Resolution No. 71151 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 7115 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON RECITING THE FACT OF THE GENERAL MUNICIPAL ELECTION HELD ON APRIL 14, 1998, DECLARING THE RESULT THEREOF AND SUCH OTHER MATTERS AS PROVIDED BY LAW WHEREAS, a general municipal election was held and conducted in the City of Vernon, California on Tuesday, April 14, 1998, as required by and WHEREAS, pursuant to Resolution No. 7051, adopted December 2, 1997, and Resolution No. 7069, adopted January 6, 1998, the election was conducted entirely by mail ballot pursuant to Section 4000, et sea., of the Elections Code of the State of California; and WHEREAS, notice of the election was given in the time, form and manner required by law; and WHEREAS, election officers were appointed, mail ballots were properly sent to all registered voters, and in all respects the election was held and conducted, the votes were cast, received and canvassed, and the returns were made and declared in the time, form and manner required by the City Charter and the Elections Code of `the State of California; and WHEREAS, pursuant to Resolution No. 7083 adopted February 3, 1998, as amended by Resolution No. 7102 adopted March 24, 1998, the City Clerk was ordered to canvass the returns of the election and the City Clerk has certified the results to the City Council, which certification and results are received, attached and made part hereof as Exhibit "A". NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 4.1 SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true and correct. SECTION 2: One (1) voting precinct was established for the purpose of holding said election consisting of the regular election precinct in the City as established for the holding of State and County elections. SECTION 3: The whole number of votes cast by mail ballots in the City was forty (40). SECTION 4: The names of persons voted for at the election for Member of the City Council are as follows: William M. McCormick Leonis C. Malburg Thomas A. Ybarra SECTION 5: The measures voted upon at the election were as follows: MEASURE A Shall an ordinance entitled "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF VERNON ADDING ARTICLE II TO CHAPTER 5 TO THE CODE OF THE CITY OF VERNON, CALIFORNIA, 1959, RELATIVE TO BUSINESS LICENSE TAXES AND FEES, ESTABLISHING A DATE FOR AN ELECTION TO BE HELD TO APPROVE THE LEVY OF THE BUSINESS LICENSE TAXES CONTAINED HEREIN; AND DECLARING THAT SAID ORDINANCE SHALL TAKE EFFECT IMMEDIATELY" be approved and adopted? -2- YES NO 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 MEASURE B Shall an ordinance entitled "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF VERNON ADDING ARTICLE III TO CHAPTER 5 OF THE CODE OF THE CITY OF VERNON, CALIFORNIA, 1959, AND RENUMBERING AND RECODIFYING SECTIONS 15.36 THROUGH 15.38 AS SECTIONS 5.35 THROUGH 5.39 OF SAID ARTICLE III; ADDING SECTION 5.40 TO SAID ARTICLE III RELATIVE TO ANNUAL ADJUSTMENT OF TAX RATES; ADDING ARTICLE IV TO SAID CHAPTER 5 TO ESTABLISH A SPECIAL TAX ON PARCELS OF REAL PROPERTY USED OR DESIGNED FOR USE AS A WAREHOUSE, TRUCK TERMINAL, FREIGHT TERMINAL OR OTHER DISTRIBUTION FACILITY; MAKING PROVISIONS FOR THE ASSESSMENT, LEVY AND COLLECTION OF SAID TAX; ESTABLISHING A DATE FOR AN ELECTION TO BE HELD TO APPROVE THE LEVY OF SAID SPECIAL TAXES; AND DECLARING THAT SAID ORDINANCE SHALL TAKE EFFECT IMMEDIATELY" be approved? �_`_ay NO SECTION 6: The number of votes given in the City for and against each measure and for each candidate are as listed in Exhibit "A" attached. SECTION 7: The City Council does declare and determine Ithat: William M. McCormick was elected as Member of the City Council for the term of four (4) years and until a successor qualifies, as provided in Ch: 3.4 of the City Charter; Leonis C. Malburg was elected as Member of the City Council for the term of four (4) years and until a successor qualifies, as provided in Ch: 3.4 of the City Charter; Thomas A. Ybarra was elected as Member of the City Council for the term of four (4) years and until a successor qualifies, as provided in Ch: 3.4 of the City Charter. SECTION 8: The City Council does declare and determine (that as a result of the general municipal election, a two-thirds -3- 1 2 3 4 5 6 7 8 PI 10 11 12 13 14 15 16 17 Ftl 0 VI 20 21 22 23 24 25 26 27 28 (2/3) majority of the voters voting on the above Measure A did vote in favor of it, and the measure was carried, and shall be .deemed approved and adopted. SECTION 9: The City Council does declare and determine that as a result of the general municipal election, a two-thirds (2/3) majority of the voters voting on the above Measure B did vote in favor of it, and the measure was carried, and shall be deemed approved and adopted. SECTION 10: The City Clerk shall enter on the records of the City Council of the City, a statement of the result of the election, showing: (1) The whole number of votes cast in the City; (2) The names of the persons voted for; (3) The measure voted upon; (4) The office each person was voted for; and (5) The total number of votes given in the City to each person and for and against each measure. SECTION 11: The City Clerk of the City of Vernon shall certify to the passage of this resolution, and thereupon and thereafter the same shall be in full force and effect.
