A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF VERNON GRANTING A
VARIANCE TO JIAN JIONG DENG FROM
SECTION 26.4.2-8(d), DEVELOPMENT
STANDARDS FOR AUTOMOBILE PARKING
LAYOUTS, OF THE COMPREHENSIVE ZONING
ORDINANCE FOR THE PROPERTY LOCATED AT
3620 SANTA FE AVENUE IN THE CITY OF
VERNON
WHEREAS, Jian Jiong Deng owns a parcel of property
located at 3620 Santa Fe Avenue in the City of Vernon and
has requested a variance from conformance with Section
26.4.2-8(d), Development Standards for Automobile Parking
Layouts, of the Comprehensive Zoning Ordinance; and
WHEREAS, Jian Jiong Deng proposes to use the
building for garment manufacturing purposes and the building
was constructed with two non -conforming truck loading spaces
and does not comply with automobile parking requirements;
and
WHEREAS, the building has been vacant for a
continuous period greater than one year and Zoning Ordinance
Section 26.4.6-7 specifies that a building which has been
vacant for a continuous period greater than one year shall
not be occupied except in the case that it has been brought
into conformity with all regulations; and
WHEREAS, the existing building on the property
measures approximately 6,469 square feet and proposing to
construct approximately 1,331 square feet of office area,
and pursuant to Zoning Ordinance Section 26.4.2-7 (a) such
use requires one truck parking space per every 10,000 square
1 feet of gross floor area of a manufacturing use and pursuant
2 to Zoning Ordnance Section 26.4.2-7 (b) such use requires
3 one truck loading space for buildings with a gross floor
4 area under 8,000 square feet in size; and
5 WHEREAS, Zoning Ordinance Section 26.4.2-6
6 specifies that one automobile parking space be provided for
7 every 1,000 square feet of gross floor area for an
8 industrial use and one automobile parking space be provided
9 for every 500 square feet of gross floor area for an office
10 use and the building as modified will require seven
11 automobile parking spaces; and
12 WHEREAS, Jian Jiong Deng has indicated that he
13 intends to alter the building configuration such that 800
14 square feet of the building will be converted into a truck
15 well to provide adequate truck parking and loading and
16 reducing the overall automobile parking requirement; and
17 WHEREAS, the submitted site plan does not conform
18 with the provisions of the Comprehensive Zoning Ordinance
19 Section 26.4.2-8 (d) that specifies the minimum aisle length
20 for automobile maneuvering but provides wider parking stalls
21 to compensate for the shorter aisle width; and
22 WHEREAS, 3620 Santa Fe is located in the CM zone
23 and the garment manufacturing use is consistent with the
24 General Plan and Zoning Ordinance; and
25 WHEREAS, the circumstances surrounding the
26 applicant's situation are unique in that other properties in
27 the area do not have the same physical constraints that
28 preclude installation of automobile parking stalls with a

maneuvering aisle conforming to Section 26.4.2-8(d), and
such circumstances create a hardship to the applicant and
justify the granting of a variance in that the applicant
would be deprived of all productive use of his building
because it is infeasible to provide the required maneuvering
aisle with the required width of 27 feet, while it is
feasible to provide a maneuvering aisle of 24.5 feet; and
WHEREAS, the variance will not adversely affect
the interests of the public or the interests of other
residents and property owners within the vicinity of the
premises, the proposal is consistent with the objectives of
the general plan and zoning ordinance, and the granting of a
variance will not constitute the granting of a special
privilege in that the effects, if any, of the decreased
width of the maneuvering aisle will be confined to the
property, and the applicant will be required to install and
maintain parking stalls that are wider than required under
Section 26.4.2-8(d) to compensate for the decreased
maneuvering aisle and provide the functional equivalent of a
conforming parking layout; and
WHEREAS, the City Council has received a Staff
Report dated April 20, 1998, upon which it has relied in
making the foregoing recitals; and
WHEREAS, the City Council of the City of Vernon
held a hearing on said application for a variance on April
28, 1998.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF VERNON AS FOLLOWS:

SECTION 1: The City Council of the City of Vernon
hereby finds and determines that the recitals contained
herein -above are true and correct.
SECTION 2: A variance from Section 26.4.2-8(c) of
the Comprehensive Zoning Ordinance, establishing standards
for parking stalls and maneuvering aisles is hereby granted
for the parcel of property at 3620 Santa Fe Avenue.
SECTION 3: The variance granted is subject to the
following conditions:
(a) Prior to occupancy the occupant shall obtain
a Certificate of Occupancy. The occupant shall comply with
all conditions as determined by the City of Vernon as part
of the required occupancy inspection. These conditions
shall include, but not be limited to, requirements for
exiting, ADA accessibility and structural integrity of the
building.
(b) The building and parking area shall be
modified and maintained in accordance with the plans dated
March 26, 1998 submitted as a part of this variance
application.
(c) The use of the building shall be limited so
as not to require more than seven automobile parking spaces.
(d) Signs shall be posted at the driveway
entrance giving notice of the truck size restriction and a
covenant shall be recorded by the property owner which
restricts the length of trucks entering the property as
required by the Comprehensive Zoning Ordinance Section
26.4.2-9 (a).

(e) All future tenants shall be notified of this
restriction and a condition stating this shall be placed in
all future leases.
(f) The entire building, including all proposed
modifications, shall be brought into conformance with all
current codes.
SECTION 5: The City Clerk of the City of Vernon
shall certify to the passage of this Resolution and
thereupon and thereafter the same shall be in full force and
effect.

VARIANCE APPLICATION
April 20, 1998
Jian Jiong Deng has requested a variance from the
Comprehensive Zoning Ordinance Section 26.4.2-8(d), Development
Standards for Automobile Parking Layouts, for the property
located at 3620 Santa Fe Avenue. Jian Jiong Deng is the owner of
the property which has been vacant for a continuous period
greater than one year. Section 26.4.6-7 requires that the
building shall not be occupied except in the case that it has
been brought into conformity with all regulations of the zone in
which it is located. With one exception, the owner's development
proposal would bring the property into conformity with the
applicable regulations. The exception involves the required
maneuvering aisle for automobile parking, thus prompting this
variance application.
The existing building is approximately 6,469 square feet in
size on a lot of approximately 9,375 square feet. In order for
the owner to fully comply with the automobile parking and
maneuvering requirements of the Comprehensive Zoning Ordinance, a
significant portion of the building would need to be demolished.
The most efficient way for the owner to provide the required
parking is to have two rows of parking (19 feet each) split by a

maneuvering aisle (27 feet). The width of the property is 62.5
feet. The owner is proposing to provide the required truck
parking and loading spaces within the building and utilize the
existing parking lot by reducing the aisle width from the
required 27 feet to 24.5 feet. To compensate for this shortened
maneuvering aisle, the owner has proposed to widen each
automobile parking space from the required 8.5 feet to 9 feet 4
inches. In effect, the proponent is providing a larger turning
radius for the automobiles to enter and exit the parking stalls
to compensate for the shorter aisle width. The Community
Services Department has determined that the additional width will
allow the vehicles to enter and exit the parking stalls and that
the parking arrangement is consistent with parking provisions of
neighboring communities.
Comprehensive Zoning Ordinance Section 26.4.2, Off-street
Parking and Loading Facilities, specifies that the facility is
required to have 7 automobile parking spaces, 1 truck loading
space, and 1 truck parking space. The proposed site complies to
this section by providing 7 automobile parking spaces, 1 truck
loading spaces and 1 truck parking space. Therefore, the
proposed project complies with the required number of automobile
and truck, parking and loading spaces as stated by the
Comprehensive Zoning Ordinance.
The building is 6,469 square feet in gross floor area.
Therefore, it can utilize the Optional Exceptions to Development
Standards for Truck Parking and Loading as provided in Section
-2-
26.4.2-9. This section states that a building used for
manufacturing or warehousing uses less than 12,000 square feet in
gross floor area may provide truck loading spaces 10 feet in
width, 40 feet in length and 15 feet in height and may utilize
the width of a public or private alley to satisfy a portion of
the 40 foot unobstructed maneuvering space. The owner is
proposing to construct one truck loading space and one truck
parking space that meet these requirements. The roof height
currently allows spaces only 12 feet high. As a condition of the
variance, the roof shall be modified so as to allow for the 15-
foot high truck loading and parking spaces. The building along
with this improvement shall be analyzed to ensure that it
complies with the requirements of the current Uniform Building
Code. This shall include being analyzed by a structural engineer
to ensure compliance with all structural and seismic design
requirements of the current Uniform Building Code prior to the
issuance of any permit for proposed modifications or occupancy.
Based upon the foregoing, staff believes the City Council
can make the following findings:
a) The circumstances surrounding the applicant's situation
are unique in that other properties in the area do not have the
same physical constraints that preclude installation of
automobile parking stalls with a maneuvering aisle conforming to
Section 25.4.2-8(d), and such circumstances create a hardship to
the applicant and justify the granting of a variance in that the
applicant would be deprived of all productive use of his building

merely because it is infeasible to provide the required
maneuvering aisle with the required width of 27 feet, while it is
feasible to provide a maneuvering aisle of 24.5 feet.
b) The variance will not adversely affect the interests of
the public or the interests of other residents and property

at 3620 Santa Fe Avenue in the City of Vernon. The applicant,
Jan Jiong Deng is requesting a variance to allow the use of a
shorter maneuvering aisle for automobile parking.

7:15 a.m. and 5:15 p.m. Monday through Thursday.

Jian Jiong Deng has requested a�°variance from the Comprehensive
Zoning Ordinance Section 26.4.2-8(d), Development Standards for
Automobile Parking Layouts, for the property located at 3620
Santa Fe Avenue. Jian Jiong Deng is the owner of the property
which has been vacant for a continuous period greater than one
year. Section 26.4.6-7 requires that the building shall not be
occupied except in the case that it has been brought into
conformity with all regulations of the zone in which it is
located. With one exception, the owner's development proposal
would bring the property into conformity with the applicable
regulations. The exception involves the required maneuvering
aisle for automobile parking, thus prompting this variance
application.
Herewith is the following evidence:
1. Staff report.
2. Application for variance.
3. Notice of Public Hearing, copies of notification
letters to owners and tenants in the area and
affidavits of posting and mailing
It is recommended that the variance be granted with the following
conditions:

a. Prior to occupancy, the occupant shall obtain a
Certificate of Occupancy. The occupant shall comply with all
conditions as determined by the City of Vernon as part of the
required occupancy inspection. These conditions shall include,
but not be limited to, requirements for exiting, ADA
accessibility and structural integrity of the building.
b. The building and parking area shall be modified and
maintained in accordance with the plans dated March 26, 1998,
submitted as a part of this variance application.
C. The use of the building shall be limited so as not
to require more than seven automobile parking spaces.
d. Signs shall be posted at the driveway entrance
giving notice of the truck size restriction and a covenant must
be recorded by the property owner which restricts the length of
trucks entering the property as required by the Comprehensive
Zoning Ordinance Section 26.4.2-9(a).
e. All future tenants shall be notified of this
restriction and a condition stating this shall be placed in all
future leases.
f. The entire building, including all proposed
modifications, shall be brought into conformance with all current
codes.
