Resolution No. 70761 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 7076 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON FUNCTIONING AS THE PLANNING AGENCY OF THE CITY OF VERNON SELECTING THE BOUNDARIES OF THE FIRST AMENDMENT PROJECT AREA TO THE INDUSTRIAL REDEVELOPMENT PROJECT AND FORMULATING, APPROVING AND ADOPTING A PRELIMINARY PLAN FOR THE REDEVELOPMENT OF THE FIRST AMENDMENT PROJECT AREA WHEREAS, the City Council of the City of Vernon by Resolution No. 7068 designated a redevelopment survey area within Ithe City of Vernon; and WHEREAS, Section 33322 of the California Community Redevelopment Law (Health and Safety Code, Sections 33000, et sea.) provides for the planning commission of the City of Vernon to select a redevelopment project area from within the boundaries of the survey area, and to formulate a preliminary plan for the redevelopment of the selected project area; and WHEREAS, Section 33008 of the Community Redevelopment Law defines the "planning commission" as used therein as the planning agency for the city established pursuant to law or charter; and WHEREAS, the City Council as authorized by Section 65100 of the California Government Code has established itself as the planning agency of the City of Vernon; and WHEREAS, a Preliminary Plan with an attached Exhibit "1" containing legal descriptions of the individual properties which are recommended to be included in the First Amendment Project Area, and an attached Exhibit 112" containing maps of the individual properties which are recommended to be included in the 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 1 18 19 20 21 22 23 24 25 26 27 28 First Amendment Project Area is being submitted to the City Council functioning as the Planning Agency of the City of Vernon for approval. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true and correct. SECTION 2: This resolution is adopted by the City Council functioning as the planning agency of the City of Vernon. SECTION 3 The City Council hereby selects the First Amendment Project Area from the boundaries of the designated redevelopment survey area, and hereby establishes as the boundaries therefor the area legally described in Exhibit 111" attached to the Preliminary Plan. Said First Amendment Project Area is also depicted in -Exhibit 112" attached to the Preliminary Plan. The Executive Director is hereby authorized to make such technical and conforming corrections to said Maps and Legal Descriptions as may be required for filing with the appropriate governmental agencies. SKW:ps Attachment cc: City Attorney STAFF REPORT RE: DETERMINATION NOT TO FORM PROJECT AREA COMMITTEE BACKGROUND: As part of the process for the proposed adoption or amendment of a redevelopment plan, the California Community Redevelopment Law requires that the redevelopment agency consult with, and obtain the advice of persons and organizations owning property, conducting business, and/or living within the proposed Project Area. One way of meeting this obligation is through the formation of a Project Area Committee, which is composed of persons and entities in the Project Area. A Project Area Committee is explicitly directed to consult on and provide advice concerning the planning and provision of residential facilities or replacement housing, or other policy matters affecting the residents of the Project Area. If it is not necessary to form a Project Area Committee, the agency may consult with and obtain advice by other means, including public meetings and other committees. On January 6, 1998, the City Council acting as the planning agency for the City of Vernon adopted and approved the Preliminary Plan for the proposed amendment of the Industrial Redevelopment Project and established the boundaries of the proposed Amendment Project Area. There are no persons residing within the proposed Amendment Project Area. The amendment of the Redevelopment Plan for the Industrial Redevelopment Project is expected to continue the authority to acquire property by eminent domain and expand that authority to the Amendment Project Area. The public projects being proposed for inclusion in the First Amendment to the Industrial Redevelopment Project are not anticipated to displace any residents. A Project Ara Committee is not required unless a substantial number of low -or moderate -income persons reside in the Project Area and the proposed project will displace them, either through acquisition or the implementation of public projects. Redevelopment Agency staff and its consultants have studied the land use character and residential profile of the proposed Amendment Project Area as well as the existing Industrial Redevelopment Project Area. At the time the Industrial Redevelopment Project was adopted, no Project Area Committee was required because the Project Area did not contain a substantial number of low -or moderate -income -persons -residing therein. Out of 1,988 acres in the original Project Area, there were only 4 residential units. There are no additional residential units within the proposed Amendment Project Area. Because there are no residential units in the proposed Amended Project Area, a Project Area Committee is not required. Instead, the Agency will consult with and obtain ,the advice of persons and organizations owning property, conducting business, and/or living within the proposed Amendment Project Area and existing Industrial Redevelopment Project Area through public meetings and hearings. DESCRIPTION OF THE BOUNDARIES OF THE PROJECT AREA The boundaries of the First Amendment to the Industrial Redevelopment Project area (the "Amendment Area") are as described in the "Description of Project Area Boundaries" attached hereto as Exhibit 1 and as shown on the "Project Area Maps" attached hereto as Exhibit 2. III. GENERAL STATEMENT OF PROPOSED LAND USES As a basis for the redevelopment of the Amendment Area, it is proposed that, in general, the land uses in the Amendment Area be as described below. The principal land use objective is to preserve manufacturing as the primary land use. There are three categories of land use proposed for the Amendment Area: General industrial. Commercial industrial. Heavy industrial. 1 The largest part of the Amendment Area is planned for general industrial use. This includes principally manufacturing, assembling, warehousing and wholesaling uses and permits public facilities. Heavy industry is to be concentrated mainly in that part of the Amendment Area north of the Los Angeles River. Commercial/industrial uses with businesses which serve the primary industrial uses are proposed to be located mostly along Santa Fe Avenue. There is no residential use within the Amendment Area and there is not proposed to be any increase in the relatively few residential dwellings in the Industrial Redevelopment Project Area; they will remain only incidental to the industrial uses. Certain specialized uses which have a significant effect on adjacent uses such as slaughtering, rendering, fertilizer production, junkyards, waste disposal and recycling facilities, and the like will be permitted in limited areas under appropriate restrictions. IV. GENERAL STATEMENT OF LAYOUT OF PRINCIPAL STREETS As a basis for the redevelopment of the Amendment Area, it is proposed that, in general, the layout of principal streets be as shown on the Industrial Redevelopment Project Area Map, including: North -South Arterial Streets ° Alameda Street ° Santa Fe Avenue ° Soto Street. Downey Road ° Atlantic Boulevard 2 Fast -West Arterial Streets Washington Boulevard Bandini Boulevard ° Slauson Avenue ° Thirty-seventh Street Thirty-eighth Street North -South Collector Streets Pacific Boulevard Boyle Avenue Fast -West Collector Streets , ° Twenty-fifth Street Twenty-sixth Street ° Fifty-first Street District Boulevard ° Vernon Avenue ° Leonis Boulevard Fruitland Avenue ° Randolph Street In addition to these surface streets, the Industrial Redevelopment Project Area is crossed in its far eastern end by the Long Beach Freeway. 3 V. GENERAL STATEMENT OF PROPOSED POPULATION DENSITIES There are no dwelling units in the Amendment Area. There are fewer than 20 scattered dwelling units in the entire Industrial Redevelopment Project Area. They are occupied predominantly by caretakers of businesses and public safety personnel of the City. For the few dwelling units in the Industrial, Redevelopment Project Area, maximum densities are one unit for 5,000 square feet for single units and one unit for 4,000 square feet for multiple units. Population is 2.5 people per dwelling unit. Neither the Amendment Area nor the Industrial Redevelopment Project Area is suitable for housing and additional housing is not planned. VI. GENERAL STATEMENT OF PROPOSED BUILDING INTENSITIES The general industrial and heavy industrial parts of the Amendment Area may have buildings on parcels with a Floor. Area Ratio of up to 2.0:1.0. Parking structures meeting City requirements would be in addition to this building area. The permitted Floor Area Ratio in the commercial/industrial area is 4.0:1.0. VII. GENERAL STATEMENT OF PROPOSED BUILDING STANDARDS As a basis for the redevelopment of the Amendment Area, it is proposed that building standards conform to the building requirements of applicable State and federal statutes and regulations and local codes and regulations. 4 VIII. ATTAINMENT OF THE PURPOSES OF THE CALIFORNIA COMMUNITY REDEVELOPMENT LAW The purposes of the California Community Redevelopment Law would be attained by the proposed redevelopment through: • Alteration, improvement, modernization, reconstruction and rehabilitation of existing obsolete and/or deteriorated industrial�sites and buildings, including unreinforced buildings; • 1Assembly of land into parcels suitable for modem industrial development with proper off street parking, loading, storage and vehicular and pedestrian circulation; • Elimination of buildings and uses for recycling of land where economics do not support the investment to upgrade deteriorated, dilapidated, or obsolete facilities; • Amelioration of hazardous substances and hazardous waste conditions at industrial plants and transportation facilities which necessitate extraordinary coordination and costs for the protection of the public health and safety; • Participation of existing owners and tenants in the revitalization and redevelopment of properties; 5 • Replanning, redesign and reconfiguration of unsafe and inefficient freeway, street and , railroad intersections (including grade separations) where necessary to provide adequate vehicular access for trucks, trains and automobiles to and from the properties they serve and through traffic; • Consolidation of rail spurs and lines and reuse of right-of-way areas for productive activities; • Replanning, redesign and upgrading of inadequate sewer, water and drainage facilities in connection with remedying obsolete site conditions; • Elimination or relocation of inappropriate land uses which are detrimental to the circulation system of the City and/or adjacent uses; • Amelioration of traffic congestion due to narrow streets, heavy truck traffic (with oversized vehicles), inadequate off --street loading and parking, and buildings located on property lines which limit street widening and/or reconfiguration of uses on the site. The City of Vernon has been an employment center for the cities which surround it. Employment in the City of Vernon has fallen from 52,900 in 1980 to 45,300 in 1997. This loss of jobs can be substantially attributed to an industrial environment in the City, and more particularly in the Industrial Redevelopment Project Area and the Amendment Area, which is less and less conducive to the needs of modern industry, less competitive with other locations in the metropolitan area and outside of it, and therefore, unable to keep many enterprises from cutting back or leaving entirely. This has resulted in a prevalence of underutilized and deteriorating properties and shifting incompatible land uses with which the infrastructure of the City is not able to cope. The State Legislature has declared that a fundamental purpose of redevelopment is "to expand employment opportunities for jobless, underemployed, and low- income persons." The City intends to address the deleterious conditions referred to above through redevelopment. IX. CONFORMANCE TO THE GENERAL PLAN An updated General Plan for the City of Vernon was adopted by the City Council of the City of Vernon by Resolution No.5609 on April 18, 1989, and amended by Resolution No. 6109 on June 16, 1992. The General Plan identified the employment objectives of the City, specified the land use mix and distribution which could achieve it, identified generally the blighting conditions in the City which would hinder attainment of the City's objectives if not ameliorated, and proposed redevelopment as a tool to solve some of the most difficult problems. The land uses, circulation facilities and other elements of infrastructure, which will be the basis for redevelopment in the Amendment Area, are consistent with those provided for in the General Plan. X. GENERAL IMPACT OF THE PROJECT UPON THE RESIDENTS AND SURROUNDING NEIGHBORHOOD There are no residents within the Amendment Area and very few within the Industrial Redevelopment Project Area. No increase in residential population is proposed. Similarly, there is not a significant number of residents in the City outside of the Amendment Area. There are some residents in adjacent cities who live near industrial facilities within the Industrial Redevelopment Project Area. Amendment of the Industrial Redevelopment Project Area.by inclusion of the Amendment Area is not expected to increase any impacts upon residents near the Amendment Area or the entire Industrial Redevelopment Project Area. There is not proposed to be any displacement of residents in the Amended Industrial Redevelopment Project Area (or . adjacent areas) as a result of the redevelopment, although isolated cases incidental to the industrial redevelopment may occur. The Industrial Redevelopment Project Area (as amended) and the City of Vernon as a whole are proposed to remain industrial. The small number of affected residents are living in the Industrial Redevelopment Project Area and adjacent parts of the City for specialized purposes and will continue to be affected by the industrial environment including traffic of trains and trucks, hazardous materials and environmental pollution, noise and vibration, an industrial type visual environment, and public facilities and services primarily intended for industrial rather than residential users. The Industrial Redevelopment Project is designed to provide increased opportunities for jobs and income which will be most convenient to residents in nearby cities. INTRODUCTION This Preliminary Plan is formulated by the City Council of the City of Vernon functioning as the planning agency of the City of Vernon (and planning commission under the California Community Redevelopment Law, Health & Safety Code, Sections 33000, et seq.). The Preliminary Plan conforms to the requirements of Section 33324 of the Community Redevelopment Law. II. DESCRIPTION OF THE BOUNDARIES OF THE PROJECT AREA The boundaries of the First Amendment to the Industrial Redevelopment Project area (the "Amendment Area") are as described in the "Description of Project Area Boundaries" attached hereto as Exhibit 1 and as shown on the "Project Area Maps" attached hereto as Exhibit 2. III. GENERAL STATEMENT OF PROPOSED LAND USES As a basis for the redevelopment of the Amendment Area, it is proposed that, in general, the land uses in the Amendment Area be as described below. The principal land use objective is to preserve manufacturing as the primary land use. There are three categories of land use proposed for the Amendment Area: General industrial. Commercial industrial. Heavy industrial. 1 The largest part of the Amendment Area is planned for general industrial use. This includes principally manufacturing, assembling, warehousing and wholesaling uses and permits public facilities. Heavy industry is to be concentrated mainly in that part of the Amendment Area north of the Los Angeles River. Commercial/industrial uses with businesses which serve the primary industrial uses are proposed to be located mostly along Santa Fe Avenue. There is no residential use within the Amendment Area and there is not proposed to be any increase in the relatively few residential dwellings in the Industrial. Redevelopment Project Area; they will remain only incidental to the industrial uses. Certain specialized uses which have a significant effect on adjacent uses such as slaughtering, rendering, fertilizer production, junkyards, waste disposal and recycling facilities, and the like will be permitted in limited areas under appropriate restrictions. 11 IV. GENERAL STATEMENT OF LAYOUT OF PRINCIPAL STREETS As a basis for the redevelopment of the Amendment Area, it is proposed that, in general, the layout of principal streets be as shown on the Industrial Redevelopment Project Area Map, including: North -South Arterial Streets ° Alameda Street ° Santa Fe Avenue ° Soto Street_ Downey Road ° . GENERAL STATEMENT OF PROPOSED POPULATION DENSITIES . There are no dwelling units in the Amendment Area. There are fewer than 20 scattered dwelling units in the entire Industrial Redevelopment Project Area. They are occupied predominantly by caretakers of businesses and public safety personnel of the City. For the few dwelling units in the Industrial Redevelopment Project Area, maximum densities are one unit for 5,000 square feet for single units and one unit for 4,000 square feet for multiple units. Population is 2.5 people per dwelling unit. Neither the Amendment Area nor the Industrial Redevelopment Project Area is suitable for housing and additional housing is not planned. VI. GENERAL STATEMENT OF PROPOSED BUILDING INTENSITIES The general industrial and heavy industrial parts of the Amendment Area may have buildings on parcels with a Floor Area Ratio of up to 2.0:1.0. Parking structures meeting City requirements would be in addition to this building area. The permitted Floor Area Ratio in the commercial/industrial area is 4.0:1.0. VII. GENERAL STATEMENT OF PROPOSED BUILDING STANDARDS As a basis for the redevelopment of the Amendment Area, it is proposed that building standards conform to the building requirements of applicable State and federal statutes and regulations and local codes and regulations. 4 VIII. ATTAINMENT OF THE PURPOSES OF THE CALIFORNIA COMMUNITY REDEVELOPMENT LAW The purposes of the California Community Redevelopment Law would be attained by the proposed redevelopment through: • Alteration, improvement, modernization, reconstruction and rehabilitation of existing obsolete and/or deteriorated industrial sites and buildings, including unreinforced buildings; Assembly of land into parcels suitable for modern industrial development with proper off street parking, loading, storage and vehicular and pedestrian circulation; • Elimination of buildings and uses for recycling of land where economics do not support the investment to upgrade deteriorated, dilapidated, or obsolete facilities; • Amelioration of hazardous substances and hazardous waste conditions at industrial plants and transportation facilities which necessitate extraordinary coordination and costs for the protection of the public health and safety; • Participation of existing owners and tenants in the revitalization and redevelopment of properties; 5 • Replanning, redesign and reconfiguration of unsafe and inefficient freeway, street and railroad intersections (including grade separations) where necessary to provide adequate vehicular access for trucks, trains and automobiles to and from the properties they serve and through traffic; • Consolidation of rail spurs and lines and reuse of right-of-way areas for productive activities; • Replanning, redesign and upgrading of inadequate sewer, water and drainage facilities in connection with remedying obsolete site conditions; • Elimination or relocation of inappropriate land uses which are detrimental to the circulation system of the City and/or adjacent uses; • Amelioration of traffic congestion due to narrow streets, heavy truck traffic (with oversized vehicles), inadequate off-street loading and parking, and buildings located on property lines which limit street widening and/or reconfiguration of uses on the site. The City of Vernon has been an employment center for the cities which surround it. Employment in the City of Vernon has fallen from 52,900 in 1980 to 45,300 in 1997. This loss of jobs can be substantially attributed to an industrial environment in the City, and more particularly in the Industrial Redevelopment Project Area and the Amendment Area, which is 0 less and less conducive to the needs of modern industry, less competitive with other locations in the metropolitan area and outside of it, and therefore, unable to keep many enterprises from cutting back or leaving entirely. This has resulted in a prevalence of underutilized and deteriorating properties and shifting incompatible land uses with which the infrastructure of the City is not able to cope. The State Legislature has declared that a fundamental purpose of redevelopment is "to expand employment opportunities for jobless, underemployed, and low- income persons." The City intends to address the deleterious conditions referred to above through redevelopment. IX. CONFORMANCE TO THE GENERAL PLAN An updated General Plan for the City of Vernon was adopted by the City Council of the City of Vernon by Resolution No.5609 on April 18, 1989, and amended by Resolution No. 6109 on June 16, 1992. The General Plan identified the employment objectives of the City, specified the land use mix and distribution which could achieve it, identified generally the blighting conditions in the City which would hinder attainment of the City's objectives if not ameliorated, and proposed redevelopment as a tool to solve some of the most difficult problems. The land uses, circulation facilities and other elements of infrastructure, which will be the basis for redevelopment in the Amendment Area, are consistent with those provided for in the General Plan. 7 X. GENERAL IMPACT OF THE PROJECT UPON THE RESIDENTS AND SURROUNDING NEIGHBORHOOD There are no residents within the Amendment Area and very few within the Industrial Redevelopment Project Area. No increase in residential population is proposed. Similarly, there is not a significant number of residents in the City outside of the Amendment Area. There are some residents in adjacent cities who live near industrial facilities within the Industrial Redevelopment Project Area. Amendment of the Industrial Redevelopment Project Area by inclusion of the Amendment Area is not expected to increase any impacts upon residents near the Amendment Area or the entire Industrial Redevelopment Project Area. There is not proposed to be any displacement of residents in the Amended Industrial Redevelopment Project Area (or . adjacent areas) as a result of the redevelopment, although isolated cases incidental to the industrial redevelopment may occur. The Industrial Redevelopment Project Area (as amended) and the City of Vernon as a whole are proposed to remain industrial. The small number of affected residents are living in the Industrial Redevelopment Project Area and adjacent parts of the City for specialized purposes and will continue to be affected by the industrial environment including traffic of trains and trucks, hazardous materials and environmental pollution, noise and vibration, an industrial type visual environment, and public facilities and services primarily intended for industrial rather than residential users. The Industrial Redevelopment Project is designed to provide increased opportunities for jobs and income which will be most convenient to residents in nearby cities.
