A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON AGREEING TO MUTUALLY TERMINATE THE
ELECTRICAL SERVICE AGREEMENT BY AND BETWEEN THE
CITY OF VERNON AND CLOUGHERTY PACKING COMPANY

WHEREAS, the City council of the City of Vernon by
Resolution No. 6899 adopted on December 17, 1996, approved and
7

authorized the execution of an Electrical Service Agreement
9
("Agreement") with Clougherty Packing Company ("Farmer John"); and
10
WHEREAS, said Agreement was executed on December 26,
11
1996; and
12
WHEREAS, since the execution of said Agreement, Farmer
13
John and the City have been assessing future electrical
14
requirements; and
15
WHEREAS, both Farmer John and the City of Vernon desire
to mutually agree to terminate the Agreement while Farmer John
16
17
continues to assess their future electrical needs; and
18
WHEREAS, negotiations for another agreement will be
19
conducted once Farmer John's assessment is complete.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:

SECTION 1: The City Council of the City of Vernon does
23
hereby find and determine that the recitals contained hereinabove
24
are true and correct.
25
SECTION 2: The City Council of the City of Vernon hereby
26
agrees to the mutual termination of the Electrical Service
27
Agreement dated December 26, 1996.

SECTION 3: The City Council of the City of Vernon hereby

1 directs the City Clerk to send a copy of this resolution to
2 Bernard J. Clougherty, Clougherty Packing Company, 3049 E. Vernon
3 Avenue, Vernon, CA 90058.

SECTION 4: The City Clerk of the city of Vernon shall
5 certify to the passage of this resolution and thereupon and
6 thereafter the same shall be in full force and effect.
