A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF VERNON ACCEPTING THE WORK OF EXCEL PAVING
COMPANY IN ACCORDANCE WITH CONTRACT NO. 545
OF THE CITY OF VERNON
WHEREAS, Excel Paving Company was awarded Contract
No. 545 for work on Paving of Pump House No. 2 Yard pursuant
to Resolution No. 7075 of the City of Vernon; and
WHEREAS, Samuel Kevin Wilson, Director of
Community Services & Water has reported to the City Council
of the City of Vernon on May 13, 1998, that said work has
been completed and recommends that the work be accepted and
payment be made to the Contractor in accordance with the
agreement.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon
hereby finds and determines that the recitals contained
hereinabove are true and correct.
SECTION 2: The work of Excel Paving Company,
pursuant to Contract No. 545 is hereby approved and accepted
by the City Council of the City of Vernon.
SECTION 3: The total contract amount is a lump
sum of Fifty-three thousand Four Hundred Seventy-seven
Dollars ($53;477.00). There is now due to the Contractor a
final partial payment totaling Forty-eight Thousand One
Hundred Twenty-nine Dollars and Thirty Cents ($48,129.30),
which is payable at this time, and the remaining ten percent
2811 (10°s) of the total contract amount, or the sum of Five

Thousand Three Hundred Forty-seven Dollars and Seventy Cents
($5,347.70) is payable thirty-five days after the adoption
of this resolution.
SECTION 4: The City Council of the City of Vernon
hereby directs payment of said sums as set forth to Excel
Paving Company, and instructs the City Clerk to file a
notice of completion with the County Recorder.
SECTION 5: The City Clerk of the City of Vernon
shall certify to the passage of this resolution and
thereupon and thereafter the same shall be in full force and
effect.
