RESOLUTION NO. 6957

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF VERNON APPROVING AND AUTHORIZING THE
EXECUTION OF AN AMENDMENT TO LIABILITY SELF-
INSURANCE AGREEMENT BY AND BETWEEN THE CITY OF
VERNON AND COLEN AND LEE, INC.

WHEREAS, the City Council of the City of Vernon by
Resolution no. 5320 on September 16, 1986, authorized a Liability
6

Self-Insurance Agreement with Colen and Lee, Inc. for the
8
administration of a general and auto liability self-insurance
9
program; and
10
WHEREAS, by Resolution 6172 on October 20, 1992, the
City Council approved an amendment to said Service Agreement
11
12
increasing the monthly fees for subsequent fiscal years; and
13
WHEREAS, Colen and Lee, Inc. has proposed an amendment
14
to the Service Agreement reflecting an increase from $650.00 to
$750.00 per month for the coming fiscal year; and
WHEREAS, Bruce V. Malkenhorst, City Administrator, has
15

recommended that said increase be approved as being fair and
18
reasonable, and that Colen and Lee, Inc. continue to administer
19
the program for the City of Vernon; and
20
WHEREAS, the Finance Committee approved said increase on
21
May 13, 1997 as being fair and reasonable.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
23
THE CITY OF VERNON AS FOLLOWS:

SECTION 1: The City Council of the City of Vernon
25 hereby finds and determines that the recitals contained
26 hereinabove are true and correct.

SECTION 2: The City Council of the city of Vernon
28 hereby approves the Amendment to Liability Self-Insurance

1 Agreement, a copy of which has been presented to the City Council
2 concurrently with this resolution, and the City council hereby
3 orders said Amendment to be received and filed by the City Clerk.

SECTION 3: The city council of the City of Vernon
5 hereby authorizes the Mayor and the City Clerk to execute said
6 Amendment for, and on behalf of, the City of Vernon.
7
SECTION 4: The City Clerk of the City of Vernon shall
8 certify to the passage of this resolution, and thereupon and
9 thereafter the same shall be in full force and effect.
10 APPROVED AND ADOPTED this 20th day of May, 1997.

AMENDMENT TO
LIABILITY SELF-INSURANCE
SERVICE AGREEMENT
This AGREEMENT is entered into this 20th day of May 1997 between the
CITY OF VERNON, hereinafter referred to as the "City," and COLEN AND LEE,
INC., a referred to as the "Administrator."
WHEREAS, the City and the Administrator entered into an Agreement,
hereinafter referred to as the "Original Agreement", on October 1, 1986 for
administration of the City's General and Auto Liability Self-Insurance Program;
and
WHEREAS, the City and the Administrator desire to extend and amend the
Original Agreement;
NOW, THEREFORE, in consideration of the mutual convenants herein
contained, the City and the Administrator do hereby extend and amend the
Original and Amended Agreements as follows:
1. CONSIDERATION: Section 9 of the Original Agreement is hereby
amended to read: The City shall pay $750.00 per month for ongoing services

rendered under this Agreement. Once a year thereafter, the Administrator may
increase or decrease the service fee by giving written notice of the change to the
City at least sixty (60) days prior to change.
2. ORIGINAL AGREEMENT: Except as specifically amended herein,
the terms and conditions of the Original Agreement shall remain in full force and
effect.
