A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON APPROVING A LOT LINE
ADJUSTMENT REQUESTED BY WEST SOTO STREET
PARTNERS AND LORETTA.DODD TRUST
WHEREAS, West Soto Street Partners is the owner of a

parcel of land (parcel A) located at 2730 and 2750 37th Street

in the City of Vernon, and Loretta Dodd Trust is the owner of a
parcel of land (parcel B) located at 3883 and 3855 Soto Street
8
in the City qf Vernon, all as described and shown on the
9

attached Exhibit "A" and Figure "A" consisting of three (3)
pages which are incorporated herein by this reference as though
fully set forth at length; and

WHEREAS, West Soto Street Partners and Loretta Dodd
14 Trust desire to adjust the common boundary between the two
15 parcels whereby said adjustment will create two new properties
16

as described and shown on the attached Exhibit "B" and Figure
"B", consisting of three (3) pages which are incorporated
herein by this reference as though fully set forth at length;
and

WHEREAS, West Soto Street Partners and Loretta Dodd
Trust have applied for a Lot Line Adjustment pursuant to
Government Code Section 66412(d) of the Subdivision Map Act,
which provides an exemption from the SUbdivision Map Act
requirements as follows:

A lot line adjustment between two or
more existing adjacent parcels, where the land taken

from one parcel is added to an adjacent parcel, and
where a greater number of parcels than originally

existed is not thereby created, provided the lot
line adjustment is approved by the local agency, or
advisory agency. . . . "

5 WHEREAS Samuel Kevin Wilson, Director of Community
6 Services, has recommended that said Lot Line Adjustment be
7 approved.
8 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
9 THE CITY OF VERNON AS FOLLOWS:
10 SECTION 1: The City Council of the City of Vernon
11 does hereby find and determine that the recitals contained
12 hereinabove are true and correct.
13 SECTION 2: The request for a Lot Line Adjustment
14 dated Sept.ember 20, 1994, to adjust the common boundary of the
15 two existing properties being described in the attached Exhibit
16 "A" whereby said adjustment will create two new properties as
17 described in the attached Exhibit "B" is hereby approved in
18 accordance with the recommendation of Samuel Kevin Wilson,
19 Director of Community Services.
20 SECTION 4: The City Clerk of the city of Vernon
21 shall certify to the passage of this resolution and thereupon
22 and thereafter the same shall be in full force and effect.
23 APPROVED AND ADOPTED this 1st day of July, 1997.

Enclosed for the City's records are the original recorded
copies of (1) Resolution No. 6984 approving a lot line adjustment
for West Soto Street Partners and the Loretta Dodd Trust; (2) a
Cancellation of Covenant and Agreement to Hold Property as One
Parcel executed by West Soto Street Partners, and (3) a document of
the same ti tIe executed by Clougherty Packing Company.
All of
these documents were returned to us by the County Recorder's
Office.
It is our understanding, from Kevin Wilson, that the
cancellation of the covenants was requested by the title company
involved in this transaction.
The lot ties had actually been
dissolved several years ago, but the title company was unhappy with
the wording.

Clougherty Packing Company, a California corporation ("CPC"), and J-BLAK, a
partnership ("J-BLAK"), previously executed a Covenant and Agreement to Hold Property
as One Parcel, which was recorded in the Recorder's Office of the Los Angeles County,
State of California on February 27, 1991 as Instrument No. 91-278764 ("Covenant"). The
Covenant burdened certain real property owned by CPC andlor J-BLAK located in the City
of Vernon, County of Los Angeles, State of California, as more particularly described as
Lot 5 of Tract 49930, in the City of Vernon, County of Los Angeles, as per map filed in
Book 1170, Pages 95 and 96 in the office of the County Recorder of said county. The
property owned by J-BLAK which was burdened by the Covenant was deeded to Joseph D.
Clougherty, as Trustee of The Loretta M. Dodd Trust, under Declaration of Trust dated
May 26, 1983. The Covenant was requested by the City of Vernon ("City") in connection
with the issuance of a building permit to CPC with respect to the construction of certain
improvements to Parcell. The Covenant provided that it would continue in full force and
effect until terminated and cancelled by mutual agreement of CPC, J-BLAK and the City,
or their respective successors and assigns. The parties hereto hereby cancel and terminate
the Covenant and declare that it is of no further force and effect.

The Loretta M. Dodd Trust, under Declaration of Trust dated May 26, 1983. The Covenant
was requested by the City of Vernon ("City") in connection with the issuance of a certificate
of occupancy with respect to a short-term tenant occupying Lot 2 of Tract 49930. The
Covenant provided that it would continue in full force and effect until terminated and

assigns. The parties hereto hereby cancel and terminate the Covenant and declare that it is
