A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON APPROVING AND AUTHORIZING THE EXECUTION
OF AN AMENDMENT TO THE CITY ATTORNEY EMPLOYMENT
AGREEMENT ESTABLISHING COMPENSATION FOR DAVID B.
BREARLEY AS CITY ATTORNEY

WHEREAS, DAVID B. BREARLEY, has served as the City
6
Attorney for the City of Vernon since July I, 1977; and
7
WHEREAS, the City Council of the city of Vernon approved
a new City Attorney Employment Agreement for city attorney
8
9
services pursuant to Resolution No. 5298 on June 26, 1986; and
10
WHEREAS, the City Council of the City of Vernon approved
an amendment to the City Attorney Employment Agreement pursuant to
11
12
Resolution No. 6815 on June 27, 1996; and
13
WHEREAS, Section 5 of said Agreement provides, in part,
14
as follows:

II . .city and Brearley further agree to
negotiate increases in the hourly rates provided
for herein from time to time. . .with merit
performance to be considered in said
negotiations. .. II

WHEREAS, the City council of the City of Vernon adopted
Resolution No. 6815 on June 27, 1996, establishing the following

compensation for city attorney services effective July I, 1996:

(a)
(b)
A retainer salary of $20,878.00 per month;
23
A fee for legal services of $165.00 per hour for
24
every hour of legal services provided in each month
in excess of 115 hours up to a maximum of 300
25
26
hours; and
( c)
A fee for legal services of $189.00 per hour for
27
all hours of legal services provided in each month

in excess of 300 hours per month; and

WHEREAS, pursuant to section 5 of the Employment
3 Agreement, the City council of the City of Vernon, having
4 participated in negotiations with the City Attorney, intends to
5 adjust the compensation for the City Attorney effective July 1,
6 1997.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
8 CITY OF VERNON AS FOLLOWS:

SECTION 1: The city Council of the city of Vernon does
10 hereby find and determine that the recitals contained hereinabove
11 are true and correct.

SECTION 2: The City Council of the City of Vernon hereby
13 approves the Amendment to the city Attorney Employment Agreement
14 effective July 1, 1997, a copy of which has been presented to the
15 City Council concurrently with this resolution and the City
16 Council hereby orders said Amendment be received and filed by the
17 City Clerk.

SECTION 3: The City Council of the City of Vernon hereby
19 authorizes the Mayor and the City Clerk to execute said Amendment
20 for, and on behalf of, the City of Vernon.
21
SECTION 4: The city Clerk of the City of Vernon shall
22 certify to the passage of this resolution and thereupon and
23 thereafter the same shall be in full force and effect.
