A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A VARIANCE TO
FAR EAST NATIONAL BANK FROM SECTION
26.4.2~8, DEVELOPMENT STANDARDS, OF THE
COMPREHENSIVE ZONING ORDINANCE, TO THE
PROPERTY LOCATED AT 4901-4903 PACIFIC
BOULEVARD IN THE CITY OF VERNON
WHEREAS, Far East National Bank owns the property
located at 4901-4903 Pacific Boulevard in the City of Vernon and
has requested a variance from Section 26.4.2-8, Development
Standards, of the Comprehensive Zoning Ordinance; and
WHEREAS, the property is unique in that the existing
building measures approximately 21,000 square feet and has three
non-conforming truck loading spaces measuring 10.0 feet in width
with two being 24.5 feet in length and one being 31.0 feet in
length; and
WHEREAS, Zoning Ordinance Section 26.4.2-7 (b) requires
two truck loading spaces for buildings with a gross floor area
between 8,001 and 25,000 square feet in size; and
WHEREAS, Zoning Ordinance Section 26.4.2-8 (c) specifies
that each truck loading space shall be a minimum of 10 feet wide
and 65 feet long, and Section 26.4.6-4 (c) provides that a non-
conforming building must comply with these standards within 5
years of April 18, 1989 unless a variance is granted; and
WHEREAS, there is insufficient space on the property
and the application of the development standards for the truck
loading space requirements will create an unreasonable hardship
by requiring the non-conforming spaces to be 10 feet wide
and 65 feet long; and

WHEREAS, the owner of the property has indicated that
it has no plans to expand or alter the building
configuration and that the existing truck loading spaces are
sufficient for the intended use; and
WHEREAS, 4901-4903 Pacific Boulevard is located in the
M zone and the operation is consistent with the objectives of the
General Plan and Zoning Ordinance; and
WHEREAS" strict applicatioIl of thEtloading area
requirements of Section 26.4 of the Vernon city Code would create
an unreasonable hardship, the existing use does not and will not
adversely affect the surrounding area, and the use does not
require the loading area specified by Section 26.4; and
WHEREAS, the City Council has received an Engineer'S
Report dated September 17, 1997 and memo < from the Director o.f
Community Services & Water dated November 18, 1997, upon which it
has relied in making the foregoing recitals; and
WHEREAS, the City Council of the City of Vernon opened
a hearing on said application for a variance on October 7, 1997,
which was continued to October 21, November 4, November 18, and
December 2,1997.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon
hereby finds and determines that the recitals contained herein-
above are true and correct.
SECrION 2: A variance from Section 26.4.2-8 of the
Comprehensive Zoning Ordinance, requiring all truck loading spaces
to be 10 feet wide by 65 feet long, is hereby granted for the

SECTION 3: The variance granted is subject to the
3 following conditions:
4 (a) The usage of the non-conforming truck loading
5 spaces shall be limited so that no truck parked at or using the
6 loading docks shall extend into the existing street right-of-way
7 as shown on the Master Plan of Streets, dated June 16, 1992.
8 (b) All existing and future tenants shall be notified
9 of this restriction and a condition stating this shall be placed
10 in all future leases.
11 (c) The loading space located on Pacific Boulevard shall
12 be sealed unless it is brought into compliance with the
13 Comprehensive Zoning Ordinance.

SECTION 4: Noncompliance with these conditions shall
constitute sufficient grounds for the City Council of the City
of Vernon to void this variance and require the application of
Zoning Ordinance Section 26.4.2-8 and the authorized truck loading
space requirement.
SECTION 5: The City Clerk of the City of Vernon shall
certify to the passage of this Resolution and thereupon and
thereafter the same shall be in full force and effect.

Honorable Members:
A Public Hearing was opened on October 17, 1997, regarding the
variance application submitted by Far East National Bank for the
property located at 4901-4903 Pacific Boulevard. They were
requesting a variance from Section 26.4.2-8, Development
Standards, of the Comprehensive Zoning Ordinance. Comments were
received from an owner of a neighboring property. This owner
claimed that the loading space located on Pacific Boulevard w~s
previously blocked and unused. Once a loading door has been
blocked and not used, the door cannot be opened or replaced
unless the loading space is in compliance with the Zoning
Ordinance.
This concern has been thoroughly reviewed by the Community
Services & Water Department and it was concluded that the door
had indeed been blocked.
Based on staff review, it is hereby recommended that the variance
be granted, contingent upon the additional condition as listed
below:
c} The loading space located on Pacific Boulevard
shall be sealed unless it is brought into
compliance with the Comprehensive Zoning
Ordinance.

A Public Hearing was opened on October 17, 1997 regarding
the variance application submitted by Far East National Bank for
the property located at 4901-4903 Pacific Boulevard. They were
requesting a variance from Section 26.4.2-8, Development
Standards, of the Comprehensive Zoning Ordinance. Comments were
received from an owner of a neighboring property. This owner
claimed that the loading space located on Pacific Boulevard was
previously blocked and unused. Once a loading door has been
blocked and not used, the door cannot be opened or replaced
unless the loading space is in compliance with the Zoning
Ordinance.
After investigation into this claim, I can only conclude
that the door had indeed been blocked. Physical evidence where
the door now exists indicates that a wall was once placed there
to block the loading space. Sections of rebar have been severed
in both the adjacent wall and the floor. Paint drippings
indicate that a wall must have been present when the building was
painted. Other neighbors and the past owner have substantiated
that there was some kind of tank placed in front of the loading
space that prevented its usage.
Therefore, I recommend that the City Council grant the
variance with the conditions changed to read as follows:
a} The usage of the non-conforming loading spaces shall be
limited so that no trucks parked at or using the loading docks
shall extend into the street right-of-way as shown on the Master
Plan of Streets, dated June 16, 1992.
b} All existing and future tenants shall be notified of this
restriction and a condition stating this shall be placed in all
future leases.
c} The loading space located on Pacific Boulevard shall be
sealed unless it is brought into compliance with the
Comprehensive Zoning Ordinance.

Specifically, the owner of the neighboring building stated that
the loading dock which is located on Pacific Boulevard was
previously blocked. Once a loading door has been blocked and not
used, the door cannot be opened or replaced unless the loading
space is in compliance with the Zoning Ordinance.
In speaking with the past owner of the building and with
other neighbors of the property, we learned that there was some
type of tank placed in front of the door which rendered it
unusable. Physical evidence also suggests that a block wall was
removed from the loading door. The present owner of the building
could not present evidence which proved otherwise. Therefore, it
is recommended that the following condition be added to the
variance:

A variance to the requirement of a 65 foot recessed loading dock. There is an
existing 25 foot recessed loading dock which can be used along with a loading
dock along the east wall which sits at the rear of the parking space for the
subject building. Any loading or unloading will be done with smaller vehicles and
will take place entirely upon the subject property's limits and will not in any way
block City sidewalks or streets.
NOTICE TO APPLIC~~: In the variance procedure it shall be shown that
the following five (5) conditions exist in reference to the property
being considered. The applicant should answer the following
statements. If you have difficulty finding reasonable answers to the
statements contained in this application it may be an indication that
your request has insufficient factors to justify approval. (Attach
additional sheet(s) if necessary.
(1) That special conditions and circumstances exist which are peculiar
to the land, structure, or buildina involved and which are not
generally applicable to other lands, ~tructures, or buildings in the
same vicinity and zone:
The subject property is approxiamately 95% improved with the existing structure
which was built in 1940.
(2) That literal interpretation of the provisions of this ordinance
would deprive the applicant of rights commonly enj oyed by other
propertied in the same vicinity and zone in which the property is
located, under the terms of this Chapter.
In order to satisfy the requirement, the subject building would have to be
severely altered
thereby greatly injuring the property's utility and
market value.

As all loading and unloading will take place entirely upon the subject property
there is no "special privilege which would be conferred to the applicant.
(5) That the granting of such variance will be in harmony and not
adversely affect the Comprehensive General Plan:
Granting of the requested variance will not affect the General Plan for the
City of Vernon, as the applicant will occupy the subject property well within
bounds of the City's codes and ordinances.

FAR EAST NATIONAL BANK
4901-4903 PACIFIC BOULEVARD
VARIANCE APPLICATION
SEPTEMBER 17, 1997
Far East National Bank has requested a variance from the
Comprehensive Zoning Ordinance Section 26.4.2-8, Development
Standards, for the property located at 4901-4903 Pacific
Boulevard in the City of Vernon. The building it owns was
constructed with three non-conforming truck loading spaces
measuring 10.0 feet in width with two being 24.5 feet in length
and one being 31.0 feet in length. It has stated that only
vehicles of smaller lengths will be used at the non-conforming
truck loading spaces. The building is currently vacant and is
approximately 21,000 square feet in size.
Section 26.4.2-7 (b) requires two truck loading spaces for
buildings with a gross floor area between 8,001 and 25,000 square
feet in size. Section 26.4.2-8 (c) of the Comprehensive Zoning
Ordinance specifies that each loading space shall be a minimum of
10 feet wide and 65 feet long and Section 26.4.6-4 (c) provides
that a non-conforming building must comply with these standards
within five years of April 18, 1989 unless a variance is granted.
Far East National Bank has indicated that requiring the non-
conforming truck loading spaces to be 65 feet long by 10 feet
wide would be a hardship. They have indicated that they have no

plans for expansion or alteration of the building configuration.
The operation is in conformance with the Zoning Ordinance and
General Plan. Therefore, it is recommended that the variance be
granted subject to the following conditions:
(a) The usage of the three non-conforming truck loading
spaces shall be limited so that no truck parked at or using the
loading docks shall extend into the existing street right-of-way
as shown on the Master Plan of Streets, dated June 16, 1992.
(b) All existing and future tenants shall be notified of
this restriction and a condition stating this shall be placed in
all future leases.
