A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF VERNON GRANTING A VARIANCE TO
SOUTHLAND BOX COMPANY FROM SECTION
26.4.2-8, DEVELOPMENT STANDARDS, OF THE
COMPREHENSIVE ZONING ORDINANCE, TO THE
PROPERTY LOCATED AT 4955 MAYWOOD AVENUE
IN THE CITY OF VERNON
WHEREAS, Southland Box Company owns the property
located at 4955 Maywood Avenue in the City of Vernon and is
requesting a variance from Section 26.4.2-8, Development
Standards, of the Comprehensive Zoning Ordinance; and
WHEREAS, the property is unique in that the existing
building measures approximately 220,000 square feet and has
thirteen non -conforming truck loading spaces measuring 10.0 feet
in width and varying in length from 40.8 feet to 52.5 feet; and
WHEREAS, Zoning Ordinance Section 26.4.2-7 (b) requires
five truck loading spaces for buildings with a gross floor area
between 100,000 and 200,000 square feet in size and one truck
loading space for each additional 100,000 square feet or fraction
thereof for a total of 6 spaces; and
WHEREAS, Zoning Ordinance Section 26.4.2-8 (c) specifies
that each truck loading space shall be a minimum of 10 feet wide
and 65 feet long, and Section 26.4.6-4 (c) provides that a non-
conforming building must comply with these standards within 5
years of April 18, 1989 unless a variance is granted; and
WHEREAS, there is insufficient space on the property
and the application of the development standards for the truck
loading space requirements will create an unreasonable hardship)
by requiring the non -conforming spaces to be 10 feet wide
1 and 65 feet long; and
2 WHEREAS, the owner of the property has indicated
3 that it has plans to alter five of the loading spaces to create
4 four conforming loading spaces, leaving eight non -conforming
5 loading spaces; and
6 WHEREAS, 4955 Maywood Avenue is located in the M
7 zone and the operation is consistent with the objectives of the
8 General Plan and Zoning Ordinance; and
9 WHEREAS, strict application of the loading area
10 requirements of Section 26.4 of the Vernon City Code would create
11 an unreasonable hardship, the existing use does not and will not
12 adversely affect the surrounding area, and the use does not
13 require the loading area specified by Section 26.4; and
14 WHEREAS, the City Council, by adoption of Resolution
15 No 6546, previously granted the,property owner a variance from
16 the requirements of Section 26.4.6-8 (c), but the rights and
17 privileges granted by that variance were not utilized by the
18 owner within the time specified in Zoning Ordinance Section
19 26.5.1-9 and
20 WHEREAS, the City Council has received an Engineer's
21 Report dated December 16, 1997, upon which it has relied in
22 making the foregoing recitals; and
23 WHEREAS, the City Council of the City of Vernon held a
24 hearing on said application for a variance on January 6, 1998.
25 NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
26 THE CITY OF VERNON AS FOLLOWS:

hereby finds and determines that the recitals contained -herein
above are true and correct
SECTION 2: A variance from Section 26.4.2-8 of the
Comprehensive Zoning Ordinance, requiring all truck loading spaces
to be 10 feet wide by 65 feet long, is hereby granted for the
parcel of property at 4955 Maywood Avenue.
SECTION 3: The variance granted is subject to the
following conditions:
(a) A total of four (4) loading spaces measuring 10.0
feet in width and 65.0 feet in length shall be constructed and
maintained on the property as shown on the owner's plan dated
October 21,_1997.
(b) The usage of the eight non -conforming truck loading
spaces shall be limited so that no truck parked at or using the
loading docks shall extend into the existing street right-of-way
as shown on the Master Plan of Streets, dated June 16, 1992.
(c) All existing and 'future tenants shall be notified
of this restriction and a condition stating this shall be placed'
in all future leases
SECTION 4: Noncompliance with these conditions shall
constitute sufficient grounds for the City Council of the City
of Vernon to void this variance and require the application of
Zoning Ordinance Section 26.4.2-8 and the authorized truck loading
space requirement.
SECTION 5: Resolution No. 6546 is hereby rescinded.
SECTION 6: The City Clerk of the City of Vernon shall

thereafter the same shall be in full force and effect.

Southland Box Company Apalication for Variance
Variance Applied for (described in detail the nature and purpose of this request for
which the premises are to be used):
To continue use of seven existing loading bays rather than increasing depth to 65' per
Comprehensive Zoning Ordinance Section 26.4.2-8, Development Standards. Southland
Box Company respectfully requests a variance to allow seven out of eleven loading bays
to remain at the lengths of 51 feet to 52.5 feet.
We have submitted plans to close one non -conforming loading dock and re -construct five
docks to create four docks of 65 feet in length. The minimum requirement is 65 feet, and
Southland Box's seven loading spaces do not conform to these standards. Once new 65
feet loading docks are constructed, the non -conforming spaces will not cause either
pedestrian or vehicular congestion. 3rh aging the spaces into compliance will have no
positive impact on traffic along Maywood Avenue.
The reasons that support this application are as follows:
(1) That special conditions and circumstances exist which are peculiar to the land,
structure, or building involved and which are not generally applicable to other
lands, structures, or buildings in the same vicinity and zone:
Southland Box Company is housed in a building originally built in 1947. The loading bays
are recessed into the building and easily accommodated all of its fleet. If Southland Box
Company will be forced to be in total compliance with the City's Zoning Ordinance, we
would have to demolish the entire building. Recessing all existing docks to 65 feet will
only create chaos in production, warehouse and shipping department near the bay area.
It is virtually impossible for the company to comply with the Comprehensive Zoning
Ordinance that requires all docks to be 65 feet in length. This is mainly due to
impossibility and monetary problem. Proposal is to recess four docks to 65 feet and
continue usage of the seven other non -conforming docks.
Southland Box submitted a similar (the same) variance to the City, which was approved.
Although, ,, did not push through with it due to the decision to propose the purchase of
Maywood Avenue. Since we were not able to realize this proposal, we would like to
continue on with the approved Zoning Variance that the City has given us in 1994.

(2) That literal interpretation of the provisions of this ordinance would deprive the
applicant of rights commonly enjoyed by other properties in the same vicinity and
zone in which the property is located, under the terms of this Chapter.
The applicant's structures met code at the time of construction. The existing, non-
conforming loading docks are adequate for the fleet of vehicles used by the company.
Other business in the area enjoy their structures, which either happened to be built to
specifications that met current code or have been granted variances as their vehicles are
not impacting circulation. Lengthening all existing bays will require major work to the
entire structure, as well as forcing rearrangement of heavy machinery. This would be
prohibitively disruptive and costly to this business and will require the facility to be closed
for a substantial period of time resulting in economic hardship to the company and its 100,
one hundred workers.
Compliance Would Create Undue Hardship
Southland Box was established approximately seven years ago. Since its inception, the
company has lost a total of close to nine million dollars. Through restructuring and cost
reductions Southland Box has managed to reduce its losses, but it is still not in a money
making position. Management is doing all it can to continue the company as a going
concern. Continued cost savings and capital investment are required to ensure the survival
of the company.
Forcing compliance with the ordinance would require an enormous expenditure, money
which the company neither has nor can .fford to spend on modifications which will have
no effect on the bottom line.
Recessing all existing eleven loading bays will also create impossibility of maneuvering
inside the plant. If Southland Box is forced to comply with the ordinance, it is very likely
that the company will be forced to close its door, resulting in the loss of jobs. Given the
fact that the non -conforming loading docks cause no material hindrance to traffic on
Maywood Avenue, in our submission it is not reasonable to force strict compliance with
the ordinanLe when doing so may result in the closure of the company. Section 26.4.6-
4(d) states:
(d) The City Council, in accordance with Section 26.5.1 (Variance), may relieve
the occupant of all or part of the provisions of the off-street parking, access and
loading requirements of this chapter if the City Council determines:
(1) The strict application of the off-street parking, access and loading
requirements of this chapter creates an unreasonable hardship;

(2) The existing use does and will not adversely affect the surrounding area;
and
(3) The use does not require the number of spaces and for area specified by
this Chapter.
(3) That Vie special conditions and circumstances do not result from actions of the
applicant:
The applicant will not interfere with travel of vehicles and pedestrians in the public right of
way, as the vehicles used by the applicant do not extend beyond the property line.
Therefore no special condition will exist.
(4) That granting the variance requested will not confer on the applicant any
special privilege that is denied by this Chapter to other lands, structures, or
buildings in the same vicinity and zone in which the property is located:
As the variance requested will not impact circulation of the city streets, no special
privilege i;, ,;anted.
No Obstruction of Traffic
The City of Vernon sent a letter to Southland Box Company in April of 1994 stating in
part:
"In an effort to improve traffic circulation within the City, minimum size guidelines
for truck loading spaces were adopted. Trucks that currently extend into the City
streets create both a pedestrian and vehicular hazard and often cause traffic
congestion burdening neighborhood business."
It is apparent from this letter that minimizing traffic congestion is one of the primary
reasons for the passing of the ordinance requiring 65 foot long loading spaces.
The minimum requirement is 65 feet. Southland Box's seeks to exempt seven loading
spaces from this standards. Five docks will be modified to create four conforming loading
docks. However, it is submitted that the non -conforming spaces do not cause either
pedestrian or vehicular congestion, and that bringing the spaces into compliance will have
no positive impact on traffic along Maywood Avenue.
Southland Box currently has a fleet of twelve trailers with tractors, seven of which are 51
feet in length; two are 56 feet in length; two are 59 feet in length; and one bobtail. When

all of these trailers with their attached tractors are parked in the loading bays, all are
within the property line and will not cross over the sidewalk.
The tractors and trailers used by Southland Box account for approximately 90% of the use
of the loading spaces, none of which extend onto Maywood Avenue and all combinations
are within the property line. Outsic ci -Tiers account for less than ten percent of the
usage. Southland Box will modify five existing loading docks to accommodate larger
trucks.
Traffic itself along Maywood Avenue is minimal. Attached as Exhibit A is a Traffic
Count survey conducted on Monday, October 19, 1992, measuring traffic traveling
southbound on Maywood, north of Fruitland. The survey shows a total of 274 vehicles
during a 24 hour period. This is in stark contrast to 3,348 and 2,668 vehicles that traveled
eastbound aad westbound respectively along Fruitland Avenue, which can hardly be said
to be a major thoroughfare. (Please see Exhibits C and D)
We have no data concerning pedestrian traffic along Maywood Avenue, but daily
observations lead us to submit that over 90% of pedestrian traffic is by our own
employees. Further, Southland Box has not received any complaints regarding any
congestion or hazard created by the non -conforming loading spaces. Nor do we have any
record of injury or accident resulting from the loading spaces.
Traffic volume to this date, both pedestrian and vehicular, along Maywood Avenue is
extremely light. Furthermore, although in isolated instances trucks do protrude across the
property line, it is our submission that they in no way interfere with traffic, cause
congestion nr create a vehicular hazard. This situation will be eliminated when four
loading docks of 65 feet length are -.onstructed. (Building plans are submitted here with)
(5) That granting of such variance will be in harmony and not adversely affect the
Comprehensive General Plan:
The existing use of the property is in conformance with the general plan. Southland Box
Company is requesting for a variance concerning the City's Zoning Ordinance. Granting
the variance ensures continuation of this use which is in concurrence.

Thank you for your response to our application for variance from Section 26.4.2-8, Development
Standards, of the Comprehensive Zoning Ordinance. My apologies for the insufficient information
of our application for variance.
The following are explanations to your inquiries on the letter dated December 3, 1997. Please refer
to the attached maps for more details.
1. The location of the proposal steel ramp and its dimensions.
The location for the proposed steel ramp will be on the west side of the
plant in between the rail road tracks and the plant. (Please refer
to red mark on Map A1)
The dimensions of the proposed steel ramp can be seen on Sheet S-2.
2. A deseription of how this steel ramp will be used.
The main use for the steel ramp is to load bale wastes into the trailer.
The forklift will lift bales and will use the steel ramp to go up the slope
until it reaches the end and drop off the bales inside the trailer.
3. A plan indicating that the dock on Fruitland Avenue will be closed.
We will not use oversize trailers that will cross over our property line of the
shipping dock located on Fruitland Avenue, but it will be used as an entrance/exit
for employees and or transporting other materials. Only trailers that does not
exceed 27 ft. in length will be used.
4. A description of how the dock on Fruitland Avenue will be closed.
As shown on the drawing, a chain -linked fenced gate will be installed within our
property line.

4955 MAYWOOD AVENUE
VARIANCE APPLICATION
DECEMBER 16, 1997
Southland Box Company has requested a variance from the
Comprehensive Zoning Ordinance Section 26.4.2-8, Development
Standards, for the property located at 4955 Maywood Avenue in the
City of Vernon.
It was previously granted a variance on December 20, 1994.
As a condition of that variance it was required to remove access
to all of its non -conforming truck loading spaces. Since that
date, Southland Box Company has been seeking other alternatives
to eliminating these loading spaces. It has now agreed to limit
the usage of any remaining non -conforming loading spaces to use
by vehicles of smaller lengths.
The building that it owns was constructed with thirteen non-
conforming truck loading spaces measuring 10.0 feet in width with
ten being 51.1 feet in length, one being 50.0 feet in length, one
being 52.5 feet in length, all located on Maywood Avenue and one
being 40.8 feet in length located on Fruitland Avenue. It has
indicated that it will reconstruct five of the loading spaces
into four conforming loading spaces, located on Fruitland Avenue.
There will be seven remaining non -conforming spaces on Maywood
Avenue being 10.0 feet in width and ranging.in length from 50.0
to 52.5 feet. The non -conforming loading space on Fruitland
Avenue is 10.0 feet in width and 40.8 feet in length and will
remain. As stated, only vehicles of smaller lengths will be used
at all of the non -conforming truck loading spaces. The building
is used for the manufacturing of paper products and is
approximately 220,000 square feet in size.
Section 26.4.2-7 (b) requires five truck loading spaces for
buildings with a gross floor area of between 100,000 and 200,000
square feet in size and one truck loading space for each
additional 100,000 square feet or fraction thereof for a total of
six spaces. Section 26.4.2-8 (c) of the Comprehensive Zoning
Ordinance specifies that each loading space shall be a minimum of
10 feet wide and 65 feet long and Section 26.4.6-4 (c) provides
that a non -conforming building must comply with these standards
within five years of April 18, 1989 unless a variance is granted.
Southland Box Company has indicated that requiring the
thirteen non -conforming truck loading spaces to be 65 feet long
by 10 feet wide would be a hardship. The operation is in
conformance with the Comprehensive Zoning Ordinance and General
Plan. Therefore, it is recommended that the variance be granted
with the following conditions:
(a) A total of (4) loading spaces measuring 10.0 feet in
width and 65.0 feet in length shall be constructed and maintained
on the property as shown on the owner's plan dated October 21,
1997.
(b) The usage of the eight non -conforming truck loading
spaces shall be limited so that no truck parked at or using the
loading docks shall extend into the existing street right-of-way
as shown on the Master Plan of Streets, dated June 16, 1992.
(c) All existing and future tenants shall be notified of
this restriction and a condition stating this shall be placed in
all future leases.
