Resolution No. 7005 1 RESOLUTION NO. 7005 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON FINDING THE CITY OF VERNON TO BE IN CONFORMANCE WITH THE CONGESTION MANAGEMENT PROGRAM (CMP) AS ESTABLISHED BY THE LOS ANGELES COUNTY METROPOLITAN TRANSPORTATION AUTHORITY 3 4 5 WHEREAS, the Los Angeles County Metropolitan 6 Transportation Authority (tlMTAIt), acting as the congestion 7 Management Agency for Los Angeles County, adopted the 1995 8 Congestion Management Program (ltCMpIt) on November 15, 1995; and 9 WHEREAS, the CMP requires that MTA annually determine that the County and cities within the County are conforming to all 10 11 CMP requirements; and 12 WHEREAS, the CMP requires submittal to the MTA of the 13 annual CMP Local Implementation Report by september 1, 1997; and 14 WHEREAS, the City Council of the City of Vernon held a 15 noticed public hearing on August 19, 1997. 16 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON'AS FOLLOWS: 17 18 SECTION 1: The City Council of the City of Vernon 19 hereby finds and determines that the recitals contained 20 hereinabove are true and correct. 21 SECTION 2: The City Council finds and determines that 22 the city of Vernon has taken all of the following actions, and is 23 in conformance with all applicable statutory requirements of the 24 1995 CMP. 25 The City of Vernon has adopted and continues to A. 26 implement a transportation demand management ordinance, consistent 27 with the minimum statutory requirements identified in the CMP - 28 Chapter on the Transportation Demand Management Element. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 B. The City of Vernon has adopted and continues to implement a land use analysis program consistent with the minimum statutory requirements identified in the CMP Chapter on the Land Use Analysis Program. C. The City of Vernon has adopted a Local Implementation Report, attached hereto and made a part hereof by reference, consistent with the requirements identified in the CMP. This report balances traffic congestion impacts due to growth within the City with transportation improvements, and demonstrates that the City is meeting its responsibilities under the Countywide Deficiency Plan. D. Since June 1, 1994, the city of Vernon has been tracking new development activity, consistent with the requirements identified in the CMP. This information will be annually tabulated, as the basis for determining mitigation measures which the City of Vernon may implement if necessary under the Countywide Deficiency Plan. SECTION 3: The City Clerk shall forward a certified copy of this Resolution to the Los Angeles County Metropolitan Transportation Authority, attention Jody Feerst, CMP Manager, Los Angeles County Metropolitan Transportation Authority, Mail stop 99-23-2, One Gateway Plaza, Los Angeles, CA 90012. The County Program was designed to alleviate traffic congestion 'caused by potential increases in growth. As required by the program each City must self certify that it is in conformance with all elements of the CMP. Failure to comply with the requirements of the program could result in the loss of state funding for transportation projects. The program establishes a point system. In order to be in compliance a municipality must maintain a positive number of points. The City can gain points by implementing congestion relieving strategies. The three strategy categories are: 1. Land Use Strategies; 2. Capital Improvements and Transportation Systems Management (TSM); and 3. Transportation Demand Management and Transit Services. Attached is a list of the strategies and the programs included within them. The City is credited points for structures that are demolished. Points from the "Toolbox Strategies" vary depending on the amount of congestion that each project relieves. The City is debited points for each structure constructed. The City of Vernon carried over -264 points from the previous year. The City of Vernon was found to be in compliance last year because the amount of credits to be received for Hobart Yard, a freight-to-rail facility, has yet to be determined. We are still waiting for MTA to determine the amount of credits to be received for this project. During the CMP's recording year, June 1, 1996 to May 31, 1997, the City of Vernon was able to attain a positive amount of CMP points, even without the addition of credit to be received for the freight-to-rail facility. Approximately 460,000 square feet of building space was constructed and 560,000 square feet of building space was demolished. (430,000 square feet of the demolition occurred at the Alcoa site.) The City gained 138 credits for its TDM Program. Therefore Vernon's credit balance is 482 (plus some amount of credit to be determined by MTA for the freight-to-rail facility) . Place: Vernon City Hall City Council Chambers 4305 Santa Fe Avenue Vernon, CA 90058 Time: Tuesday, August 19, 1997 at 5:00 p.m. The City of Vernon will be conducting a Public Hearing regarding Vernon's conformance with the Congestion Management Plan as established by the Los Angeles County Metropolitan Transportation Authority. The purpose of the hearing is to obtain testimony from affected and/or interested persons regarding this subject. The public is also invited to submit written comments regarding the request prior to the Hearing. Review of the file: The documentation supporting the conclusion that Vernon is in conformance with the Congestion Management Plan is available in the office of Community Services, Vernon City Hall, 4305 Santa Fe Avenue, between the hours of 7:15 a.m. and 5:15 p.m. Monday through Thursday. If you challenge the approval of Vernon's self certification or any provisions thereof in court, you may be limited to raising only those issues you or someone else raised at the hearing described in this notice or in written correspondence delivered to the City of Vernon at, or prior to, the meeting. 4- ~ ,.
