Resolution No. 6970 1 2 3 4 5 RESOLUTION NO. 6970 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON GRANTING A CONDITIONAL USE PERMIT TO REFRIGERATE TRANSPORT SERVICE FOR THE OPERATION OF A FREIGHT TERMINAL AT 4423 HAWTHORNE AVENUE 6 WHEREAS, Refrigerate Transport Service has applied 7 for a conditional use permit to operate a freight terminal 8 at 4423 Hawthorne Avenue in the City of Vernon; and 9 WHEREAS, the City Council of the City of Vernon 10 held a hearing on said application for a conditional use 11 permit on June 17, 1997; and 12 WHEREAS, the site is a nonconforming use in the 13 General Industrial (M) Zone which has been continuously used 14 as a freight terminal previously operated by Jons Markets 15 and which requires a conditional use permit under the Zoning 16 Ordinance in order to qualify for a new occupancy permit 17 pursuant to Vernon City Code Section 26.2.5-11; and 18 WHEREAS, the proposed operation will use the 19 property as a freight terminal for approximately 15 trailers 20 and tractors; and . 21 WHEREAS, the site is approximately 1.01 acres in 22 size, contains one building, and the size, shape, topography 23 and drainage of the parcel are adequate for the proposed 24 operations; and 25 WHEREAS, a barrier wall or landscaping will be 26 installed and maintained where parking or maneuvering areas 27 adjoin a public street pursuant to the Vernon City Code; and 28 WHEREAS, the site is surrounded by industrial uses 1 compatible with the proposed use and no adverse effect from 2 traffic, parking, noise, odors, dust, smoke, light or glare, 3 or risk of fire, infection or explosion is anticipated from 4 the proposed operation; and 5 WHEREAS, the site has access to Hawthorne Avenue 6 and in general traffic will travel north on Hawthorne Avenue 7 to Vernon Avenue, west or east to Alameda Street or Santa Fe 8 Avenue and north to freeway access; and the streets to be 9 utilized within the City of Vernon are sufficient to handle 10 the traffic generated from the proposed operation; and 11 WHEREAS, the site is required to have adequate off 12 street parking and loading facilities in accordance with the 13 Vernon City Code; and 14 WHEREAS, the conditions imposed on the conditional 15 use permit will adequately protect the public health, safety 16 and general welfare and the operation is consistent with all 17 applicable rules and laws of the City of Vernon; and 18 WHEREAS, the proposed use as to location, 19 operation and design is consistent with the General Plan and 20 the Zoning Ordinance of the City of Vernon; and 21 WHEREAS, the project was found to be categorically 22 exempt from the California Environmental Quality Act as an 23 existing facility pursuant to Section 15301 of the 24 California Environmental Quality Act Guidelines and a Notice 25 of Exemption shall be filed with the County Clerk pursuant 26 to Section 15062 of the California Environmental Quality Act 27 Guidelines. 28 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL -2- 1 OF THE CITY OF VERNON AS FOLLOWS: 2 SECTION 1: The City Council of the City of Vernon 3 hereby finds and determines that the recitals contained 4 hereinabove are true and correct. 5 SEC~~ON 2r Subject to the conditions set forth 6 below, the conditional use permit is granted to Refrigerate 7 Transport Service for the operation of a freight terminal at 8 4423 Hawthorne Avenue. 9 SECTION 3: In order to adequately protect the 10 public health, safety and general welfare the following 11 conditions are imposed: 12 a. The facility shall be operated in accordance 13 with all current codes, rules, regulations and subject to 14 permit fees as adopted by the City of Vernon. All trucking 15 operations, including truck and trailer parking, shall be 16 limited to the lot located at 4423 Hawthorne Avenue in the 17 Ci ty of Vernon. 18 b. All required federal, state, local and 19 regulatory agency permits shall be obtained prior to 20 operation. Prior to occupancy a business license and 21 occupancy permit shall be obtained. 22 c. All parking and loading facilities shall be 23 paved and maintained with a hard durable surface material 24 and shall be adequately drained, and kept free of dust, mud, 25 trash and weeds. Where parking or maneuvering areas adjoin 26 the public street a barrier wall or landscaping shall be 27 installed and maintained to meet City standards. 28 d. All existing cracked sidewalk, curb and gutter -3- 1 adjacent to the site on Hawthorne Avenue shall be repaired 2 and maintained to meet City standards. 3 e. No equipment or freight shall be stored on the 4 site, other than in buildings, trailers or on the docks. 5 f. Servicing of vehicles including washing, steam 6 cleaning, repairing and maintenance shall be performed in 7 facilities in compliance with appropriate codes. 8 g. The facility shall be operated in a manner which 9 will not impede traffic on Hawthorne Avenue. 10 h. A National Pollutant Discharge Elimination 11 System Permit shall be obtained from the California State 12 Board of Water Resources. 13 i. The facility shall be in compliance with all 14 Health Department rules and regulations and all required 15 Health Department permits shall be obtained. 16 j. A hazardous materials inventory and 17 business/contingency plans shall be submitted and a 18 hazardous materials permit shall be obtained from the City 19 of Vernon Health Department. Hazardous materials/wastes 20 shall be handled and managed in compliance with all 21 appropriate federal, state and local laws. 22 k. Adequate plans and materials must be available 23 for handling leaks or spills from vehicles during storage or 24 transportation. 25 1. The facility shall be operated in a manner 26 that will prevent unsanitary conditions, odors or other 27 nuisances. The property shall be provided with adequate 28 refuse containers and disposal service. -4- 1 m. AFo1 Response to the Received Written Comment from peit Electric Company Regarding the Conditional Use per.mit Application from Refrigerate Transport Service 4423 Hawthorne Avenue A written comment was received from Feit Electric Company regarding the conditional use permit application from Refrigerate Transport Service to operate a freight terminal at 4423 Hawthorne Avenue. Mr. Feit is concerned with the effect this operation may have on the traffic on Hawthorne Avenue. Mr. Feit based this concern on the traffic problems he has encountered from the operation that is currently operating at this facility. While traffic problems caused by the operation is of concern to the City, the Department of Community Services is of the opinion that the proposed operation will not have an adverse effect on the traffic on Hawthorne Avenue. In order to address this issue, a condition. was placed upon the permit which stated: "The facility shall be operated in a manner which will not impede traffic on Hawthorne Avenue." In addition, the proposed operation is of a much smaller nature than the operation that currently occupies the facility. The proposed operation owns less than ten trucks which will access the facility, all of which are approximately 45 feet or less in length. Outside operators will be accessing the facility, however, this will only account for approximately 5 additional truck trips per day. The proposed operation will be generating far less traffic than is generated by the current operation. @ ENGINEER'S REPORT REFRIGERATE TRANSPORT SERVICE CONDITIONAL USE PERMIT TO OPERATE A .FREIGHT TERMINAL AT 4423 HAWTHORNE AVENUE (June 10, 1997) Refrigerate Transport Service has applied for a conditional use permit to operate a freight terminal at 4423 Hawthorne Avenue in the City of Vernon. Refrigerate Transport Service is a trucking company which distributes wholesale produce. 1. GENERAL PLAN The proposed use is a grandfathered nonconforming use. The site has been continuously used as a freight terminal. 2. ~ The site is approximately 1.10 acres in size and contains one building. The size, shape, topography and drainage of the parcel are adequate for the proposed operation. 3. ADVERSE AFFECT The site is surrounded by industrial uses compatible with the proposed use and no adverse noise, odor, dust, smoke, light or glare, or risk of fire, infection or explosion is anticipated from the proposed operation. 4. ACCESS The site has access to Hawthorne Avenue. The street is of adequate size to handle the traffic generated from the proposed operation. 5. TRUCK MOVEMENTS Refrigerate Transport Service will operate approximately 9 trucks at the facility which will be dispatched from this site to make deliveries to customers. Approximately 5 outside haulers will access the site daily. 1 There will be 12 employees at the site. 6. STATE OR FEDERAL CONDITIONS There are no conditions imposed by State or Federal law. 7. CONDITIONS It is recommended that the following conditions be set on the permit to adequately protect the public interests: a. The facility shall be operated in accordance with all current codes, rules, regulations and subject to permit fees as adopted by the City of Vernon. All trucking operations, including truck and trailer parking, shall be limited to the lot located at 4423 Hawthorne Avenue in the City of Vernon. b. All required federal, state, local and regulatory agency permits shall be obtained prior to operation. Prior to occupancy a business license and occupancy permit shall be obtained. c. All parking and loading facilities shall be paved and maintained with a hard durable surface material and shall be adequately drained, and kept free of dust, mud, trash and weeds. Where parking or maneuvering areas adjoin the public street a barrier wall or landscaping shall be installed and maintained to meet City standards. d. All existing cracked sidewalk, curb and gutter adjacent to the site on Hawthorne Avenue shall be repaired and maintained to meet City standards. e. No equipment or freight shall be stored on the site, other than in buildings, trailers or on the docks. f. Servicing of vehicles including washing, steam cleaning, 2 repairing and maintenance shall be performed in facilities in compliance with appropriate codes. g. The facility shall be operated in a manner which will not impede traffic on Hawthorne Avenue. h. A National Pollutant Discharge Elimination System Permit shall be obtained from the California State Board of Water Resources. i. The facility shall be in compliance with all Health Department rules and regulations and all required Health Department permits shall be obtained. j. A hazardous materials inventory and business/contingency plans shall be submitted and a hazardous materials permit shall be obtained from the City of Vernon Health Department. Hazardous materials/wastes shall be handled and managed in compliance with all appropriate federal, state and local laws. k. Adequate plans and materials must be available for handling leaks or spills from vehicles during storage or transportation. 1. The facility shall be operated in a manner that will prevent unsanitary conditions, odors or other nuisances. The property shall be provided with adequate refuse containers and disposal service. m.
