RESOLUTION NO. 7152
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF VERNON AMENDING THE PROGRAM GUIDELINES FOR
THE CITY OF VERNON INFRASTRUCTURE LOAN PROGRAM
(COMMUNITY DEVELOPMENT BLOCK GRANT NO. 95-
EDBG-390) AS SUBMITTED TO THE STATE DEPARTMENT
OF HOUSING AND COMMUNITY DEVELOPMENT TO
EXCLUDE CITY MATCHING FUNDS FOR SEWER
IMPROVEMENTS
WHEREAS, the City of Vernon submitted Program Guidelines
for the City of Vernon Infrastructure Loan Program ("Guidelines")
to the State of California, Department of Housing and Community
Development ("State") under Community Development Block Grant
(CDBG) No. 95-EDBG-39.0, and said Guidelines were approved by the
State; and
WHEREAS, the Guidelines, as approved by the State,
inadvertently designated City funds for a 20% matching requirement
on sewer improvement projects; and
WHEREAS, the City's intent was to provide matching funds
for water and power utility relocation projects only, not for
sewer improvement projects; and
WHEREAS, Bruce V. Malkenhorst, City Administrator, has
recommended that Section 3.2 of the Guidelines be amended to
delete the requirement for City matching funds for sewer
improvement projects and provide instead that matching funds for
such projects should come from the business owner requesting a
loan.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon
hereby finds and determines that the recitals contained
hereinabove are true and correct.

SECTION 2: Sections 3.2 (1) and 3.2 (2) of the
Guidelines are amended to read as follows:
"(1) City -Owned Water and Power Utility Improvements
and Traffic Sicgnalization: For improvements classified as
City -owned utility improvements, the City of Vernon will
provide a 20-percent leverage of the cost of the improvements
using City funds. No match of private funds from the
business owner is required.
For example, if the total cost for the utility
improvements is $100,000, the public infrastructure loan will
be comprised of $80,000 Enterprise Funds and $20,000 in City
funds.
(2) Frontage (Curb Gutter, Sidewalk), Street Widening
and Sewer Improvements and Non -City -Owned Utility
Improvements: For improvements classified as frontage,
street widening or sewer improvements, or non -City -owned
utility improvements, the business owner requesting a loan
will be required to provide a 20-percent match of private
funds. No leverage of City funds will be provided.
For example, if the total cost for the frontage and/or
street widening improvements is $100,000, the Infrastructure
Loan Program will provide a loan up to $80,000. The
remainder will be provided by the business owner as a private
match."
SECTION 3: In all other respects, the Guidelines, as
submitted to and approved by the State, shall remain in full force

of this resolution to the State of California, Department of
Housing and Community Development, addressed as follows:

SECTION 5: The City Clerk of the City of Vernon shall
