RESOLUTION NO. 7079
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON APPROVING AND AUTHORIZING THE EXECUTION
OF AMENDMENT NO. 1 TO THE PROFESSIONAL SERVICES
AGREEMENT BY AND BETWEEN THE CITY OF VERNON AND
AUSTIN-FOUST ASSOCIATES, INC.
WHEREAS, the City of Vernon ("City") and Austin -Foust
Associates, Inc. ("Consultant") are parties to a Professional
Services Agreement ("Agreement") dated October 16, 1997, approved
by Council Resolution No. 7041; and
WHEREAS, City and Consultant desire to amend the
Agreement to expand the scope of work to be performed by
Consultant and to provide Consultant with additional compensation
therefor.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon does
hereby find and determine that the recitals contained hereinabove
are true and correct.
SECTION 2: The City Council of the City of Vernon hereby
approves Amendment No. 1 to Professional Services Agreement, a
copy of which has been presented to the City Council concurrently
with this resolution, and the City Council hereby orders said
Agreement to be received and filed by the City Clerk.
SECTION 3: The City Council of the City of Vernon hereby
authorizes the Mayor and the City Clerk to execute said Agreement
for, and on behalf of, the City of Vernon.

SECTION 4: The City Clerk of the City of Vernon shall
certify to the passage of this resolution and thereupon and
thereafter the same shall be in full force and effect.

RECITALS
WHEREAS, City and Consultant are parties to a
Professional Services Agreement ("Agreement") dated October 16,
1997; and
WHEREAS, City and Consultant intend this Amendment to
expand the scope of work to be performed by Consultant and to
provide Consultant with additional compensation for such work.
NOW, THEREFORE, THE PARTIES HERETO DO MUTUALLY AGREE AS
SET FORTH HEREIN:
SECTION 1. The scope of work to be performed by
Consultant under the Agreement is expanded to include additional
services as an expert in connection with proceedings before the

California public Utilities Commission related to expansion of
trucking facilities at Hobart Yard, including, without limitation,
providing deposition testimony and appearing before the Public
Utilities Commission.
SECTION 2. Consultant shall receive additional
compensation in an amount not to exceed Five Thousand Dollars and
No Cents ($5,000.00) for the work described in the preceding
paragraph.
SECTION 3. In all other respects the Agreement shall
remain in full force and effect.
IN WITNESS WHEREOF, the City and the Consultant have
executed this Agreement as of the date first hereinabove set
forth.
