RESOLUTION NO. 7077
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON DETERMINING THAT A PROJECT AREA COMMITTEE
SHALL NOT BE FORMED IN CONNECTION WITH THE FIRST
AMENDMENT TO THE INDUSTRIAL REDEVELOPMENT PROJECT
WHEREAS, the City Council of
the
City of Vernon
by
Resolution No. 7068 designated a survey
area
within the City
of
J Vernon; and
WHEREAS, the City Council of the City of Vernon, acting as
the planning agency of the City of Vernon, by Resolution No. 7076
selected the boundaries of the First Amendment Project Area, adopted
a Preliminary Plan, and authorized submission of the Preliminary
Plan to the Redevelopment Agency of the City of Vernon; and
WHEREAS, the California Community Redevelopment Law (Health
and Safety Code, Section 33000, et sea.) requires that a project
area committee be formed in a redevelopment project area in either
of the following situations:
(1) a substantial number of low-income persons or
moderate -income persons, or both, reside within the project area,
and the redevelopment plan as adopted will contain authority for the
agency to acquire, by eminent domain, property on which any persons
reside; or
(2) the redevelopment plan as adopted contains one or more
public projects that will displace a substantial number of low-
income persons or moderate -income persons, or both; and
WHEREAS, Section 33385(f) of the California Redevelopment
Law also requires that if the project area does not contain a
substantial number of low and moderate income individuals, the
Agency shall consult with and obtain the advice of residents and
1 community organizations concerning those policy matters which deals
2 with the planning and provision of residential facilities or
3 replacement housing for those to be displaced by project activities,
4 if any, as well as on other policy matters which affect the
5 residents of the project, and further requires that the proposed
6 Redevelopment Plan be provided to such residents and community
7 organizations prior to submitting it to the City Council; and
8 WHEREAS, because neither the Industrial Redevelopment
9 Project Area nor the proposed First Amendment Project Area contains
10 a substantial number of low-income or moderate -income persons
11 residing within their respective boundaries, adoption and
12 implementation of the First Amendment to the Industrial
13 Redevelopment Plan will not result in the displacement of a
14 substantial number of low- or moderate -income persons, either
15 through Agency property acquisition or through public projects
16 implemented by the Agency.
17 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
18 CITY OF VERNON AS FOLLOWS:
19 SECTION 1: The City Council of the City of Vernon hereby
20 finds and determines that the recitals contained hereinabove are
21 true and correct.
22 SECTION 2: The City Council hereby finds and determines
23 that a substantial number of low- or moderate -income individuals do
24 not reside in the proposed First Amendment Project Area, or in the
25 Proposed Amendment Project Area combined with the existing
26 Industrial Redevelopment Project Area, that adoption and
27 implementation of the First Amendment to the Industrial
28 Redevelopment Plan will not result in the displacement of a

substantial number of low- or moderate -income persons, either
through Agency property acquisition or through public projects
implemented by the Agency, and that formation of a project area
committee is not required. The City Council further determines that
a project area committee shall not be formed in connection with the
I First Amendment to the Industrial Redevelopment Project.
SECTION 3: The Redevelopment Agency of the City of Vernon
is hereby authorized and directed to consult with and obtain the
advice of residents, property owners, businesses, and community
organizations within the Industrial Redevelopment Project Area and
First Amendment Project Area, and to provide such residents,
property owners, businesses and community organizations with the
proposed First Amendment to the Industrial Redevelopment Plan prior
to its submission to the City Council.
SECTION 4: The City Clerk of the City of Vernon shall
certify to the passage of this resolution, and thereupon and
thereafter the same shall be in full force and effect.
