A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON DENYING A VARIANCE TO
JIAN JIONG DENG FROM SECTION 26.4.6-7,
AUTOMATIC EXPIRATION OF NON-CONFORMING
BUILDING, OF THE COMPREHENSIVE ZONING
ORDINANCE FOR THE PROPERTY LOCATED AT
3620 SANTA FE AVENUE IN THE CITY OF
VERNON
WHEREAS, Jian Jiong Deng owns a parcel of property
located 3620 Santa Fe Avenue in the City of Vernon and has
requested a variance from conformance with Section 26.4.6-7,
Automatic expiration of non-conforming building, of the
Comprehensive Zoning Ordinance; and
WHEREAS, Jian Jiong Deng proposes to use the building
for warehouse purposes and the building was constructed with two
conforming truck loading spaces which measure 10.0 feet in
width and 40.0 feet in length with 40.0 feet of unobstructed
maneuvering area; and
WHEREAS, the building has been vacant for a continuous
period greater than one year and Zoning Ordinance Section 26.4.6-
7 specifies that a building which has been vacant for a continuous
period greater than one year shall not be occupied except in the
case that it has been brought into conformity with all
regulations; and
WHEREAS, the existing building on the property measures
approximately 6,469 square feet with approximately 1,462 square
feet of office area, and pursuant to Zoning Ordinance Section
26.4.2-7 (a) such use requires one truck parking space per every
10,000 square feet of gross floor area of a warehouse use and
pursuant to Zoning Ordinance Section 26.4.2-7 (b) such use

requires one truck loading space for buildings with a gross floor
area under 8,000 square feet in size; and
WHEREAS, the building was constructed with insufficient
automobile parking spaces to comply with the current Zoning
Ordinance requirements; and
WHEREAS, Zoning Ordinance Section 26.4.2-6 specifies
that one automobile parking space be provided for every 1,000
square feet of gross floor area for an industrial use and one
automobile parking space be provided for every 500 square feet of
gross floor area for an office use and the building requires a
minimum of eight automobile parking spaces; and
WHEREAS, Jian Jiong Deng has indicated that he intends
to alter the building configuration such that 1,217 square feet
of the building will remain vacant, thus decreasing the parking
requirements for the building; and
WHEREAS, the submitted plans do not meet the provisions
of Comprehensive Zoning Ordinance Sections 26.4.2-8 (c) and (d)
that specify the required size and aisles for automobile parking
spaces; and
WHEREAS, 3620 Santa Fe Avenue is located in the CM zone
and the warehouse use is consistent with the objectives of the
General Plan and Zoning Ordinance; and
WHEREAS, the City Council has received an Engineers
Report dated July 9, 1997, in this matter upon which it has relied
in the foregoing recitals; and
WHEREAS, the City Council of the City of Vernon held a
hearing on said application for a variance on July 15, 1997.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF

THE CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon
hereby finds and determines that the recitals contained
hereinabove are true and correct.
SECTION 2: The request by Jian Jion Deng for a
variance from Section 26.4.6-7, Automatic expiration for non-
conforming building, of the Comprehensive Zoning Ordinance,
requiring that a non-conforming building which is vacant for a
continuous period of one (1) year shall not be occupied except
in the case that it is brought into conformity with all of the
regulations of the zone in which it is located, at 3620 Santa
Fe Avenue is hereby denied.
SECTION 3: The City Clerk of the City of Vernon
shall certify to the passage of this Resolution and thereupon
and thereafter the same shall be in full force and effect.

Honorable Members:
Jian Jiong Deng has submitted an application for a Variance from the
Comprehensive Zoning Ordinance, Section 26.4.6-7, Automatic Expiration
of Non-Conforming Building, for the building located at 3620 Santa Fe
Avenue, and transmitted herewith are the following documents as

VARIANCE APPLICATION
July 9, 1997
Jian Jiong Deng has requested a variance from the
Comprehensive Zoning Ordinance Section 26.4.6-7, Automatic
Expiration of Non-conforming Building, for the property located
at 3620 Santa Fe Avenue. Jian Jiong Deng is the owner of the
property which has been vacant for a continuous period greater
than one year. Section 26.4.6-7 requires that the building shall
not be occupied except in the case that it has been brought into
conformity with all regulations of the zone in which it is
located.
The building is approximately 6469 square feet on a lot of
approximately 9375 square feet. The owner is proposing to use
4,327 square feet of the building for warehouse purposes and 925
square feet of the building for office purposes. In order to be
able to provide parking, the owner is proposing to leave 1,217
square feet of the building vacant. One truck loading space and
one truck parking space, both 40,0 feet in length with 40 feet of
unobstructed maneuvering area, can be provided if the adjacent
alley is included as part of the maneuvering area and the
existing chain link fence is removed. The owner is proposing to
provide seven automobile parking spaces, six of which would be in
tandem.
As stated, Section 26.4.6-7 requires that a building which
has been vacant for a period greater than one year shall not be

occupied except in the case that the building has been brought
into conformity with all Fegulations of the zone in which it is
located. The property is located in the eM Zone. Section
26.4.2-7 (a) requires one truck parking space per 10,000 square
feet of gross floor area for a warehouse use. Section 26.4.2-7
(b) requires one truck loading space for buildings with a gross
floor area under 8,000 square feet. Section 26.4.2-6 requires
one automobile parking space per 1,000 square feet of an
industrial use and one space per 500 square feet of office use.
Therefore, the total parking and loading requirements for the
building are as follows:
Truck parking spaces: 1
Truck Loading spaces: 1
Automobile parking spaces
Office area: 2
Warehouse area: 5*
Total: 7
*If 1,217 square feet of the building remains vacant.
The problem with the owner's proposal is that the lot does
not supply, sufficient parking as required by the code. Section
26.4.2-8 (c) requires that all automobile parking spaces be 8.5
feet in width and 19 feet in length. Section 26.4.2-8 (d)
requires that for a 19-foot, 900 stall, a 27-foot aisle shall be
provided, The owner of the property is proposing to provide six
of the seven required parking spaces in tandem (ie, without the
27-foot required aisle), such that only three of the spaces would
be accessible if all six of the spaces were occupied. The owner
states that the three parking spaces which may not always be
accessible will be designated as "employee only" parking.
The idea of parking in tandem is not allowed by the code.
Also, even with the proposed tandem parking, a 27-foot
maneuvering aisle is not provided behind the spaces.
Additionally, the spaces are not 8.5 feet in width. The truck
parking and loading spaces are not 15 feet high as required by
the code. The building has been inspected to determine which
other Building Code concerns may be applicable to the building
and, at the very least, exiting, ADA accessibility and structural
integrity of the building will need to be investigated. We have
met with the owner's representative to discuss different
alternatives but have not been able to come up with a solution.
Since the submitted plans do not conform with Sections 26.4.2-8
(c) and (d) of the Comprehensive Zoning Ordinance which specify
the ,required size and aisles for automobile parking spaces, 'it is
recommended that the variance be denied.
