A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF VERNON CERTIFYING THAT THE COUNCIL HAS
REVIEWED AND CONSIDERED THE FINAL
ENVIRONMENTAL IMPACT REPORT FOR THE U.S.
FILTER CONDITIONAL USE PERMIT FOR A HAZARDOUS
WASTE TREATMENT FACILITY AND ADOPTING CERTAIN
FINDINGS, A STATEMENT OF OVERRIDING
CONSIDERATIONS AND A MITIGATION MONITORING
PLAN IN CONNECTION THEREWITH

8 WHEREAS, the City of Vernon has received an application
9 for a conditional use permit from U.S. Filter Recovery Services
10 (California), Inc. ("U.S. Filter"), to operate, maintain, and
11 expand a hazardous waste treatment facility at 5375 Boyle Avenue
12 in the City of Vernon; and
13 WHEREAS, U.S. Filter has leased the facility and has
14 assumed from Norris Environmental Service the application for a
15 license from the State of California for such facility; and
16 WHEREAS, a Final Environmental Impact Report ("FEIR")
17 for the proposed expansion was prepared by the California
18 Department of Toxic Substances Control (DTSC) as the lead agency
19 in compliance with CEQA guidelines, public hearings were conducted
20 by the lead agency, and the FEIR was certified by the lead agency
21 on August 30, 1996; and
22 WHEREAS, the City of Vernon was notified of the project
23 and was provided with an opportunity to make comments on the draft
24 EIR; and
25 WHEREAS, the City of Vernon, as a Responsible Agency
26 under CEQA, is required to consider the FEIR before reaching a
27 decision on the project and make certain findings relative
28 thereto; and
1 WHEREAS, a separate document entitled "Statement of
2 Findings, Overriding Considerations and Mitigation Monitoring Plan
3 for the Norris Environmental Services Hazardous Waste Facility
4 Application Environmental Impact Report" ("Statement") dated
5 August 1996 has been prepared and approved by the DTSC; and
6 WHEREAS, copies of the FEIR and Statement have been
7 received by the City and have been submitted to the City Council
8 in connection with the hearing in this matter; and
9 WHEREAS, the conditional use permit for u.S. Filter
10 contains conditions which are part of the mitigation plan for the
11 project or which will additionally mitigate the environmental
12 impacts of the project.
13 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
14 THE CITY OF VERNON AS FOLLOWS:
15 SECTION 1: The City council of the City of Vernon
16 hereby finds and determines that the recitals contained
17 hereinabove are true and correct.
18 SECTION 2: The City council of the City of Vernon
19 hereby certifies that it has reviewed and considered the
20 information contained in the FEIR.
21 SECTION 3: The City Council further approves and adopts
22 the Statement, which is incorporated herein by this reference, as
23 its own Statement of Findings and Statement of Overriding
24 Considerations in this matter, and approves and adopts the
25 Mitigation Monitoring Plan contained therein.
26 SECTION 4: The City Council hereby orders the FEIR and
27 Statement to be received and filed by the City Clerk.

SECTION 5: The City Clerk of the City of Vernon shall
2 certify to the passage of this resolution, and thereupon and
3 thereafter the same shall be in full force and effect.

Project Description:
u.s. Filter has applied for a conditional use permit to expand and operate a
hazardous waste treatment facility previously operated by Ni industries at 5375 Boyle
Avenue in the City'of Vernon. An Environmental impact Report was performed for the
California Environmental Protection Agency Department of Toxic and Substances Control
in accordance with the California Environmental Quality Act as part of Norris
Environmental Services' permit application.
This is to advise that the City of Vernon has approved the above described project on August 5, 1997 and has made the
following determinations regarding the above described project:
1. The project will have a significant effect on the environment.
2. An Environmental Impact Report was prepared for this project pursuant to the provisions of CEQA.
3. Mitigation measures were not made a condition of the approval of this project.
4. A statement of Overriding Considerations was adopted for this project.
5. Findings were made pursuant to the provisions of CEQA.
