Resolution No. 7069t t 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 7069 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON, CALIFORNIA, ORDERING THE SUBMISSION OF QUESTIONS TO THE QUALIFIED VOTERS OF THE CITY RELATING TO BUSINESS LICENSE TAXES, PROVIDING FOR ANNUAL ADJUSTMENT OF MAXIMUM TAX RATES, AND THE ESTABLISHMENT OF A SPECIAL PARCEL TAX ON WAREHOUSES, TRUCK TERMINALS, FREIGHT TERMINALS AND OTHER DISTRIBUTION FACILITIES WITHIN THE CITY OF VERNON AT THE GENERAL MUNICIPAL ELECTION TO BE HELD ON TUESDAY, APRIL 14, 1998 WHEREAS, the City Council of the City of Vernon on January 6, 1998, adopted Ordinance No. 1056, adding Article II to Chapter 5 to the Code of the City of Vernon, relating to business license taxes, and Ordinance No. 1057, adding Articles III and IV to said Chapter 5 to renumber and recodify sections 15.36 through 15.38 of said Code, provide for annual adjustment of tax rates, and establish a special parcel tax on property used or designed for use as a warehouse, truck terminal, freight terminal or other distribution facility; and WHEREAS, the City Council of the City of Vernon, by adoption of Resolution No. 7051 on December 2, 1997, has ordered that a general municipal election be held in the City on Tuesday, April 14, 1998; and WHEREAS, pursuant to the provisions of Article V of the Charter of the City of Vernon, the aforesaid ordinances provide that the questions hereinafter set forth as Measures A and B shall be submitted to the qualified voters of the City at said general municipal election. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recital contained hereinabove is true and correct. SECTION 2: The City Council, pursuant to its right and authority, does hereby order submitted to the voters at the general municipal election to be held on Tuesday, April 14, 1998, the following questions: MEASURE A Shall an ordinance entitled "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF VERNON ADDING ARTICLE II TO CHAPTER 5 TO THE CODE OF THE CITY OF VERNON, CALIFORNIA, 1959, RELATIVE TO BUSINESS LICENSE TAXES AND FEES, ESTABLISHING A DATE FOR AN ELECTION TO BE HELD TO APPROVE THE LEVY OF THE BUSINESS LICENSE TAXES CONTAINED HEREIN; AND DECLARING THAT SAID ORDINANCE SHALL TAKE EFFECT IMMEDIATELY" be approved? -2- YES NO 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 MEASURE B Shall an ordinance entitled "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF VERNON ADDING ARTICLE III TO CHAPTER 5 OF THE CODE OF THE CITY OF VERNON, CALIFORNIA, 1959, AND RENUMBERING AND RECODIFYING SECTIONS 15.36 THROUGH 15.38 AS SECTIONS 5.35 THROUGH 5.39 OF SAID ARTICLE III; ADDING SECTION 5.40 TO SAID ARTICLE III RELATIVE TO ANNUAL ADJUSTMENT OF TAX RATES; ADDING ARTICLE IV TO SAID CHAPTER 5 TO ESTABLISH A SPECIAL TAX ON PARCELS OF REAL PROPERTY USED OR DESIGNED FOR USE AS A WAREHOUSE, TRUCK TERMINAL, FREIGHT TERMINAL OR OTHER DISTRIBUTION FACILITY; MAKING PROVISIONS FOR THE ASSESSMENT, LEVY AND COLLECTION OF SAID TAX; ESTABLISHING A DATE FOR AN ELECTION TO BE HELD TO APPROVE THE LEVY OF SAID SPECIAL TAXES; AND DECLARING THAT SAID ORDINANCE SHALL TAKE EFFECT IMMEDIATELY" be approved? YES NO SECTION 3: The proposed ordinances are on file with the City Clerk and may be examined during regular business hours. SECTION 4: The ballots to be used at the election shall be in form and content as required by law. SECTION 5: The City Clerk is authorized, instructed and directed to procure and furnish any and all official ballots, notices, printed matter and all supplies, equipment and paraphernalia that may be necessary in order to properly and lawfully conduct the election. SECTION 6: Pursuant to Section 4000 of the Elections Code of the State of California, the election will be conducted entirely by absent voter ballots. Ballots may be submitted by mail or hand delivered but must be received by the City Clerk by 8:00 p.m. on April 14, 1998, as required by Section 4103 of the -3- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20. 21 22 23 24 25 26 27 28 Elections Code of the State of California. The City Clerk's Office at the City Hall located at 4305 Santa Fe Avenue in the City of Vernon shall remain open from 7:00 a.m. to 8:00 p.m. on election day. SECTION 7: In all particulars not recited in this resolution, the election shall be held and conducted as provided by law for holding municipal elections. SECTION 8: Notice of the time and place of holding the election is given and the City Clerk is authorized, instructed and directed to give further or additional notice of the election, in time, form and manner as required by law. SECTION 9: The City Clerk of the City of Vernon shall certify to the passage of this resolution and thereupon and thereafter the same shall be in full force and effect.
