Resolution No. 7007 1 RESOLUTION NO. 7007 2 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON APPROVING AND AUTHORIZING THE EXECUTION OF A WATER RIGHT LICENSE AND SIDE AGREEMENT BY AND BETWEEN THE CITY OF VERNON AND THE CITY OF MONTEBELLO WHICH GRANTS THE CITY OF VERNON A LICENSE TO EXTRACT 80 ACRE-FEET OF THE CITY OF MONTEBELLO'S ALLOWED PUMPING ALLOCATION FOR THE PERIOD JULY 1, 1997 THROUGH JUNE 30, 1998 4 5 6 7 8 WHEREAS, the City of Montebello owns water rights from which it is willing to lease 80 acre-feet of allowed pumping allocation to the City of Vernon for fiscal year 1997-1998; and 9 10 11 WHEREAS, the Director of Community Services & Water and the 12 City of Montebello have negotiated a Water Right License and Side 13 Agreement (dated July 10, 1997) with an agreed price for the period of July 1, 1997 through June 30, 1998 of Eleven Thousand six Hundred 14 15 Dollars and No Cents ($11,600.00); and WHEREAS, the City of Vernon and City of Montebello intend 16 to execute a "Statement" to the City of Montebello dated August 21, 17 1997, which provides that the sum of Eleven Thousand six Hundred 18 19 Dollars and No Cents ($11,600.00) (for 1997-98) will be paid to the City of Montebello. 20 21 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: 22 23 SECTION 1: The City Council of the city of Vernon hereby finds and determines that the recitals contained hereinabove are 24 true and correct. 25 26 SECTION 2: The City Council of the City of Vernon hereby approves the Water Right License, the Side Agreement and the 27 Statement, copies of which have been presented to the City council 28 1 concurrently with this resolution, and the City Council hereby 2 orders said License to be received and filed by the City Clerk. 3 SECTION 3: The City Council of the city of Vernon hereby 4 authorizes the Mayor and the City Clerk to execute said License for, 5 and on behalf of -, the City of Vernon, and authorizes the City 6 Administrator to execute the Side Agreement and the Statement for, 7 and on behalf of, the City of Vernon. 8 The City Clerk of the City of Vernon shall SECTION 4: 9 certify to the passage of this resolution, and thereupon and 10 thereafter the same shall be in full force and effect. 11 APPROVED AND ADOPTED this 16th day of September, 1997. 12 13 ~. /' LEONIS c.
