A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF VERNON GRANTING A
VARIANCE TO RANCHO FOODS, INC. FROM
SECTION 26.4.2-8, DEVELOPMENT
STANDARDS, OF THE COMPREHENSIVE
ZONING ORDINANCE, FOR THE PROPERTY
LOCATED AT 4201 FRUITLAND AVENUE IN
THE CITY OF VERNON
WHEREAS, Rancho Foods, Inc. owns the property
located at 4201 Fruitland Avenue in the City of Vernon and
is requesting a variance from Section 26.4.2-8, Development
Standards, of the Comprehensive Zoning Ordinance; and
WHEREAS, the property is unique in that the
existing building measures approximately 22,845 square feet,
has ten conforming truck loading spaces, and contains both
processing and distribution operations; and
WHEREAS, Zoning Ordinance Section 26.4.2-7 (b)
requires one truck loading spaces for buildings with a gross
floor area of 8,000 square feet or less in size; and
WHEREAS, Zoning Ordinance Section 26.4.2-8 (c)
specifies that each truck loading space shall be a minimum
of 10 feet wide and 65 feet long; and
WHEREAS, Rancho Foods intends to separate and move
the processing operation to a 1,000 square foot room in the
southeast corner of the building, but there is insufficient
space on the property to provide a conforming truck loading
space for the separated processing operation, and the
application of the development standards for the truck
loading space requirements will create an unreasonable
hardship by requiring modification to the building which are

not practical or feasible; and
WHEREAS, the owner of the property has requested
permission to re -open an existing non -conforming loading
space on Fruitland Avenue to facilitate movement of product
between the processing and distribution operations, which
space will be 10.0 feet wide and 30.0 feet long; and
WHEREAS, Rancho Foods, Inc. has requested this
variance for a period of five years during which time it
intends to evaluate future needs and construct a new
facility that will be in compliance with the Comprehensive
Zoning Ordinance; and
WHEREAS, 4201 Fruitland Avenue is located in the M
zone and the operation is consistent with the objectives of
the General Plan and Zoning Ordinance; and
WHEREAS, strict application of the loading space
requirements of Section 26.4.2-8(c) of the Vernon City Code
would create an unreasonable hardship, the existing use does
not and will not adversely affect the surrounding area, and
the use does not require the loading area specified by
Section 26.4.2-8(c); and
WHEREAS, the City Council has received a Staff
Report dated January 26, 1998, upon which it has relied in
making the foregoing recitals; and
WHEREAS, the City Council of the City of Vernon
held a hearing on said application for a variance on March
3, 1998.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF VERNON AS FOLLOWS:

SECTION 1: The City Council of the City of Vernon
hereby finds and determines that the recitals contained
herein -above are true and correct.
SECTION 2: A variance from Section 26.4.2-8 of
the Comprehensive Zoning Ordinance, requiring all truck
loading spaces to be 10 feet wide by 65 feet long, is hereby
granted for the parcel of property at 4201 Fruitland Avenue.
SECTION 3: The variance granted is subject to the
following conditions:
(a) The usage of the non -conforming truck loading
space shall be limited so that no truck parked at or using
the loading dock shall extend into the street right-of-way
as shown on the Master Plan of Streets, dated June 16, 1992.
(b) All existing and future tenants shall be
notified of this restriction and a condition stating this
shall be placed in all future leases.
(c) Rancho Foods, Inc. shall seal the non-
conforming truck loading dock by March 3, 2003, at which
time the Variance will expire.
(d) Use of the non -conforming truck loading dock
shall be limited to movement of product between the
distribution and processing operations.
SECTION 4: Noncompliance with these conditions
shall constitute sufficient grounds for the City Council of
the City of Vernon to void this variance and require the
application of Zoning Ordinance Section 26.4.2-8 and the
authorized truck loading space requirement.

thereupon and thereafter the same shall be in full force and

Private and Deed, Restrictions
There are no private or deed restrictions controlling the use of this property.
Reason for Variance Application
We would like to reopen a dock high door on the south east portion of the
building which does not have the required docking maneuvering ability space.
We would be backing in off of Fruitland Avenue. We would like to do this for the
purpose of separating our U.S.D.A. Processing from our Distribution Operation
which is now currently together. To do this we need physical separation. That
dock high door would be the area used for bobtail truck access only to the
U.S.D.A. Processing Area if variance is approved.
Notice to Applicant Responses
(1) We feel that this is a hardship to the owner occupied company. Because we
would only like to have a small portion of our building be U.S.D.A. approved
That area would need to have dock high access. At this time our whole
building is U.S.D.A. approved and our operation is 98 percent box in -box out
but we have about 2 percent of our business that still requires us to be
U.S.D.A. approved. With the changing U.S.D.A. regulations pertaining to
HACCAP (Hazard Analysis Critical Contact Points) being implemented. We
feet that we are at the mercy of the U.S.D.A. in our whole facility when we
only require -about approximately 1000 square feet of space. For Example:
On February 19, 1997 a U.S. D.A. Inspector shutdown our operation because
they found a piece of " foreign matter " % " in size in a bin of product. It would
have been very easy for us (meaning the U.S.D.A. Inspector and Rancho
Foods Processing Personnel)to identify and correct the problem, But instead
the U.S.D.A. Inspector stopped 70 employees from working for 3 Y2 hours.
We feel we were held hostage and that is our reasoning for wanting to isolate
the area of our building that is U.S.D.A. approved. That would only make a
small portion of our facility U.S.D.A. inspected. Our second alternative is to
farm out the U.S.D.A. needed work to another facility. But then that would put
us in a very awkward position of having to eliminate 8 employees jobs who
have worked for Rancho Foods for many years. Instead by isolating the
U.S.D.A. in that small area requiring the dock high door and changing the
rest of the facility to Non U.S. D.A. if that same scenario was to occur it would
not halt all 70 of our employees from work. There mould only be 8 employees
stopped and the Box In -Box Out operation would not be affected.
(2) There are other properties that have been granted the same variance for
using a dock door with less than 105 Feet of clearance from the side walk by
using smaller vehicles.
(3) There is no special conditions or circumstances because this is the way that
the building was constructed and there was a dock high door there
previously.
(4) Other properties have had similar variance requests.
(5) By agreeing to use only smaller trucks (trucks that may back into that dock
space shall not obstruct the sidewalk, driveway or street flow of traffic on
Fruitland Avenue.
In laymen terms. We would like this variance to be granted so that we would be
able to separate our Distribution Operation from our U.S.D.A. Operations. The
cost of the U.S.D.A. shutdown for 70 employees was estimated at about $
875.00 an hour. If the variance is not granted we would be forced to shutdown
the U.S.D.A. Operations in the facility and 8 employees will be terminated from
their positions whom which have worked here for many years. If Rancho Foods
does not own a vehicle that complies with the needs of the variance. Rancho
Foods shall agree to purchase a vehicle that shall comply. We think that a
variance granted for five years would allow us enough time to decide and make
new improvements to the existing facility to comply with the city ordinances.

Rancho Foods, Inc. has submitted a complete application for
a variance. It is requesting a variance from the Comprehensive
Zoning Ordinance, Section 26.4.2-8, Development Standards, for
the building located at 4201 Fruitland Avenue. The building
currently has ten conforming truck loading spaces. It is
proposing to utilize one non -conforming truck loading space
measuring 10.0 feet in width and approximately 30.0 feet in
length. It is willing to restrict the length of the vehicles
that will use the non -conforming loading space to avoid extending
into the street right-of-way.
Herewith is the following evidence:
1. Application for variance.
2. Original Notice of Public Hearing, copies of
notification letters to owners and tenants in the area
and affidavits of posting and mailing.
3. Rescheduled Notice of Public Hearing, copies of
notification letters to owners and tenants in the area

4. Staff report.
It is recommended that the variance be granted with the following
conditions:
(a) The usage of the non -conforming truck loading space
shall be limited so that no truck parked at or using the loading
dock shall extend into the street right-of-way as shown on the
Master Plan of Streets, dated June 16, 1992.
(b) All existing and future tenants shall be notified of
this restriction and a condition stating this shall be placed in
all future leases.
(c) Rancho Foods, Inc. shall seal the non -conforming truck
loading dock by March 3, 2003, at which time the Variance will
expire.

RANCHO FOODS, INC.
4201 FRUITLAND AVENUE
VARIANCE APPLICATION
January 26, 1998
Rancho Foods, Inc. has requested a variance from the
Comprehensive Zoning Ordinance Section 26.4.2-8, Development
Standards, for the property located at 4201 Fruitland Avenue in
the City of Vernon. The building that it owns has ten conforming
truck loading spaces. The building is used as a meat processing
and distribution facility and is approximately 22,845 square
feet. They are proposing to utilize one non -conforming loading
space that had previously been blocked.
Currently, Rancho Foods, Inc. operates both their processing
and distribution operations within one continuous building. In
the event that a USDA inspector temporarily stops the processing
of meat, the distribution facility is also stopped because it is
within the same area as the processing facility. The entire
business comes to a temporary halt every time the processing
facility is suspended by a USDA inspector. The facility has been
temporarily suspended approximately three times during the past
year. As a result, 70 employees were kept from working for a
minimum of three hours during each occurrence, causing lost wages
for employees and productive man hours for Rancho Foods, Inc.
The USDA is only required to inspect the processing
activities, but since the processing and distribution activities

are currently combined, USDA inspectors have access to the
distribution as well as the processing. Because of this, USDA
inspectors can and do inspect the distribution activities even
when they are not required to. In order to remedy this
situation, Rancho Foods, Inc. is proposing to relocate its
processing activities to the south east portion of their building
in a 1,000 square foot room completely separate from the
distribution activities. This processing facility will require a
loading dock to transport the processed meat to the distribution
facility. To do this, a variance is being requested to re -open a
non -conforming loading space at the southeast corner of their
facilities. The proposed loading space will be 10.0 feet wide
and 30.0 feet long, located on Fruitland Avenue. Therefore, with
approval of this variance, future USDA inspector closures would
be limited to the processing facility, allowing distribution to
function as scheduled, keeping employees working and the company
productive. Due to the financial hardship caused by these USDA
closures, if Rancho Foods, Inc. is not granted this Variance they
have stated that they would close down their processing facility.
This in turn would lead to the termination of eight meat
processing employees that have been with the company for many
years.
Rancho Foods, Inc. has requested this variance for a limited
five year period. In this time, they will evaluate future
expansion of the company and construct a new facility on the
property complying with all provisions of the Comprehensive
Staff Report.wpd
Zoning Ordinance. Rancho Foods, Inc. has stated only vehicles of
smaller lengths will be used at the non -conforming truck loading
space to ensure that vehicles will not extend into the street
right-of-way while in the loading space.
Staff finds the following to be true:
a) The previously explained hardships surrounding the
applicants situation are unique in that other properties in the
area do not have the same hardships.
b) This variance will not adversely affect the interest of
the public or the interests of other residents and property
owners within the vicinity of the premises. The property
neighboring Rancho Foods, Inc. was granted a similar variance
that approved the existence of a non -conforming loading space on
Fruitland. There have been no complaints of this variance from
nearby property owners nor has it caused any adverse affects to
the public.
c) As mentioned earlier Rancho Foods, Inc. has stated only
vehicles of smaller lengths will be used at the non -conforming
truck loading space to ensure that vehicles will not extend into
the street right-of-way while in the loading space. As long as
Rancho Foods, Inc. complies to this restriction than they will be
consistent with the objectives of the Comprehensive Zoning
Ordinance and the General Plan.
d) The basis of granting this variance to Rancho Foods,
Inc., is that they have physical limitations on the property that
make it financially infeasible to comply with the Comprehensive
Staff Report.wpd
Zoning Ordinance, and if the variance is not granted it would
cause significant financial hardship. The granting of this
variance will not constitute the granting of a "special
privilege" inconsistent with the limitation on other nearby
properties.
Section 26.4.2-8 (c) of the Comprehensive Zoning Ordinance
specifies that each loading space shall be a minimum of 10 feet
wide and 65 feet long. Section 26.4.2-7 requires that the
facility provide two truck parking spaces and two truck loading
spaces. Rancho Foods, Inc. has more than the required number of
loading spaces and all but the proposed space are consistent in
size and shape with Section 26.4.2-8 (c) of the Comprehensive
Zoning Ordinance. Therefore, it is recommended that the variance
be granted with the following conditions:
(a) The usage of the non -conforming truck loading space
shall be limited so that no truck parked at or using the loading
dock shall extend into the street right-of-way as shown on the
Master Plan of Streets, dated June 16, 1992.
(b) All existing and future tenants shall be notified of
