vernon City Code provide for the issuance of health permits 9 for various types of businesses, vehicles, facilities and uses; and 10 WHEREAS, Section 13.53 to the Code of the City of Vernon 11 provides for the issuance of permits for hazardous materials 12 establishments; and 13 WHEREAS, Sections 11.25, 13.8, 13.34, 13.55, and 25.12-4 14 of the Vernon City Code provide that the City Council of the City of 15 Vernon shall establish health permit fees, hazardous materials 16 establishment permit fees, and application fees therefor by 17 resolution; and 18 WHEREAS, the city council of the City of Vernon adopted 19 Resolution No. 6354 on November 23, 1993, Resolution No. 6618 on May 20 2, 1995, and Resolution No. 6619 on May 2, 1995, establishing health 21 permit fees, hazardous materials establishment permit fees, and 22 application fees in accordance with said Code; and 23 WHEREAS, fees established by said resolutions have been 24 determined to be inadequate; and 25 WHEREAS, the City Council of the City of Vernon intends to 26 establish new fees for such categories as set forth herein. 27 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE 28 CITY OF VERNON AS FOLLOWS: 1 SECTION 1: The City Council of the city of Vernon hereby 2 finds and determines that the recitals contained hereinabove are 3 true and correct. 4 SECTION 2: The City Council of the City of Vernon hereby 5 establishes the following issuance fees and annual renewal fees for 6 permits granted by the City of Vernon pursuant to Section 13.8 of 7 the Vernon City Code: 8 TYPE OF BUSINESS OR VEHICLE ANNUAL FEE $176 (or $61 per day) 9 (a) Caterer 10 (b) Cesspool and Sump Pumping Vehicle $126 basic business inspection fee and $67 per vehicle 11 12 (c) Commercial Agricultural Operation $114 13 (d) Food Processing Establishment (1) Less than 2,000 sq. ft. (2) 2,000 sq. ft. or more $274 $554 14 15 (e) Food Vending Machine Business $24 per machine 16 (f) Food Warehouse $213 17 18 (g) Garment Manufacturing Establishment To Amend Permit $131 (one time application fee) and $179 $45 19 20 (h) Laundry (including vehicles operating from the City of Vernon) $126 21 22 (i) Laundry Vehicle (independent and from outside the City of Vernon) $67 per vehicle 23 24 (j) Offal Vehicle $126 basic business inspection fee* and $67 per vehicle 25 28 (k) Rendering Plant (I) Restaurant (I) 0-30 seats (2) 31 seats and over $194 + $67 per vehicle 26 27 $213 $423 -2- : 1 (m) Retail Food Delivery Vehicle (N) Retail Food Preparation Vehicle $74 per vehicle 2 $213 (or $74 per day) 3 4 (0) Retail Food Production and Marketing Establishment $139 5 (p) Retail Fruit and Vegetable Vehicle $74 per vehicle 6 (q) Retail Packaged Food Vehicle $139 (or $44 per day) 7 (r) Waste Disposal Business $126 basic business inspection fee and $67 per vehicle 8 9 (s) Waste Disposal site (t) Waste Processing Facility (u) Waste Transfer station (v) Water Supply utility (w) Wiping Rag Business $126 $126 $126 10 11 12 $5.00 per service 13 $131 (one time) 14 $179 annual 15 *The $126 basic business inspection fee does not apply to 16 a company operating offal vehicle(s) in conjunction with, and as a 17 part of, a Vernon permitted Rendering Plant or Food Processing 18 Establishment. 19 SECTION 3: The City Council of the City of Vernon hereby 20 establishes the following issuance fees and annual renewal fees for 21 health permit inspections granted by the City of Vernon pursuant to 22 section 11.25 of the Vernon City Code: 23 TYPE OF BUSINESS OR VEHICLE ANNUAL FEE 24 (a) Wholesale Food Vehicle $ 39 per vehicle 25 SECTION 4: The city Council of the City of Vernon hereby 26 establishes the following issuance fees and annual renewal fees for 27 permits granted by the City of Vernon pursuant to section 13.34 of 28 the Vernon City Code: - 3 - .. 1 ANNUAL FEE TYPE OF BUSINESS OR VEHICLE 2 (a) Underground Hazardous Substances Storage Facility (b) Annual Tank Operating Permit $266 for five (5) years 3 4 $60 per tank (not to exceed $300 per facility) 5 (c) Transfer of Operating Permit $88 6 7 (d) Amendment to an Operating Permit $45 SECTION 5: The City Council of the City of Vernon hereby 8 9 establishes the following permit and application fees for hazardous materials establishments pursuant to section 13.55 of the Code of the City of Vernon: 10 11 DESCRIPTION FEE $254 12 13 APPLICATION FEE (one time): PERMIT FEE (initial and renewal): 14 $ 84 Class A: 15 Handling of less than 100 kilograms (220 lbs) of hazardous materials per month; or less than 1 kilogram (2.2 lbs) of extremely hazardous waste per month. 16 17 18 Class B: $254 19 Handling of 100 kilograms (220 lbs) to 1,000 kilograms (2,200 Ibs) of hazardous materials per month; or 1 kilogram (2.2 Ibs) to 10 kilograms (22 Ibs) of extremely hazardous waste per month. 20 21 $422 Class C: 22 Handling of over 1,000 kilograms(2,220 Ibs) of hazardous materials per month; or over 10 kilograms (22 lbs) of extremely hazardous waste per month. 23 24 25 TO AMEND PERMIT: $ 45 $254 26 CERTIFICATE OF CLOSURE 27 For the purpose of determining the above fees, 1 gallon 28 (3.79 liters) of liquid shall be equivalent to 7 pounds (3.18 - 4 - .. 1 kilograms). 2 Establishments which have hazardous substances stored in 3 underground storage tanks, for which a valid operating permit has 4 been issued by the City of Vernon, shall be exempt from including 5 the volume of the underground storage capacity when determining the 6 permit fee classification for a hazardous materials establishment. 7 SECTION 6: The City Council of the City of Vernon hereby 8 establishes the following application fees, fee for filing an 9 appeal, and fee to amend a well permit granted by the City of Vernon 10 pursuant to section 25.12-4 of the Vernon City Code: 11 TYPE OF BUSINESS OR VEHICLE ANNUAL FEE 12 (a) Drilling a water well or destroying or converting an existing water well $175 13 14 (b) Drilling a monitoring well (ground water) (c) Filing an appeal (d) Amendment to a well permit $105 $ 70 $ 45 15 16 17 SECTION 7: Delinquent fees shall be subject to the 18 penalties set forth in Vernon City Code sections 13.15, 13.34, 19 20 13.55(b), or 25.12-1, as applicable. SECTION 8: In addition to the foregoing, the licensee or 21 22 permittee shall pay all other necessary fees or deposits which may be required by other ordinances or resolutions of the City of Vernon or applicable State law. IN THE COUNCIL CHAMBERS OF THE CITY HALL LOCATED AT 4305 SANTA FE AVENUE, VERNON, CALIFORNIA MEMBERS PRESENT: Malburg, Ybarra, Gonzales MEMBERS ABSENT: None The meeting was called to order by Chairman Malburg. It was moved by Gonzales, seconded by Ybarra, that the Minutes of the Adjourned Regular Finance Committee Meeting held April 14, 1997, be approved as submitted and adopted. Motion carried. Communication from Bruce V. Malkenhorst, Director of Finance, dated April 17, 1997, was presented, advising that the Fire Department is requesting to purchase 20 voice amplifiers to be used with self-contained breathing apparatus in order to provide clear voice communication for personnel using the breathing apparatus during fire activities. This equipment will increase safety and is recommended by the National Fire Protection Association. This was included in the budget, and it is hereby recommended that approval be granted for the purchase of 20 amplifiers at a cost of approximately $3,600. It was moved by Ybarra, seconded by Gonzales, that recommendation be made to City Council to approve the purchase of 20 voice amplifiers for the Fire Department at a cost of approximately $3,600. Motion carried. Consideration and discussion of sending an additional staff person from the Police Department to attend a Polygraph Examiner Training Course in San Diego. This is a seven week course (from September 8 thru October 24, 1997) which includes all class materials and printed matter. This is included in their proposed budget. It was moved by Gonzales, seconded by Ybarra, that recommendation be made to City Council to grant authority for Sgt. James Rodino to attend the aforementioned course with an expense allowance of $7,416.09 which includes tuition, lodging, and meals. Motion carried. Communication from Bruce V. Malkenhorst, Director of Finance, dated April 30, 1997, was presented, transmitting for review and acceptance the City of Vernon Report of Cash and Investments for Quarter ended March 31, 1997, in accordance with Section VI of the Amended Investment Policy adopted February 18, 1997. Also in accordance with said policy the "report" was transmitted to all members of the legislative body on April 30th. It was moved by Ybarra, seconded by Gonzales, to accept the City of Vernon Report of Cash and Investments for Quarter ended March 31, 1997. Motion carried. Communication from Bruce V. Malkenhorst, Director of Finance, dated May 7, 1997, was presented, transmitting results of a survey of local health jurisdictions conducted by the Health Department with regard to Health Permit Fees. The City has not adjusted its health permit fees since June, 1995. This has been reviewed by the Director of Environmental Health, and it is hereby recommended that approval be granted to increase all Health Permit Fees 5% effective June 1, 1997.
