RESOLUTION NO. 7013
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A CONDITIONAL USE
PERMIT TO NEW WILLIG FREIGHT LINES FOR
THE OPERATION OF A TRUCK AND FREIGHT TERMINAL
AT 2043 ROSS STREET
5 WHEREAS, New Willig Freight Lines has applied for
6 a conditional use permit to operate a truck and freight
7 terminal at 2043 Ross Street in the City of Vernon; and
8
WHEREAS, the City Council of the City of Vernon
9 held a hearing on said application for a conditional use
10 permit on September 2, 1997; and
11
WHEREAS, the proposed site is a grandfathered non-
12 conforming use in the General Industrial (M) Zone which has
13 been continuously used as a truck and freight terminal
14 previously operated by Southern Counties Transport and which
15 requires a conditional use permit under the Zoning Ordinance
16 in order to continue the use; and
17 WHEREAS, the proposed operation will include the
18 hauling and temporary storage of general products; and
19 WHEREAS, the proposed site is approximately 1.26
20 acres in size, contains three buildings, and the size,
21 shape, topography and drainage of the parcel are adequate
22 for the proposed operation; and
23 WHEREAS, a barrier wall or landscaping will be
24 installed where parking or maneuvering areas adjoin a public
25 street pursuant to the Vernon City Code; and
26 WHEREAS, the proposed site is surrounded by
27 industrial uses compatible with the proposed use and no
28 adverse effect from traffic, parking, noise, odors, dust,

1 smoke, light or glare, or risk of fire, infection or
2 explosion is anticipated from the proposed operation; and
3 WHEREAS, the site has access to Ross Street and in
4 general traffic will travel from the site on Ross Street to
5 Alameda Street, thence north to freeway access; or on Ross
6 Street to 37th Street to Santa Fe Avenue, thence to freeway
7 access; and the streets to be utilized within the City of
8 Vernon are sufficient to handle the traffic generated from
9 the proposed operations; and
10 WHEREAS, the site is required to have adequate
11 of.fstreet parking and loading facilities in accordance with
12 the Vernon City Code; and
13 WHEREAS, the conditions imposed on the conditional
14 use permit will adequately protect the public health, safety
15 and general welfare and the operation is consistent with all
16 applicable rules and laws of the City of Vernon; and
17 WHEREAS, the proposed use as to location,
18 operation, and design is consistent with the General Plan
19 and the Zoning Ordinance of the City of Vernon; and
20 WHEREAS, the City Council has received an
21 Engineer's Report dated August 25, 1997, upon which it has
22 relied in making the foregoing recitals; and
23 WHEREAS, the project is categorically exempt from
24 the California Environmental Quality Act as an existing
25 facility pursuant to Section 15301 of the California
26 Environmental Quality Act Guidelines and a Notice of
27 Exemption shall be filed with the County Clerk pursuant to
28 Section 15062 of the California Environmental Quality Act

2 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
3 OF THE CITY OF VERNON AS FOLLOWS:
4 SECTIO~ 1: The City Council of the City of Vernon
5 hereby finds and determines that the recitals contained
6 hereinabove are true and correct.
7 SECTION 2: Subject to the conditions set forth
8 below, the conditional use permit is granted to New
9 Willig Freight Lines for the operation of a truck and
10 freight terminal at 2043 Ross Street.
11 SECTION 3: In order to adequately protect the
12 public health, safety and general welfare the following
13 conditions are imposed:
14 a. The facility shall be operated in accordance
15 with, and made to conform with all current codes, rules,
16 regulations and subject to permit fees as adopted by the
17 City of Vernon. All trucking operations, including truck
18 and trailer parking, shall be limited to the lot located at
19 2043 Ross Street in the City of Vernon.
20 b. All parking and loading facilities shall be
21 paved with a hard durable surface material and shall be
22 adequately drained, and kept free of dust, mud, trash and
23 weeds. Where parking or maneuvering areas adjoin the public
24 street a barrier wall or landscaping shall be installed to
25 meet City standards.
26 c. Servicing of vehicles including washing, steam
27 cleaning and repairing shall be performed in facilities in
28 compliance with appropriate codes.

1 d. A National Pollutant. Discharge Elimination
2 System Permit shalL be . obtained from the California State
3 Board of Water Resources.
4 e. No equipment or freight shall be s.tored OIl the
5 site, other than in buildings, trailers or on the docks.
6 f. Adequate plans and materials must be available
7 for handling leaks or spills from vehicles during storage or
8 transportation.
9 g. All required federal, state, local and
10 regulatory agency permits shall be obtained prior to
11 operation. Prior to occupancy a business license and
12 occupancy permit shall be obtained.
13 h. A hazardous materials inventory and
14 business/contingency plan shall be submitted and a hazardous
15 materials permit shall be obtained from the City of Vernon
16 Health Department. Hazardous materials/wastes shall be
17 handled and managed in compliance with all appropriate
18 federal, state and local laws.
19 i. The facility shall be operated in a manner that
20 will prevent unsanitary conditions, odors or other
21 nuisances. The property shall be provided with adequate
22 refuse containers and refuse disposal service.
23 j. The facility's buildings shall be structurally
24 maintained to exclude rodents and the property shall be
25 maintained rodent free.
26 k. The facility shall be operated in a manner
27 which will not impede traffic on Ross Street.

3 SECT~ON 4: The City Clerk of the City of Vernon

CONDITIONAL USE PERMIT TO OPERATE A
TRUCK AND FREIGHT TERMINAL AT 2043 ROSS STREET
(August 25, 1997)
New Willig Freight Lines has applied for a conditional use
permit to operate a truck and freight terminal at 2043 Ross
Street in the City of Vernon. It is a trucking company providing
pick-up and delivery service of a wide range of items.
1. GENERAL PLAN The proposed use conforms to the Zoning
Ordinance and the General Plan. The site is presently being used
as a truck and freight terminal.
2. SITE The proposed site is of adequate size and shape
for the proposed use.
3. ADVERSE AFFECT The proposed site is surrounded by
industrial uses compatible with the proposed use and no adverse
noise, odor, dust, smoke, light or glare, or risk of fire,
infection or explosion is anticipated from the proposed
operation.
4. ACCESS The site has access to Ross Street. This street
is of adequate size to handle the traffic generated from the
proposed operation.
5. TRUCK MOVEMENTS New Willig Freight Lines will operate
approximately 20 trucks out of the facility. Operations will be
between the hours of 2:00 am and 12:00 am, Monday through Friday.
In general, trucks will travel on Ross Street to Alameda Street

then north to freeway access, or on Ross Street to 37th Street to
Santa Fe Avenue then to freeway access.
6. STATE OR FEDERAL CONDITIONS There are no conditions
imposed by State or Federal law.
7. CONDITIONS It is recommended that the following
conditions be set on the permit to adequately protect the public
interests:
a. The facility shall be operated in accordance with, and

Gentlemen:
New Willig Freight Lines has applied for a conditional use
permit to operate a truck and freight terminal at 2043 Ross
Street.
After review of the application by the Community Services
Department, it is recommended that the conditional use permit be
granted.
Herewith for your consideration are the following supporting
documents:
1. Request for conditional use permit and information
supporting the application.
2. Engineer'S Report.
3. Notice of Public Hearing, copies of notification letters
to owners and tenants in the area and affidavits of posting and
mailing.
New Willig Freight Lines was found to be categorically
exempt from the California Environmental Quality Act process,
since they will be using an existing truck terminal and the
facility is not being expanded.
In my opinion the proposed operation will pose no adverse
effects to the City of Vernon and will have no significant
effects on the environment, and no mitigating measures are
required.

It is also recommended that the City Council find that the
proposed use is categorically exempt from the California
Environmental Quality Act process.
Further it is recommended that a Notice of Exemption be
filed with the County Clerk and the conditional use permit be
granted subject to the following conditions:
a. The facility shall be operated in accordance with, and
made to conform with all current codes, rules, regulations and
subject to permit fees as adopted by the City of Vernon. All
trucking operations, including truck and trailer parking, shall
be limited to the lot located at 2043 Ross Street in the City of
Vernon.
b. All parking and loading facilities shall be paved with a
hard durable surface material and shall be adequately drained,
and kept free of dust, mud, trash and weeds. Where parking or
maneuvering areas adjoin the public street a barrier wall or
landscaping shall be installed to meet City standards.
c. Servicing of vehicles including washing, steam cleaning
and repairing shall be performed in facilities in compliance with
appropriate codes.
d. A National Pollutant Discharge Elimination System Permit
shall be obtained from the California State Board of Water
Resources.
e. No equipment or freight shall be stored on the site,
other than in buildings, trailers or on the docks.
f. Adequate plans and materials must be available for
handling leaks or spills from vehicles during storage or
transportation.
g. All required federal, state, local and regulatory agency
permits shall be obtained prior to operation. Prior to occupancy
a business license and occupancy permit shall be obtained.
h. A hazardous materials inventory and business/contingency
plan shall be submitted and a hazardous materials permit shall be
obtained from the City of Vernon Health Department. Hazardous
materials/wastes shall be handled and managed in compliance with
all appropriate federal, state and local laws.
i. The facility shall be operated in a manner that will
prevent unsanitary conditions, odors or other nuisances. The
property shall be provided with adequate refuse containers and
refuse disposal service.

j. The facility's buildings shall be structurally maintained
to exclude rodents and the property shall be maintained rodent
free.
k. The facility shall be operated in a manner which will not
impede traffic on Ross Street.
1. All existing cracked sidewalk, curb and gutter adjacent
to the site in Ross Street shall be repaired and maintained to
meet City Standards.
