A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON, CALIFORNIA, AUTHORIZING THE DIRECTOR OF
COMMUNITY SERVICES AND WATER TO SIGN ALL
REPORTS AND ASSOCIATED DOCUMENTS RELATED TO THE
NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM
("NPDES") PERMIT

WHEREAS, The City Council of the City of Vernon, by
8
adoption of Resolution No. 6366 on December 7, 1993, approved a
National Pollutant Discharge Elimination System (NPDES) Permit No.
CA0061654-CI6948 Permit Implementation Agreement; and
WHEREAS, the aforesaid permit was superceded by NPDES
Permit No. CAS614001, issued pursuant to Order No. 96-054 of the
California Regional Water Quality Board, Los Angeles Region, on or
about July 15, 1996; and

WHEREAS, the NPDES Program requires periodic reports and

associated documents from the City of Vernon,
signed by the
16
principal executive officer, the ranking elected official, or a duly
17
18
authorized representative if the authorization is made in writing by
the principal executive officer or the ranking elected official, the
19
authorization specifies either an individual or a position having
20
21
responsibility for the overall responsibility of the Permittee's
Stormwater

responsibility,
or an individual or position having overall

responsibility for environmental matters for the Permittee, and the
written authorization is submitted to the executive officer of the

County of Los Angeles; and
WHEREAS, a duly authorized representative may be either a
27
named individual or any' individual occupying a named position; and

1 WHEREAS, Kevin Wilson, Director of community services and
2 Water for the City of Vernon, has responsibility for the overall
3 operation of the Stormwater Management Program for the City of
4 Vernon; and
5 WHEREAS, the City Council desires to authorize Kevin
6 Wilson, Director of Community Services and Water, or his successor,
7 to sign such reports and associated documents related to the NPDES,
8 Permit for the City of Vernon.
9 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
10 CITY OF VERNON AS FOLLOWS:
11 SECTION 1: The City Council of the City of Vernon hereby
12 finds and determines that the recitals contained hereinabove are
13 true and correct.
14 SECTION 2: The City Council of the city of Vernon hereby
15 authorizes Kevin Wilson, Director of Community services and Water,
16 or his successor, to sign reports and associated documents related
17 to the National Pollutant Discharge Elimination System Permit
18 Program required of the City of Vernon.
19 SECTION 3: The City council of the city of Vernon hereby
20 orders the City Clerk to submit a certified copy of this Resolution
21 to Robert Ghirelli, D.Env., Executive Officer, California Regional
22 Water Quality Control Board, Los Angeles Region, 101 Centre Plaza
23 Drive, Monterey Park, CA 91754-2156.

SECTION 4: The City Clerk of the City of Vernon shall
2 certify to the passage of this resolution, and thereupon and

thereafter the same shall be in full force and effect.

Honorable Members:
The National Pollution Discharge Elimination System (NPDES) Permit was
approved by the City Council with adoption of Resolution No. 6366.
At this time, due to the numerous reports that are required, it would
be more expedient if the Council allowed the Director of Community
Services to directly submit the reports.
It is hereby recommended that authority be granted for Kevin Wilson,
Director of Community Services, to sign necessary documents required
by the NPDES.

Subject: NPDES Permit Submittal Authorization
The new Municipal National Pollution Discharge Elimination System
Permit (NPDES) requires periodic submittals of reports and other
documentation relating to our implementation of the various
stormwater programs contained in the Permit. The Permit requires
all submittals to be signed by ~the principal executive officer or
the ranking elected official" of the Permittee unless some other
person is ~duly authorized" to submit the reports.
The exact number of required reports has yet to be established,
but the following is a partial list:
Annual Report
Annual Budget Summary
Quarterly Industrial/Commercial Inspection reports
Various reports for specific program elements
Program Accomplishments and Self Assessment report
Since there will be quite a few reports and other submittals made
each year as a part of this Permit, it would simplify things
greatly if I were authorized to submit these reports in the manner
described in the Permit. You will have to send a letter to the
Regional Water Quality Control Board that specifically authorizes
me (or whomever occupies the position of Director of Community
Services) to submit these reports. I have attached a copy of the
portion of the Permit that mandates this authorization (see Part 3
(I I) ) .

Part 3. STANDARD PROVISIONS
I. The initial storm water management program, as delineated in the CSWMP or WMAPs
may need to be modified, revised, or amended periodically to respond to changed
conditions and to incorporate more effective approaches to pollutant controls. Minor
changes may be made at the direction of the Executive Officer. Minor changes
requested by the Permittees shall become effective upon written approval of the
Executive Officer. If proposed changes involved a major revision in the overall scope
of the program, such changes must be approved by the Regional Board as
amendments to this Order.
II. Except as otherwise provided in this Order, all reports or submittals made directly to
the Executive Officer or through the Principal Permittee shall be signed under penalty
of perjury by the principal executive officer or the ranking elected official of the
Permittee ora duly authorized representative if:
A. The authorization is made in writing by a person described above;
B. The authorization specifies either an individual or a position having responsibility
for the overall operation of the Permittee's storm water management program,
position of equivalent responsibility, or an individual or position having overall
responsibility ~or environmental matters for the Permittee. A duly authorized
representative may thus be either a named individual or any individual occupying
a named position; and
C. The written authorization is submitted to the Executive Offi,cer.
III. This Order may only be modified, revoked, or reissued, prior to the expiration date, by
the Regional Board, in accordance with the procedural requirements of the Water
Code and Title 23 of the California Code Regulations for the issuance of waste
discharge requirements, and upon prior notice and hearing, to:
A. Address changed conditions identified in the required reports or other sources
deemed significant by the Regional Board;
B. Incorporate applicable requirements or statewide water quality control plans
adopted by the State Board or amendments to the Basin Plan;
C. Comply with any applicable requirements, guidelines, and/or regulations issued
or approved pursuant to CWA Section 402(p); and/or
D. Consider any other federal, or state laws or regulations that became effective
after adoption of this Order.
