Resolution No. 7010 . .' 1 RESOLUTION NO. 7010 2 3 A RESOLUTION OF THE CITY eOUNCIL OF THE CITY OF VERNON AMENDING SECTION 25, SCHEDULE II, EXHIBIT "B," PAGE 14 AND SCHEDULE V, EXHIBIT "E," OF RESOLUTION NO. 6976, WHICH FIXED THE eOMPENSATION FOR CERTAIN EMPLOYEES OF SAID eITY AND AUTHORIZED CERTAIN EXPENSE ALLOWANCES 4 5 6 7 WHEREAS, Resolution No. 6976 was adopted by the City Council of the eity of Vernon on June 25, 1997, to be effective on 8 9 July 1, 1997; and 10 WHEREAS, the City Council of the City of Vernon adopted Resolution No. 7009 on September 2, 1997, which approved a Fourth Side-Letter Agreement between the Municipal Employees Relations 11 12 13 Representative and the Vernon Police Officers' Benefit Association 14 amending the Memorandum of Understanding previously adopted by Resolution No. 5489 on March 15, 1988, as amended by a Side-Letter 15 16 Agreement adopted by Resolution No. 6001 on January 21, 1992, a Second Side-Letter Agreement adopted by Resolution No. 6258 on 17 18 October 5, 1993, and a Third Side-Letter Agreement adopted by 19 Resolution No. 6656 on July 11, 1995; and WHEREAS, the Fourth Side-Letter Agreement provides for 20 21 (1) (2) An extension of the MOU to the year 2005; 22 A five percent (5%) salary increase for the Vernon Group 23 2 employees effective September 1, 1997; 24 (3) An increase in the court appearance and standby status 25 fees effective September 1, 1997; 26 (4) A new discipline procedure; 27 and 28 WHEREAS, Schedule II, Exhibit "B," page 14 of Resolution 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 No. 6976 provides for the positions and salary scales of police officers and sergeants in the Vernon Police Department; and WHEREAS, Schedule V, Exhibit "E," of Resolution No. 6976 provides for the compensation for court appearances and standby status; and WHEREAS, in accordance with Section 2.4 of the MOU, the City council of the city of Vernon intends to establish a new salary schedule for the positions of police officers and sergeants in the Vernon Police Department; and WHEREAS, certain schedules and sections of Resolution No. 6976 need to be modified in order to implement the provisions of the Fourth Side-Letter Agreement. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon does hereby find and determine that the recitals contained hereinabove are true and correct. SECTION 2: Effective September 1, 1997, Schedule II, Exhibit "B," page 14 of Resolution No. 6976 is hereby amended to establish new salary schedules for the positions of police officers and sergeants in the Vernon Police Department as indicated on the amended page 14 of Schedule II, Exhibit "B," which is attached hereto as Attachment A and made a part hereof. SECTION 3: Effective September 1, 1997, Schedule V, Exhibit "E" of Resolution 6976 is hereby amended to establish new compensation for court appearances and standby status for the positions of police officers and sergeants in the Vernon Police Department as indicated on the amended Schedule V, Exhibit "E," -2- ',' 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 which is attached hereto as Attachment B and made a part hereof. SECTION 4: Section 25(a), page 32 of Resolution No. 6976 is hereby modified to read as follows: (a) MOU. For purposes of this resolution, all of the provisions in the MOU dated March 1, 1988, adopted by the City eouncil of the City of Vernon on March 15, 1988, pursuant to Resolution No. 5489, as extended by a Side-Letter Agreement effective October 6, 1991, approved by the City council of the City of Vernon on January 21, 1992, pursuant to Resolution No. 6001, and Second Side-Letter Agreement approved by the City council of the City of Vernon on October 5, 1993, pursuant to Resolution No. 6258, the Third Side- Letter Agreement approved by the City Council of the City of Vernon on July 11, 1995, pursuant to Resolution No. 6656, and the Fourth Side-Letter Agreement, approved by the City Council of the City of Vernon on September 2, 1997, pursuant to Resolution 7009 are referenced herein as though fully set forth at length. SECTION 5: section 25(c), page 33, of Resolution No. 6976 is hereby modified to read as follows: (c) Court Appearances. Any employee shall be deemed to have served a full court -3- 1 day appearance if the employee is required to appear at the 2 morning session of the court and has to return on the same day 3 after the noon recess of the court. otherwise, an appearance 4 during the morning session or the afternoon session only shall be 5 considered a half court day. 6 SECTION 6: section 25(d), page 33, of Resolution No. 7 6976 is hereby modified to read as follows: 8 (d) Standby Status. 9 In addition, Police Sergeants and Police Officers shall 10 be compensated for standby status as specified in Schedule V, 11 Exhibit "E." 12 SECTION 7: In all other respects, Resolution No. 6976 13 shall remain in full force and effect, and the provisions of 14 Resolution No. 6976 not consistent with or in conflict with this 15 resolution are hereby repealed. 16 17 SECTION 8: The City Clerk of the city of Vernon shall certify to the passage of this resolution and thereupon and thereafter the same shall be in full force and effect. 18 19 APPROVED AND ADOPTED this 2nd day of september, ~a~ THOMAS A.
