RESOLUTION NO. 7138
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF VERNON APPROVING AND AUTHORIZING THE
EXECUTION OF ENCROACHMENT LICENSE AGREEMENT
NO. 384 BY AND BETWEEN THE CITY OF VERNON AND
PEP BOYS, MANNY, MOE AND JACK OF CALIFORNIA
WHEREAS, Pep Boys, Manny, Moe and Jack of California
("Pep Boys") maintains eleven (11) cement concrete.footings in the
south side of 45th Street and thirteen (13) cement concrete
footings in the west side of Seville Avenue in the City of Vernon
("the Encroachment"); and
WHEREAS, the City Council is authorized to issue an
encroachment license, pursuant to Chapter 22, Article VI,
Encroachments, of the Code the City of Vernon, which license shall
be valid for a period of twenty-five (25) years unless otherwise
stated; and
WHEREAS, the City Council adopted Resolution No. 5088 on
February 21, 1984, authorizing fees for encroachment licenses; and
WHEREAS, the Director of Community Services and Water
has recommended approval of Encroachment License Agreement No.
384, to allow Pep Boys to maintain the Encroachment for a period
of twenty-five (25) years, subject to the terms and conditions of
the aforesaid Article VI of Chapter 22 of the Code of the City of
Vernon.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon
hereby finds and determines that the recitals contained
hereinabove are true and correct.

1 SECTION 2: The City Council of the City of Vernon
2 hereby approves the Encroachment License Agreement No. 384, a copy
3 of which has been presented to the City Council concurrently with
4 this resolution, and the City Council hereby orders said Agreement
5 to be received and filed by the City Clerk.
6 SECTION 3: The City Clerk of the City of Vernon shall
7 certify to the passage of this resolution, and thereupon and
8 thereafter the same shall be in full force and effect.
9 APPROVED AND ADOPTED this 19th day of May, 1998.
