RESOLUTION NO. 7125
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF VERNON AWARDING A CONTRACT TO DE LA CRUZ
CONSTRUCTION, INC. FOR VERNON GAS DISTRIBUTION
SYSTEM PHASE III IN ACCORDANCE WITH CONTRACT
NO. 540 OF THE CITY OF VERNON AND APPROVING
THE EXECUTION OF SAID CONTRACT
WHEREAS, on October 21, 1997, Contract No. 539 was
awarded by the City Council of the City of Vernon to De La Cruz
Construction, Inc., for Vernon Gas Distribution System Phase II
based upon a bid in the sum of $4,054,626. 70, that being the
lowest responsible bid meeting contract requirements; and
WHEREAS, the performance of De La Cruz Construction,
lInc. on Phase II has been highly satisfactory; and
WHEREAS, the Department of Community Services and Water
lhas developed bid specifications for Vernon Gas Distribution
System Phase III, which are contained in Contract No. 540; and
WHEREAS, the Phase III project is a continuation of the
(Phase II project, involving the same construction techniques, some
of which are highly technical and specialized; and
WHEREAS, De La Cruz Construction, Inc. has provided the
ICity with a proposal dated April 27, 1998 (the "Proposal"),
indicating it is willing to perform the work required by Contract
No. 540 for the total sum of Four Million Nine Hundred Twenty-
seven Thousand Nineteen Dollars and Eight Cents ($4,927,019.08),
which is based upon unit prices that are more favorable to the
City than the bid awarded to De La Cruz Construction, Inc. for
Phase II; and
WHEREAS, Samuel Kevin Wilson, Director of Community
IServices & Water, has recommended that the City Council award
1 Contract No. 540 to De La Cruz Construction, Inc., in the amount
2 quoted in the Proposal; and
3 WHEREAS, it is in the public interest and necessity
4 that Contract No. 540 for Vernon Gas Distribution System Phase III
5 be awarded to De La Cruz Construction, Inc., without necessity of
6 formal bids, as provided in Section 2.27(a) of the Vernon City
7 Code.
8 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
9 THE CITY OF VERNON AS FOLLOWS:
10 SECTION 1: The City Council of the City of Vernon
11 hereby finds and determines that the recitals contained
12 hereinabove are true and correct.
13 SECTION 2: The City Council of the City of Vernon
14 hereby awards Contract No. 540 to De La Cruz Construction, Inc.,
15 in the total sum of Four Million Nine Hundred Twenty-seven
16 Thousand Nineteen Dollars and Eight Cents ($4,927,019.08), in
17 accordance with the recommendation of Samuel Kevin Wilson,
18 Director of Community Services & Water and the Proposal submitted
19 by De La Cruz Construction, Inc., dated April 27, 1998, a copy of
20 which has been presented to the City Council concurrently with
21 this resolution, and the City Council hereby orders the Proposal
22 and Contract to be received and filed by the City Clerk.
23 SECTION 3: The City Council of the City of Vernon
24 hereby authorizes the Mayor and the City Clerk to execute said
25 Contract for, and on behalf of, the City of Vernon.

SECTION 4: The City Clerk of the City of Vernon shall
certify to the passage of this resolution, and thereupon and
thereafter the same shall be in full force and effect.
