A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON APPROVING AND AUTHORIZING THE EXECUTION
OF AN ADDENDUM TO THE AGREEMENT FOR
PROFESSIONAL SERVICES (CITY OFFICE ADDITION) AS
AMENDED BY AND BETWEEN THE CITY OF VERNON AND
BOYLE ENGINEERING CORPORATION PERTAINING TO THE
REDESIGN OF CITY HALL FACILITIES FOR ADA

WHEREAS, by Resolution No. 6331 on October 5, 1993, the

Corporation for Professional Services (City Offices Addition) to

perform the Programming Phase; and

WHEREAS, the ci ty Council amended said Agreement by
Resolution No. 6565 on December 20, 1994 (Amendment No.1), by

Resolution No. 6698 on October 17, 1995 (Amendment No.2), by
Resolution No. 6759 on March 26, 1996 (Amendment No. 3 which also
14
repealed Amendment No.2), and by Resolution No. 6881 on November 5,
15

1996 (Addendum to Amendment No.3); and
WHEREAS, the City of vernon needs architectural and
17
engineering services to design renovations in order to bring City
18
Hall facilities into compliance with the Americans with Disabilities
19
Act (ADA); and
20
21
WHEREAS, at the request of the city, Boyle Engineering
Corporation has submi tted a proposal for an addendum to said
Agreement as amended for additional services as described in the
22

letter dated April 7, 1997, for "Additional Services for ADA/
Title 24 Accessibility Compliance at Basement, 1st and 3rd Floors,
City Hall Renovation and Expansion Project" to which is attached a

Task Exhibit for "Engineering Services Estimate - ADA Compliance

Bsmt, 1st & 3rd Floor "; and

WHEREAS, Kevin Wilson, Director of Community Services, has

recOmmended that the City Council approve said addendum to the

Agreement at a lump sum cost of Ten Thousand Three Hundred Forty-
five Dollars and No Cents ($10,345.00) as set forth therein.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:

SECTION 1: The City Council of the City of Vernon hereby
8 finds and determines that the recitals contained hereinabove are
9 true and correct.

SECTION 2: The City Council of the City of Vernon hereby
11 approves said Addendum for additional services under the Agreement
12 for Professional Services (City Offices Addition), a copy of which
13 Addendum has been presented to the City Council concurrently with
14 this resolution, and the City Council hereby orders said Addendum to
15 be received and filed by the City Clerk.

SECTION 3: The City Council of the City of Vernon hereby
17 authorizes the Mayor and the City Clerk to execute said Addendum
18 for, and on behalf of, the City of Vernon.
19
SECTION 4: The City Clerk of the City of Vernon shall
20 certify to the passage of this Resolution, and thereupon and
21
thereafter the same shall be in full force and effect.

Enclosed is the Task Exhibit for design and drafting work required to provide modifications
described by the memorandum dated Apri125, 1997, attached. The engineering services for the
tasks involved are considered additional services to the existing contract dated April 9, 1996,
with the City of Vernon.
The fee for providing these services is based upon Boyle's standard time and materials rates.
The total not-to-exceed amount is $4,966.

Honorable Members:
The City previously approved an agreement with Boyle Engineering for
Professional Services. (City Office Addition) which included retrofit
work on the Warehouse which sustained severe earthquake damage. Boyle
has reviewed the structural integrity of the warehouse building and
determined that the roof is not capable of withstanding. the additional
loads required by the retrofit. Additional engineering work is
required.
This has been reviewed by the Director of Community Services and the
City Attorney, and it is hereby recommended that approval be granted
for Boyle Engineering to perform the additional engineering work at a
cost not to exceed $4,996.

SUBJECT: WAREHOUSE
Boyle Engineering has reviewed the structural integrity of
the Warehouse. The situation is far worse than expected. As you
are aware the Warehouse suffered damage in the last earthquake.
Several columns sustained severe cracks. In the interim the City
has installed large wooded posts to help support the roof
structure.
It was our assumption that if the roof were tied to the
wall, that the loads could be transferred to the entire pane l
through the roof structure. Unfortunately the roof structure is
under designed and extensive work is necessary. The agreement
for the Engineering of the retrofit work did not include this
additional work.. Therefore it is recommended that Boyle
Engineering's contract be amended to include this. additional work
at a cost not to exceed $4,996.

SUBJECT:
In a telephone conversation on April. 23, 1997 with Mr. Richard Lucas, I brought to his
attention the findings of my structural design of the warehouse retrofit. Referencing the Scope
of Services I noted that we specifically indicate the. wall panels will be attached to: the roof
structure to enhance the stability of the building in a seismic event and will not necessarily be
designed to the 1444 UBC. However in the design it was determined the roof structure only
has appraximateiy half of the capacity needed to resist the seismic:. loads. Since retrofit design
of the. roof deck is beyond the scope. of work, I was requesting direction from Richard__ Ri.chard_
then indicated that I prepare a task exhibit to identify the out of scope services.:
Qn the warehouse building the magnitudeof design forces exceed the capacity of the plywood
-roof structure as it is currently constructed. The tiltup wall panels can be attached to .the roof,
- ~ however the roof cannot transfer the loads to theend walls. Several options are available to
modify the structure to obtain the required transfer: of seismic loads.
1, Remove a portion of-the existing roof deck and replace the plywood and joists with larger
elements. The balance of the roof would require additional nailing to meet the requirements.
This option would require the roof membrane to be completely removed and re~Iaced.
2. Provide new interior braced frames or shearwalls at locations to allow the existing roof
deck nailing to work as presently constructed. This option could interfere with the operations
of the facility.
3. Provide new exterior buttresses at the column locations to provide the required resistance.
My recommendation is to proceed with option 1 to upgrade the facility to transfer the seismic
loads to the shearwalls.
At presen# the project is on hold until we receive direction and the notice to
proceed.

RE: Change Order No. 5 -Increase Size of Steel Rods for Retrofit of
Warehouse
Attached is Change Order No. 5 to provide for the increase in size of certain steel rods for
the retrofit of the warehouse building. The increased rod sizes will match the clevis sizes
per the manufacturer's recommendation.
The cost for this modification is $2,881.00. Boyle Engineering Corporation has reviewed
the cost for the work and has determined it to be reasonable.. It is recommended that you
authorize the Department to proceed with this change order work.

Victor Opincar communicated to me that it is his understanding
that the contract for the construction of the City Hall Annex
ended October 28, 2000, and that you have cited Amendment No.3
which states that the construction and administration phase
terminates when the final certificate of payment to the
contractor is issued and that you told him they are responsible
until such time.
Please advise me why we have this difference of opinion.

completion date. Mr. Opincar has conversed. with the City Manager with regards to this project
from its inception.

Enclosed is the Task Exhibit for design and drafting work required to provide modifications for
disabled access in the existing City Hall building. The scope has been defined by the attached
"Transition Plan -Americans with Disabilities Act Evaluation" provided by the-City of Vernon.
The engineering services for the tasks involved are considered additional services to the existing
contract dated April 9, 1996, with the City of Vernon.

Honorable Members:
The first floor of City Hall (police station) has not yet been retro-
fitted to comply with the Americans with D~abi3it~s Act. The City
currently has an agreement with Boyle Engineering which can be amended
to provide architectural services to redesign the restrooms, counters,
etc. for ADA compliance at a cost of $10,345.
This has been reviewed by the Director of Community Services and the
City Attorney, and it is hereby recommended that the agreement with
Boyle Engineering be amended to provide said archite~'izrai`se~vices at
a cost not to exceed $10,345.

SUBJECT: AMERICANS WITH DISABILITIES ACT
The Americans with Disabilities Act requires all public.
buildings to be retrofitted to accommodate disabled individuals.
With the recent construction of the third floor and the total
proposed remodeling of the second floor. of the City Hall, this
leaves .only the Police Station out of compliance. Joan Francone
has stated that there may be some benefits in our insurance rates
if the City is in compliance with-the regulations..
Due to these factors, it is recommended that Boyle
Engineering have their agreement amended so that they may provide
the Architectural Services to redesign the restrooms, counters,
etc. to meet ADA compliance. Construction would take place some
time in the future. Boyle Engineering has given me a cost of
$10,345.00 to provide these services.
If you foresee any further architectural services on the
first floor, such as in the Library, or old City Attorney's
offices, then this would be the time to either include those
services in their contract at an additional cost, or wait on the
ADA Architectural services until we have a firm idea of what we
want to do on that floor., Either way, the restrooms on the first
floor serve our .City Council Chambers and they should be made
disabled accessible as soon as possible.
Therefore it is recommended that Boyle. Engineers contract be
amended to provide ADA Architectural services for the Police
Station at a cost not to exceed $10,345.00.
